SUBJECT: TREE REMOVAL PERMIT ACTION LETTER—TR-2013-10:
This letter confums the decision of the Director of Community Development, given on October 3, 2013,
approving a tree removal permit to allow the removal and replacement of a Deodar Cedar tree, located
at 21351 Vai Avenue. This removal is approved with the following conditions:
1. APPROVED PROJECT
This approval is based on the arborist report prepared by Simon Tunnicliffe (Certified Arborist#WE-
7505A), dated February 11, 2013, consisting of two pages and a site plan, labeled A-0 dated March
2013, except as may be amended by conditions in this resolution.
2. TREE REPLACEMENTS
The applicant is required to plant two 24-inch box replacement Coast Live Oak trees in accordance
with the Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree
species and location may be made to the approved replacement plan pending staff approval. The
replacement trees shall be planted within 30 days of the effective approval date of this tree removal
permit.
3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and
a description of the dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.180 of the Protected Trees Ordinance.
Please note, however, that an appeal of this decision can be made within 14 calendar days from
the date of this decision. If this happens, you will be notified of a public hearing, which will be
scheduled before the Planning Commission and the tree cannot be removed until a final decision
on the appeal has been made. If no appeal is made within the appeal period, the tree(s) may be
removed after Thursday, October 17,2013.

On February 8, 2013, a site visit was made to 21351 Vai Avenue, Cupertino CA 95014 to
_ evaluate and catalog trees (13 total)_ _
TREESURVAY
Tree#1 —Platanus (London Plane tree)—This tree has a circumference of 61", an approximate
height of 50' and a crown spread of 40'. As viewed,this is a normal, healthy tree.

Tree#2—Cedar Deodara—73" circumference, 60' height and a 20' crown�spread—In fair
condition, thus urban specimen is normal for urban cedars.
Tree#3—Cedar Deodara—41" circumference, 60' height and a 13' crown spread. This particular
tree is impacted by its larger neighbor#2 and is in marginal health.
Tree#4—Q. agrifolia(Coast live Oak)— 111" circumference, 50" height, 50' crown spread. This
tree is in good condition.
Tree#5—Q. agrifolia(Coast live Oak)— 117" circumference, 50" height, 48' crown spread—
This tree is in good condition.
Tree#6—P. radiata(Monterey Pine)— 111" circumference, 55' height, 30' crown spread. This
tree has a rather severe infestation of bark beetle (dendroctonus valens). The abundant piles of
"frass" and the sap "modules" at the base are definite indications of this destructive pest. If not
treated immediately, the vascular damage done will cause failure even though the pest may be
exterminated. The massive galleries carved out by this pest permanently damages the vascular
tissue with decline and failure usually within 1 year.

Tree#7—Q. agrifolia (Coast live Oak)— 1 17" circ��mfei-ence. 55" hzi�ht. 37� cco���n spread —
This tree_appeais„to be in normal, fair health.
Tree#8—Cedar Deodara—95" circumference, 75' height and a 45' crown spread. Located about
3 feet from the existing structure, this normally healthy tree is in the footprint of proposed
construction. It is only one of many large and beautiful size trees and although regretful, its
removal will not depreciate the crowded setting of 12 other mature trees. Removal is pending the
application of permits.
Tree#9—Coastal Redwood—This multi-trunk tree has a combined circumference of 63", 67",
_ -___-____- _ 26'-'-at-4.5-'-DBH measurement,-appraximately 65'-heightanda-20'--crown spread_-�his-tree-is-in ------
fair condition.
_ Tree#10_—Acer(Maple)—A multi-trunk tree, has a circumference of_36", 38",47" at 4.5 DBH._ _ _ __ _
The height is 50' and the crown spread is 40' —This tree is in fair condition.
Tree#11 —Podocarpus—This smaller double trunk tree has a circumference of 17" and 10", a
height of 18" and a crown spread of 9'. This tree is in fair condition.
Tree#12—Leyland Cypress_-_This tree_has a 40" circumferenc_e,.1_8' height and a 13' crown_ _ _______ _
_ _ _ _____ _ __ - _- -
spread. It is in marginal condition due to the symptoms of canker that is very common to this
species.
Tree#13—Acer(Maple)—This tree originates in the neighboring property but extends into
_ 21351 Property._Approximate circumference 63_", a_height of 45' and a crown spread_of 40_'_. This _ __

tree is in fair condition.
TREE PROTECTION
At the time of viewing,no station markers were visible so tree protection will consist of the
following recommendations:
Erect a 6' chain link fence at least 8 feet away from the trunk of any tree in close
proximity to construction. Trees not near any construction should have 6' chain link fence
erected at the dripline.No grade changes, traffic, storage of mater�als or dirt/debris, excavation,
rock cobbles or any human activity should take place in the area inside the fence. This is
designated the Tree Protection Zone or TPZ.
Soil compaction or human activity will impact the feeding absorbing roots found in the
top soil to keeping the grade beneath the canopy's in pristine condition is vital to long term
health.No venting of exhaust into the crowns of trees, any roots in proximity to or in the way of

consti-uction should be e��aluated and if necessary cut only by the supetti-ision of the Citv or

REC01VIN1END.�TION
Tree#5—
This tree is in good condition with a percentage of 15% removed from tree#5 (and also tree#7)
However, an old out of standard cable system is in place that through time has compromised the
tree by girdling both trunks. Our recommendation would be to remove and replace with a more
effective modern cable system(to ISA standards) Perform endweight pruning prior to cable
installation but not to exceed city specs of 25%.
Tree#1,#2 and #4—
Previous pruning has been done on this tree. I estimate about 20%has been taken out, however
lateral growth that encroaches over the street has not been pruned sufficiently, I.E. Heavy growth
and potential limb failure. It is recommended that the tree have selective thinning and pruning
back where necessary by 25%.
