Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION The applicant, Kapil and Neena Bhatnagar, is requesting approval to add 461 square feet to the rear of their existing residence at 20303 Cartwright Way, which is located in a Planned Single- Family Residential Cluster P(R1C) zoning district. The development, Vista Gardens, was originally approved by the City in 1974 as part of application nos. Z-1974-03, U-1974-21, and TM-1974-08. In accordance with the conditions of the original development approval, any minor exterior changes must be approved by the Director of Community Development. The proposed addition substantially conforms to the R1C Ordinance and the conditions of the original development approvals. Additionally, the proposed addition is consistent with the design and materials of the existing residence. The applicant has obtained homeowner's association approval for the proposed project. The site and elevation plans were circulated to the adjacent property owners for a two-week review period. No comments were received by the City. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: DIR-2013-21 20303 Cartwright Way Page 2 1. APPROVED EXHIBITS Approval is based on exhibits titled: "Bhatnagar Residence, 20303 Cartwright Way, Cupertino, CA 95014," prepared by SC Design Group, received June 26, 2013, and consisting of three sheets labeled A-1.0, A2.0, and A3.0; except as may be amended by the conditions contained in this resolution. 2. BUILDING PERMITS The applicant shall consult with the City Building Division to obtain the necessary building permits for the installation of the aerials and associated equipment. 3. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. 4. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval of the modification is effective July 22, 2013. The fourteen calendar day appeal period will expire on August 5, 2013.
