A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
APPROVING THE GRANTING OF REAL PROPERTY TO THE STATE OF
CALIFORNIA
WHEREAS, The City Council of thE� City of Cupertino authorizes the City
Manager to execute a Grant Deed attached hereto and made a part hereof, which is in
good and sufficient form, granting the State of California real property to construct and
maintain a public highway situate by the Don Burnett Bicycle-Pedestrian Bridge
(formally Mary Avenue Bicycle Pedestrian Bridge) on two portions of land, one being
approximately 1,203 Square Feet and the other approximately 7 Square Feet more
particularly described in Exhibit "A", attached hereto and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Cupertino is approving said grant of real property; and
IT IS FURTHER RESOLVED that the State of California is hereby authorized to
record said Grant Deed and this resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 17th day of September, 2013 by the following vote:

California and being a portion of that certain Parcel of Land described in the Judgment
recorded on March 21,2012 as Document Number 21591730, Official Records of Santa Clara
County being more particularly described as follows:
Commencing at the northeast corner of the Parcel of Land described in said Judgement;
Thence South 00°52'43" West along the easterly line of said Parcel, a distance of 558.96 feet
to the True Point of Beginning;
Thence leaving said easterly line and continuing along the following nine (9) courses and
distances;
1. South 84°35'20"West,2.47 feet;
2. North 86°29'09"West,9.82 feet;

4. Northwesterly along the arc of a tangent curve to the left, having a radius of 100.00

This conveyance is made for the purpose of a freeway and the grantor hereby releases and
relinquishes to the grantee any and all abutter's rights including access rights,appurtenant to
grantor's remaining property, in and to said freeway.

Beginning at the northwest corner of the Parcel of Land described in said Quitclaim Deed said
point also being distance South 00°5243" West, 558.96 feet from the northeast corner of that
certain Parcel of Land described in the Judgement recorded on March 21, 2012 as Document
Number 21591730,Official Records of Santa Clara County;
Thence North 84°35'55" East along the northerly line of the land described in said Quitclaim
Deed, a distance of 9.72 feet to a point on the northerly Right-of-Way line of the Lands of the
State of California (Junipero Serra Freeway);
Thence westerly along said northerly line South 76°06'39" West, 10.00 feet to a point on the
westerly line of the Parcel of Land described in said Quitclaim Deed.
