Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. BACKGROUND The applicant, Barre Barnes, obtained approval for a 4,478+square foot hillside residence from the Planning Commission on June 12, 2012 (Attachment A). The applicant is proposing minor building and site changes to the previously approved hillside residence. The proposed revisions outlined below have a net effect of reducing the building area by 70 square feet. 1) Change exterior treatment from concrete siding to stucco finish. 2) Eliminate a Gazebo (150.88 sq ft.). 3) Change the proposed impervious area form 1232.09 sq ft to 849.51 sq ft. 4) Change in roof line to eliminate any roof overhangs into the PG&E easement area. DISCUSSION Many of the exterior changes will not intensify the visual impact of the house on the surroundings. The most visible changes are to the roof line and the exterior building finish. The roof line change is proposed to eliminate any roof overhangs into the PG&E easement area. No other interior or exterior changes are proposed. No other interior or exterior changes are proposed. The project is consistent with the City's Residential Hillside Zone ordinance. See the attached plan set for more information. In response to the public noticing, Staff received concerns from the Midpeninsula Regional Open Space District (MROSD) regarding potential visual impacts from the project as viewed from DIR-2013-25 21740 Rainbow Drive Page 2 certain vistas and/or trails. The proposed deck has a finished elevation of 663 feet, while the nearby ridgeline of the adjacent MROSD parcel is nearly 100 feet higher at about 760 feet. There will be no visual impacts into the majority of the MROSD lands. Neither the deck (nor the residence) is located on a prominent ridgeline nor are there any nearby hillside residences. In response, the owner proposed to mitigate the concern by planting native drought tolerant vegetation in areas of the house and along retaining wall. ACTION The Director of Community Development deems the modification minor and generally consistent with the approved hillside exception, and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on Plan Set titled:, "21740 Rainbow Drive, Cupertino, California, Single Family Residential New Construction", consisting of 17 sheets dated August 14, 2013, and labeled A000, A00, A01.1, A01.2, A02 through A09, 1 through 4, except as may be amended by the conditions contained in this memorandum. 2. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 3. PREVIOUS CONDITIONS OF APPROVAL All prior conditions of approval through past approvals shall remain in effect unless superseded by or in conflict with subsequent conditions of approval, including conditions of approval for EXC-2011-11 and TR-2012-19. 2. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. 2. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest DIR-2013-25 21740 Rainbow Drive Page 3 these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a),has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. 3. LANDSCAPE REVIEW A revised and detailed landscape plan shall be submitted with the building permit plan set and reviewed and approved by the Director of Community Development in conformance with the RHS zoning standards. T'his Director's approval is effective October 1, 2013. The fourteen calendar day appeal period will expire on October 16, 2013.
