Subject: Director's Minor Modification, DIR-2013-24, to a previously approved Architectural and Site
Approval (ASA-2011-12) to allow outdoor patio enhancements at an existing restaurant
(Islands) located at 20750 Stevens Creek Boulevard.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow an appeal of the decision within fourteen
calendar days.
DISCUSSION
The applicant, Geet Gill and Nina Raey, representing Islands Restaurant and the property owner, Byer
Properties, is requesting a modification to a previously approved Architectural and Site Approval
permit (ASA-2011-12) to allow outdoor patio enhancements at Islands Restaurant located at 20750
Stevens Creek Boulevard within the Crossroads Shopping Center. The building pad and outdoor patio
area for Islands were originally approved by the City Council in November 2011 (DP-2011-03 and ASA-
2011-12). The City Council approved a subsequent Conditional Use Permit (U-2012-01) for Islands in
May 2012 for late night hours and for separate interior bar facilities.
The proposed modifications to the outdoor patio include the following:
• Removal of existing metal railing on the west, north, and south elevations and replacement with
horizontal cedar wood boards with a transparent glass windscreen on top, totaling 6 feet in height
• Removal of existing metal gates on the north and south elevation and replacement with transparent
glass gates
• New roll-down sun shade along the west and south elevations
• New flame table
There are no increases in total seating or employees for the restaurant in conjunction with the proposed
enhancements. The design, colors, and materials of the proposed outdoor patio modifications are
compatible with the building and will enhance the outdoor dining experience.

ACTION
The Director of Community Development deems the modification minor and approves the project with
the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits entitled: "Islands Restaurants, Cupertino, CA" prepared by Lee &
Sakahara Architects, AIA, received September 10, 2013, and consisting of five sheets labeled A0.1,
A1.1, A2.1, A4.1, and A6.1; except as may be amended by the conditions contained in this
resolution.
2. PREVIOUS CONDITIONS OF APPROVAL
The following previous conditions of approval for the project site shall remain in effect:

3. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the first page of
the building plans.
4. BUILDING PERMITS
The applicant shall consult with the City Building Division to obtain the necessary building permits
for the installation of the aerials and associated equipment.
5. FINAL REVIEW OF OUTDOOR PATIO AREA COLORS AND MATERIALS
The final color and material palate for the outdoor patio area, including, but not limited to, the
wood boards, glass windscreen and gates, flame table, and sun shade shall be reviewed and
approved by the Director of Community Development prior to building permit issuance. The
Director may approve minor modifications to the approved plans as deemed appropriate.
6. REMOVAL OF PLASTIC DRAPES
The unpermitted plastic drapes in the outdoor patio area shall be removed in conjunction with this
project.
7. ABC LICENSING REQUIREMENTS
The outdoor seating area shall comply with Califomia Department of Alcoholic Beverage Control
(ABC) licensing requirements.
8. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,

including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
9. NOTICE OF FEES,DEDICATIONS. RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
This approval of the modification is effective September 16, 2013. The fourteen calendar day appeal
period will expire on September 30, 2013.
