Subject: Director's Minor Modification (DIR-2013-19) to allow the installation of a basketball half court
and associated site improvements at an existing office park(Results Way) and a
Tree Removal Permit (TR-2013-33) to allow the removal and replacement of four Camphor
trees to accommodate the construction of a basketball court and associated site improvements
at an existing office park (Results Way).
Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow an appeal of the decision within fourteen calendar
days.
DISCUSSION
David Schaefer, with XL Construction, proposes to upgrade an existing patio and landscaping area to
create a more active space for office employees to play and watch basketball.
Location
The project site is located at the east patio of the existing Apple office buildings at 14 Results Way,
bounded by Union Pacific Railroad tracks to the east, a parking lot and Results Way to the south, and
office buildings and parking lots to the north and west.

Site Improvements
Construction is to include a new concrete slab and an extended hardscape for north access buildings
between the building 15 loading dock and the patio, new ipe wood wrapped concrete benches, a rubber
half-court complete with basketball pole and hoop, and a new metal grid fence.

Landscaping
The plans call for the removal of two redwood trees (previously approved for removal as part of TR-
2011-42) and an additional four camphor trees ranging in diameter from 2" to 4" which are being
processed by the associated TR-2013-33. Replacement planting includes two oak trees and two 24" box
redwood trees to infill gaps in the evergreen screen and to fit into the existing groves.

Interior to the office park, and obscured by fencing, the proposed basketball court and associated site
improvements are not anticipated to result in a noticeable impact to the general public.
ACTION
In accordance with Cupertino Municipal Code Section 19.164, the Director of Community Development
deems the modification minor and approves the modification described in the plan set titled: "APPLE
RESULTS WAY CUPERTINO, CA 95014" prepared by Studios architecture, and consisting of five (5)
sheets labeled A0.01, A1.01, A2.01 and A7.01 last revised 06/17/13 and stamped as received 6/17/2013,
except as may be modified by the conditions enumerated below.
1) ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the first page of
the building plans.
2) BUILDING PERMIT REQUIRED
This approval does not constitute building permit approval; a separate building permit is
required.
3) ACCURACY OF THE PROJECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but
not limited to property boundary locations, building setbacks, property size, building square

footage, any relevant easements and/or construction records. Any misrepresentation of any
property data may invalidate this approval and require additional review.
4) TREE RELACEMENTS
The applicant is required to plant at least two 24-inch oak, and two 24-inch redwood trees in
accordance with the Protected Tree Ordinance and approved tree replacement plan.
Modifications to the tree species and location may be made to the approved replacement planting
plan pending staff approval. The replacement trees shall be planted prior to buildin�final.
5) CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
6) INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its
City Council, its officers, employees and agents (the "indemnified parties") from and against any
claim, action, or proceeding brought by a third party against the indemnified parties and the
applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby
for the project, including (without limitation) reimbursing the City its actual attorneys' fees and
costs incurred in defense of the litigation. The City may, in its sole discretion, elect to defend any
such action with attorneys of its choice.
7) NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of
Section 66020, you will be legally barred from later challenging such exactions.
This approval is effective August 12, 2013. The fourteen calendar day appeal period will expire on
August 26, 2013. If no appeal is made within the appeal period, the tree(s) may be removed after
Monday,August 26, 2013.

Re: 16 Resuits Way Tree Removal Permit Application Justification Statement
To Whom It May Concern:
This letter is to address the removal of four(4) Cinnaminom Camphoras noted on Demolition
Plan C1.0 and required to begin construction of the Building 16 Basketball Court on the Results
Way Campus.
The four trees are small trees less than 4" in diameter and located in the center of the 616
exterior patio. The B16 Basketball Court site is an interior site that solely serves the campus
users and has minimal visibility to the public.
We will be replacing the 4 camphor trees with the following trees as noted and shown on
Replacement Plan A1.01:
• Two (2) -24" box Coast Live Oaks (Quercus agrifolia)and be planted to infill gaps in
the South of property perimeter lawn berm to serve as an evergreen screen tree
buffer between property and public
• Two (2) -24" Coast Redwoods (Sequoia sempervirens)to be planted around the
basketball court to infill the gaps and provide a similar evergreen screen within the
existing grove of Coast Redwoods in this location.
