Subject: Director's Minor Modification, DIR-2013-23, to permit a previously unpermitted 257
square foot exterior storage addition at an existing bowling alley located at 20990
Homestead Road.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Greg Malley, representing the property owner, Silvercreek Yuba 1 LLC, is
proposing to permit three previously unpermitted exterior sheds totaling 257 square feet along
the south wall of the Homestead Lanes bowling alley located at 20990 Homestead Road. The
sheds are used exclusively for storage purposes.
The storage sheds are attached to the building wall and mimic the existing exterior colors and
materials of the bowling alley. The sheds are minimally visible from the public right-of-way
given their size, distance from the street, and screening by the existing building and
landscaping. The storage sheds are 5 feet wide, and vary in length from 9 feet, 10 inches to 19
feet, 9 inches. The storage sheds are approximately 9 feet tall to the top of the plate, and are
setback 15 feet to the south side property line and over 250 to the west (Stelling) property line.
There are no setback requirements in the P (Recreation, Entertainment) zone in which the
bowling alley is located, however the setback to the south property line is consistent with the
General Commercial Ordinance.
The project is not anticipated to generate any additional parking demand since the addition is
only for non-habitable storage space.

The applicant also proposes the following other exterior modifications in conjunction with the
permitting the addition:
• ADA accessibility upgrades in the parking lot
• New fence with 3 foot high gate securing access to the south side building setback area
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Homestead Lanes Interior Improvements, 20990
Homestead Road, Cupertino, CA," prepared by MBA Architects, received July 29, 2013,
and consisting of six sheets labeled 1, CC1, 1.2, 2, 3.1, and 3.2; except as may be amended
by the conditions contained in this resolution.
2. BUILDING PERMITS
The applicant shall consult with the City Building Division to obtain the necessary building
permits for the installation of the aerials and associated equipment.
3. PARKING
Additional parking space(s) is not required as long as the additional approved square
footage in the storage sheds is used for storage and other non-habitable uses. If the
applicant desires to use this area for any other habitable use, the City may require
additional parking in accordance with the requirements of the approved Use Permit (U-
1974-15) and/or the Parking Ordinance.
4. DEVELOPMENT ALLOCATION
The applicant shall receive an allocation of 257 square feet of retail commercial allocation
from the Heart of the City General Plan area.
5. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City,
its City Council, its officers, employees and agents (the "indemnified parties") from and
against any claim, action, or proceeding brought by a third party against the indemnified
parties and the applicant to attack, set aside, or void this ordinance or any permit or
approval authorized hereby for the project, including (without limitation) reimbursing the
City its actual attorneys' fees and costs incurred in defense of the litigation. The City may,
in its sole discretion, elect to defend any such action with attorneys of its choice.
6. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS

The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective August 1, 2013. The fourteen calendar day
appeal period will expire on August 15, 2013.
