Subject: Director's Temporary Use Permit, TUP-2013-03, to allow the construction of a
temporary mock up building in the rear parking lot located at 10435 N. Tantau
Avenue; and
Retroactive Tree Removal Permit, TR-2013-26, to allow the removal and replacement
of 2 trees to facilitate the construction of a temporary mock up building in the rear
parking lot located at 10435 N. Tantau Avenue.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of a temporary use permit, authorizing the use of a site in any zoning
district for a temporary use. The Director reports the decision to the City Council
& Planning Commission in time to allow an appeal of the decision within
fourteen calendar days of approval.

280 and Pruneridge Avenue. The project will be sufficiently parked and will not negatively
affect the parking demand of the entire site since the number of employees occupying the
existing office building is anticipated to be less than the amount of displaced parking for the
lifespan of the proposed temporary mock up building.
The temporary mock up building will be visible from the parking lots of the adjacent properties,
which currently are all owned by Apple. The project will have limited visibility along
Pruneridge Avenue. The project is proposing an eight-foot high construction fence around the
mock-up building, which will additionally help screen the proposed building from the public
right-of-way. Large construction apparatus and temporary building scaffolding shall be placed
or erected to facilitate the construction of the building during the initial six months of
construction.
The mock up building is approximately 20 ft in height and consists of 9,100 s.f. The building
will be primarily used for the display and testing of various architectural products, building
material samples and mechanical systems.
Trees:
Two Shamel Ash trees have been removed in order to facilitate the construction of the mock up
building. None of these trees were considered Specimen Trees as defined by the City's
Protected Tree Ordinance, but were considered protected trees nonetheless. Retroactive Tree
Removal fees have been collected, and replacement trees will be required as part of the larger
Apple Campus 2 project in accordance with the City's Protected Tree Ordinance.
Environmental Determination:
The project has been deemed to be Statutorily Exempt pursuant to Section 15268 of the CEQA
Guidelines (Ministerial Projects) and Categorically Exempt under Sections 15311, 15332 and
15304.
Since the project site is subject to the preparation of an Environmental Impact Report, the
project has been reviewed by the Environmental Consultant, LSA Associates to identify
conditions of approval that this temporary project would be subject to as well.
The Director of Community Development approves the temporary use permit and retroactive
tree removal permit with the following conditions of approval:
1. APPROVED EXHIBITS
This approval is based on Exhibits titled "RG1A Mockup" prepared by Foster+Partners
dated 5/15/13 consisting of pages P-1.00, P-1.10, P-1.1, P-2.00, P-3.00, Prototype Concept
Rendering, and Prototype Core and Shell Breakdown, except as may be amended by the
Conditions contained in this Resolution.

2. EXPIRATION DATE
This approval shall expire on July 10, 2014. The applicant may apply for a Temporary
Use Permit at that time for an extension of time.
3. REMOVAL OF TEMPORARY STRUCTURES AND IMPROVEMENTS
The applicant shall remove all temporary structures and associated improvements and
restore the site to its originally approved condition within 3 months of expiration of the
temporary use permit unless an extension is filed by the expiration date of the permit
and subsequently approved by the Director of Community Development.
4. ADDITIONAL CONDITIONS OF APPROVAL
The applicant shall adhere to applicable conditions of approval outlined in the memo
with a subject line: "RC-1A Mockup Statutory Exemption Analysis" dated 7/3/2013 from
LSA Associates.
5. TREE REPLACEMENTS
Tree replacements for the retroactive tree removal permit will be required in conjunction
with the larger Apple Campus 2 project.
6. MINOR MODIFICATIONS
Further interior and exterior modifications to the mock up building may be completed
administratively if deemed minor by the Director of Community Development.
7. BUILDING OCCUPANCY
Prior to the issuance of the Certificate of Occupancy or Temporary Certificate of
Occupancy, the applicant shall ensure the building is constructed based on the
California Code standards that the building is designed and permitted under and all
appropriate inspections are signed-off based on the approved design.
The fourteen calendar day appeal period will expire on June 24, 2013.
