The application is approved with the following conditions: 1. APPROVED PROjECT This approval is based on the arborist report prepared by Travis Evans (Certified Arborist #WE- 7613AU), dated September 26, 2013, consisting of four pages and a tree removal and replacement site plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is required to plant two 24-inch box replacement trees in accordance with the Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. The replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. The property owner will be required to replace and maintain the trees in accordance with the City's Tree Ordinance. 3. NOTICE OF FEES, DEDICATIONS. RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. 10601 S De Anza Blvd TR-2013-44 Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the tree cannot be removed until a final decision on the appeal has been made. Hillsdale Blvd. Suite 317 � Forster City, Ca. 94404 BY� _ Arborist Report On September 26, 2013, I observed one Southern Magnolia or Magnolia grandiflora tree at 10601 S. De Anza Blvd in Cupertino, Ca. The tree is located in the front of the property near the northeast corner of the building. The tree has codominant standards at approximately 3' above natural grade and the standards measure 53"and 78" in circumference at 4.5' above ground level. The tree is approximately 45 feet tall with approximate canopy spread of 45 feet. Through a thorough inspection, from ground level I was able to observe a number of defects in the tree. The tree is in a severe sta.te of decline. At the present time, it is in my estimation that there is only 5-10% of live tissue remaining in the tree. This dead tissue is likely attributed a couple of factors. The first and largest factor would be the root disturbance on the west side of the base of the tree. A new concrete walkway was installed within the last 5 years and in the process of installation, it appears that many basil roots were severed within 12"of the trunk of the tree. This amount of root loss not only compromised the tree's health but also compromises the tree's stability. The chance of a complete uprooting of the tree towards De Anza Blvd is greater possibility with the loss of the basil roots on the west side of the tree. In conclusion, with the amount of dead tissue and disturbance to the tree's root system, the tree poses as a high risk tree for the property. Based on the age, specie, dead tissue, and root loss, I strongly recommend removal of the trees in question as soon as possible.
