CC 06-18-2013 ASS i 9N CUPERTINO APPROVED MINUTES CUPERTINO CITY COUNCIL Special Meeting Tuesday, June 18, 2013 CITY COUNCIL MEETING ROLL CALL At 5:10 p.m. Mayor Orrin Mahoney called the City Council meeting to order in City Hall Conference Room A, 10300 Torre Avenue, Cupertino, CA. Present: Mayor Orrin Mahoney, Vice Mayor Gilbert Wong, and Council members Barry Chang, and Mark Santoro. Absent: Rod Sinks. CLOSED SESSION 1. Subject: Conference with Labor Negotiator (Government Code 54957.6); Agency designated negotiators: Director of Administrative Services, City Manager, and Dania Torres Wong; Employee organizations: Operating Engineers Local No. 3 Union; Cupertino Employees' Association; Unrepresented (Management and Confidential) Employees' Compensation Program; Appointed Employees' Compensation Program At 5:10 p.m. Council recessed to a closed session, and reconvened in open session at 6:45 p.m. Mayor Mahoney announced that Council obtained a briefing from labor negotiators and gave direction. No action was taken. PLEDGE OF ALLEGIANCE At 6:45 p.m. Mayor Orrin Mahoney reconvened the City Council meeting in the Community Hall Council Chamber, 10350 Torre Avenue, Cupertino, CA and led the Pledge of Allegiance. Tuesday,June 18, 2013 Cupertino City Council Successor to the Redevelopment Agency ROLL CALL Present: Mayor Orrin Mahoney, Vice Mayor Gilbert Wong, and Council members Barry Chang, and Mark Santoro. Absent: Rod Sinks. CEREMONIAL MATTERS AND PRESENTATIONS 2. Subject: Certificates of Appreciation for all Cupertino students who won an award at the Synopsys Championship a regional science fair Recommended Action: Present certificates Forest Williams, President of the Santa Clara Valley Science and Engineering Fair Association explained that the association sponsors a regional, state, and international science fair and that over 1000 students participate. He noted that the association's mission is to awaken in each student that desire to pursue the opportunities and the challenges offered by science and engineering. Mayor Mahoney presented the certificates to the students. POSTPONEMENTS Wong moved and Chang seconded to table item number 13. The motion carried with Sinks absent. ORAL COMMUNICATIONS Barbara Rogers talked about the need for long-range planning for older adult housing in order to be ready for Cupertino's changing demographics. She also distributed her comments. Chuck Johnson talked about 4 proposals for public safety: tax on restaurants based on amount of plastic waste, make the walkways on Alves Dr. safer by adding signs, designate the curbs at end of Alderbrook Lane at south entrance to Creekside Park as short-term parking, and add a crosswalk across Bollinger at Hyde Ave in Cupertino/San Jose. He also distributed his comments. Ayes: Chang, Mahoney, Santoro, and Wong. Noes: none. Abstain: Santoro abstained from item number 10. Absent: Sinks. 3. Subject: Accept Accounts Payable for period ending May 24, 2013 Recommended Action: Adopt Resolution No. 13-054 accepting Accounts Payable for period ending May 24, 2013 7. Subject: Accept Accounts Payable for period ending May 31, 2013 Recommended Action: Adopt Resolution No. 13-055 accepting Accounts Payable for period ending May 31, 2013 8. Subject: Adopt a resolution updating the settlement authority granted to the City Attorney from$1,500 to $15,000 Recommended Action: Adopt Resolution No. 13-056 delegating to the City Attorney authority to compromise, settle, or dismiss any claim or action for or against the City for an amount not exceeding fifteen thousand dollars ($15,000) Written communications for this item included a copy of adopted Resolution No. 5120. 9. Subject: Adopt a position opposing AB 325 (Alejo), a bill that would extend the statute of limitations relating to housing elements Recommended Action: Accept Legislative Committee and League of California Cities recommendation to oppose AB 325 (Alejo) as amended on 5/29/2013 Tuesday, June 18, 2013 Cupertino City Council Successor to the Redevelopment Agency 10. Subject: Adopt a support position on Measure A, to maintain and protect library services by continuing community funding at existing rates with no increase in taxes Recommended Action: Adopt a support position of Measure A as submitted to the Registrar of Voters by the Joint Powers Authority Board of the Santa Clara County Library District 11. Subject: Application for Alcoholic Beverage License, Peacock Indian Cuisine & Bakery, 10251 S De Anza Boulevard Recommended Action: Approve application for Alcoholic Beverage License, Peacock Indian Cuisine & Bakery, 10251 S De Anza Boulevard 12. Subject: Brush abatement for public nuisance and potential fire hazard Recommended Action: No hearing needed. Remove item from the agenda SECOND READING OF ORDINANCES - None PUBLIC HEARINGS - None ORDINANCES AND ACTION ITEMS 13. Subject: Consider support of the Santa Clara Valley Transportation Authority (VTA) federal grant application to add a lane to some portions of Highway 85 and convert the HOV lane into an express lane in other portions Recommended Action: Consider whether or not the Council should support the Santa Clara Valley Transportation Authority (VTA) federal grant application Description: The City Council Legislative Committee met and discussed this item on Wednesday, May 29, 2013. The committee passed the request to Council without a recommendation Under postponements, this item was tabled. 14. Subject: Consider canceling the July 2 City Council meeting Recommended Action: Consider canceling the July 2 meeting Wong moved and Chang seconded to cancel the July 2 City Council meeting. The motion carried unanimously with Sinks absent. Tuesday, June 18, 2013 Cupertino City Council Successor to the Redevelopment Agency REPORTS BY COUNCIL AND STAFF City Manager David Brandt mentioned that the City would be hosting fireworks on the Fourth of July and noted that many activities would be taking place in the morning, beginning with a pancake breakfast and children's parade. Council members highlighted the activities of their committees and various community events. ADJOURNMENT At 7:15 p.m., the meeting was adjourned to July 16. The July 2 meeting was canceled.
