SUBJECT: TREE REMOVAL PERMIT ACTION LETTER—Application TR-2013-45
This letter confirms the decision of the Director of Community Development, given on November 5,
2013, approving a Tree Removal Permit to allow the removal of a dead Coast Live oak tree in the rear
yard of a single family residence located at 21946 Oakleaf Court. The application is approved with the
following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by Charles Ramskov, Ph.D., Registered
Consulting Arborist, dated September 19, 2013, consisting of 1 page, and a tree removal and
replacement plan except as may be amended by conditions in this resolution.
2. TREE REPLACEMENTS
The applicant is required to plant two(2) 24-inch box Acer Macrophylum replacement trees in
accordance with the Protected Tree Ordinance and approved tree replacement plan. Modifications to
the tree species and location may be made to the approved replacement plan pending staff approval.
The replacement trees shall be planted within 30 days of the effective approval date of this tree
removal permit.
3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and
a description of the dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.120 of the Protected Trees Ordinance.

The large Quercus Agrifolia in the back yard of 21946 Oakleaf Ct. Cupertino appears
to be in severe decline and has not been functional for some time. The Coastal Live
Oak is a large specimen and predates construction of the home of Mr.Joseph Chui.
The leaf material is quite chlorotic and shows decline from the south facing foliage
toward the north in progressive desiccation. The base and crown appear to be at
what was original height with respect to the soil margin. There is a large cavity
starting at the southwest facing crown flares and proceeds under the basal structure
of the tree. Also in evidence are several blossom sites for the most apparent cause
of decline overall,progressive root fungus, (Armillaria mellea) or oak root fungus.
Probes of the living layer of the tree indicate transpiration has mostly stopped and
the tree is functionally dead. A neighbors'attempt to water the crown area (hose
over the fence) was of little help and was likely counter productive.
I recommended to the homeowner that the removal permit process be started and
that a plan for removal be developed.
