SUBJECT: TREE MANAGEMENT PLAN ACTION LETTER—TMP-2013-01:
This letter confirms the decision of the Director of Community Development, given on
September 5, 2013, approving a tree management plan to permit the removal and replacement
of trees over a 10 year time frame (2013-2022) located at the 10080 Scenic Boulevard (Meadows
of Cupertino). This removal is approved with the following conditions:
1. APPROVED PRO�
Approval is based on the tree management plan (TMP) dated June 26, 2013 prepared by
Michael Bench (ISA Certified Arborist-# 1897), consisting of thirty-seven (37) pages, except
as may be amended by conditions in this approval.
2. TREE REMOVALS AND REPLACEMENTS
All trees specified for removal in the Tree Management Plan (TMP) may be removed in the
TMP may be removed and replaced within the specified time frame per the TMP without
the tree removal permit(s). Proposed tree removal(s) and replacement(s) shall take place
between the 2013-2022 timeframe as specified by the TMP dated June 26, 2013. The applicant
shall provide a notice to the city at least two week in advance and place notice on the tree
scheduled to be removed at least 1 week in advance prior to removal.
The applicant is requested to plant replacement trees in conjunction with those specified in
the TMP. The applicant shall maintain a log of the tree removal(s) and replacement(s) and
provide to the city every year.
3. RECORDATION FO TREE MANAGEMENT PLAN
The TMP shall be recorded on the property in accordance with the Protected Trees
Ordinance.
4. MODIFICATIONS TO APPROVED TREE MANAGEMENT PLAN
Any additional tree removal(s) which are not included in this TMP or deviation from the
TMP will require separate review and approval from the Community Development
Department.
5. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City,
its City Council, its officers, employees and agents (the "indemnified parties") from and
against any claim, action, or proceeding brought by a third party against the indemnified
parties and the applicant to attack, set aside, or void this ordinance or any permit or
approval authorized hereby for the project, including (without limitation) reimbursing the
City its actual attorneys' fees and costs incurred in defense of the litigation. The City may,
in its sole discretion, elect to defend any such action with attorneys of its choice.
6. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
Staff has made the findings necessary to grant the tree management plan permit in accordance
with Section 14.18.130 and Section 14.18.180 of the Protected Trees Ordinance.
Please note, however, that an appeal of this decision can be made within 14 calendar days
from the date of this decision. If this happens, you will be notified of a public hearing,
which will be scheduled before the Planning Commission and the tree(s) cannot be removed
until a final decision on the appeal has been made. If no appeal is made within the appeal
period,the tree(s) may be removed after Friday, September 20,2013.

THE MEADOWS OF CUPERTINO
TREE MANAGEMENT PLAN
Proposal
The Home Owner's Association of The Meadows of Cupertino propose a ten year Tree Management
Plan for the development site. Since the time of development(approximately 1975) several trees have
died and have been replaced. Several trees have declined and are in need of replacement. Some have
reached maturity and are over crowded or are starting to decline. Some trees have caused infrastructure
damage resulting in repairs.
Rather than replacing trees randomly, the Meadows Home Owner's Association proposes to initiate this
replacement plan for the long term to maintain the urban tree canopy in this development and to address
the current and expected future environmental conditions. It is expected that water resources will
decrease in the near future. This plan proposes to replace high water consuming trees with low water
consuming trees in grouped areas a few at a time. By the tenth year,the majority of the high volume
water consuming trees would be replaced by low to very low water consumers.
Priorities for Removal and Replacement
l. Trees observed to be Hazardous
2. Trees causing infrastructure damage
3. High water consuming trees
4. Invasive species
5. Overcrowded trees which are subdominant or suppressed
Because of the density of the planting in this development, this plan proposes to replace protected trees
on a 1:1 Ratio.
History
The original Landscape Plans L1A, L 2, L3A for this development were dated 1976. It appears that the
landscape was planted in 1976 or 1977.
The 1976 Landscape Plans on micro-film were very difficult to read. Many of the plants on the list were
obscured and unreadable. The following trees were found on the 1976 Plans:

Based on their size and placement, it appears that the following trees, which could not be read from the
1976 Plan List,were planted into the 1976 Landscape:

Planting Notes
Texas privet(Ligustrum texanum), which is a shrub, is listed on the 1976 plans, but it appears that a few
Japanese privet(Ligustrum japonicum)trees were planted either by mistake or as substitutes. Ligustrum
japonicum self seeds profusely and is invasive. None of the small specimens of Japanese privet existing
today could have been planted. They no doubt have sprouted as volunteers. Based on size (trunk
diameter), it appears that only Trees# 159, 165 and 175 were planted as part of the 1976 Landscape. All
of the others Japanese privet trees in the current Tree Inventory are volunteers.
Trees Egisting Prior to 1976
Coast live oak(Quercus agrifolia)also self seeds. It is very unlikely that any of the oaks on this properly
were planted. All were volunteers. Those specimens 8 inches in diameter or larger are estimated to have
existed by 1976.
The following species at this site also existed prior to 1976:

California black walnut (Juglans hindsii)—Trees # 54, 68, 70, 74, 78, 81, 82, 132, 134.

Tree Inventory
An Inventory of the existing trees was prepared by Lucy Leeburg, certified arborist, Saratoga Tree
Service, July 30, 2012. A Tree Map of the Existing Trees is in the attachments.
This inventory was updated by Michael L. Bench, Consulting Arborist, May 2013.
T'here are 210 existing trees. These trees have been tagged with metallic labels for field identification.

Replacement Schedule
This plan proposes to remove and replace a few trees per year for ten years, 2013-2022. The planned
removals and replacements are listed by year in the attachments. For each successive year a Tree Map
indicates the trees planned to be removed and the approximate locations of the replacements. The 2013
replacement specimens start with Tree # 250. All trees after Tree # 250 would be recognized as
replacement specimens on. The Tree Maps are updated for each successive year. The replacement
species aze noted of each the replacement tree, which is numbered and marked on the map. The
objectives for each year are described with each successive year.

Non-Protected Trees
Several trees are indicated to be non-protected specimens on the Inventory of Trees. These trees are not
one of the following categories:
1. They are currently too small to have e�sted prior to 1976.
2. Were not included in the Landscape Plan of 1976.
3. Were not planted since 1976 as Replacement specimens.
Many of these small trees have sprouted from invasive species since 1976. A few are sub-dominant or
suppressed native species resulting in over-crowding. Three deodar cedar specimens, Trees#22, 23,
and 24 are healthy specimens, but were planted too close to a cluster of coast live oak specimens. In
time these cedars will damage the oak specimens by shading.
This plan proposes to remove in 2013 and 2014 the following non-protected invasive specimens,the
poor specimens, and those specimens creating over crowding. They are Trees# 12, 13, 15, 16, 17, 22,
23, 24, 39, 49, 149, 151, 152, 153, 154, 155, 156, 157, 158, 165, 169, 170, 171, 173, 174, 176, 177, and
178. The removal of these will reduce the competition to the adjacent trees and will create spaces to
plant appropriate replacement trees. For example, compare the north side Common Area 2013 to the
proposed final version of this area in 2016.
Procedures for Trees Not in the Plan
Any new proposals for removal of trees not approved within the TMP shall require City review through
a tree removal permit or new tree management plan. Tree removal permit applications shall include
completed application forms; an ISA-certified arborist's report; tree pictures; site plan showing removal
and replacement locations, size, and species; HOA approval; and any other information required by the
Protected Tree Ordinance.
Notification Procedures
The HOA sha11 notify the City at least 2 weeks in advance before trees approved under the TMP are
removed. The HOA shall post notices on the trees scheduled for removal at least 1 week in advance
prior to removal.
An ISA-certified arborist shall confirm in writing that the required replacements have been planted
properly and according to plan. The HOA shall provide this documentation to the City within 30 days of
the tree removals. The HOA shall maintain a log of the tree removals and replacements and provide to
the City to include in the file.

Replacements
Plant adequately spaced on the slope near Scenic Boulevard—This would allow for a
greater space near Adelheid Court for shubs, perennials and other small accent trees.
This Park Area on the west side of Adehlheid Ct. is sloped and not very usable for
recreation. The replacement trees would provide a better screen for the homeowners on
Adehleid from the uphill side neighbors along Scenic Boulevard and from vehicles on
Scenic Boulevard. Accent shrubs, perennials, and small trees planted along Adelheid
would be a significant enhancement to the residents on Adelheid Court.
