Subject: Director's Minor Modification, DIR-2013-17 to allow a 275 square foot addition
to an existing retreat center at 22840 Mercedes Road
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports their
decision to the City Council and Planning Commission in time to allow an
appeal of the decision within fourteen calendar days.
DISCUSSION
The applicant, Salvatore Caruso, representing the property owner, Ramona Blvd, Inc., is
proposing to expand an existing chapel and conference/dining room by 275 square feet
at the Our Lady of Santa Clara Retreat located at 22840 Mercedes Road. A General Plan
development allocation is not required since this project is in a BQ (Quasi-Public)
zoning district and not a residential, commercial, office, or hotel project. In addition, the
project is not anticipated to generate any additional parking demand since the
expansion is only for amenity space.
The 116 square foot conference/dining room expansion will be minimally visible from
the public right-of-way on Mercedes Road. The 159 square foot chapel addition to the
rear proposes to increase the height of the existing sloped roof by approximately four
feet to a total height of 21 feet. The total height is within the limitations prescribed by
the General Plan. Even with the height increase, the addition is not anticipated to be
visible from the public right of way given the coverage by existing vegetation. The
colors and materials of the addition will match the existing structure.
The applicant also proposes the following other modifications in conjunction with the
addition:
• Remodel approximately 915 square feet of the existing interior foyer and lobby areas
• Add two new windows on the north elevation at the expanded conference room

• Add two new doors on the north elevation to match the existing
• Replace existing window with double doors on the south elevation near the
expanded chapel
Staff supports the proposed addition because it is not anticipated to create any
substantial visual or parking impacts, and it is consistent with the existing retreat
building.
ACTION
The Director of Community Development deems the modification minor and approves
the project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Our Lady of Santa Clara, 22840 Mercedes
Road, Cupertino, CA 95014," received June 20, 2013 and consisting of 7 sheets
labeled A0.1, A1.1, A2.1, A2.2, A3.1, A3.2, and A3.3; except as may be amended by
the conditions contained in this resolution.
2. BUILDING PERMIT
The applicant shall consult with the Building Division to obtain the necessary
permits required for the proposed addition.
3. PREVIOUS CONDITIONS OF APPROVAL
All prior conditions of approval through past approvals, including, but not limited
to ASA-2010-04, TR-2010-40, DIR-2007-22, U-1989-02, and U-1972-05 shall remain in
effect unless superseded by or in conflict with subsequent conditions of approval,
including conditions of approval for DIR-2013-17.
4. TREE REPLACEMENTS
The replacement trees associated with Tree Removal Permit file no. TR-2010-40 shall
be planted prior to final occupancy of building permits.
5. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with
regard to the proposed project for additional conditions and requirements. Any
misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
6. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the
City, its City Council, its officers, employees and agents (the "indemnified parties")
from and against any claim, action, or proceeding brought by a third party against
the indemnified parties and the applicant to attack, set aside, or void this ordinance

or any permit or approval authorized hereby for the project, including (without
limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any
such action with attorneys of its choice.
7. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66020(d) (1), these Conditions constitute written notice of
a statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you
fail to file a protest within this 90-day period complying with all of the requirements
of Section 66020, you will be legally barred from later challenging such exactions.
This approval of the modification is effective July 3, 2013. The fourteen calendar day
appeal period will expire on July 17, 2013.
