SUBjECT: TREE REMOVAL PERMIT ACTION LETTER—TR-2013-25:
This letter confirms the decision of the Director of Community Development, given on June 27, 2013,
approving a tree removal permit to allow the removal and replacement of one 20 inch Oak Tree, due to
its location in the middle of a proposed access driveway to a residential property located at 10231
Hillcrest Road.
1. APPROVED PROJECT
This approval is based on the Tree Removal and Replanting Plan prepared by Mike Chen (Architect),
dated June 29, 2013, consisting of one page and an arborist report prepared by Michael Bench
(Certified Arborist #WE-1897A), received May 7, 2013, consisting of four pages, except as may be
amended by conditions in this resolution.
2. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but not
limited to property boundary locations, buildulg setbacks, property size, building square footage,
any relevant easements and/or construction records. Any misrepresentation of any property data
may invalidate this approval and may require additional review.
3. TREE REPLACEMENTS
The applicant is required to plant one 36-inch box replacement oak trees in accordance with the
Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree species and
location may be made to the approved replace�nent plan pend'u1g staff approval. The replacement
trees shall be planted withu130 days of the effective approval date of this tree removal permit.
4. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may uulude certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and
a description of the dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.180 of the Protected Trees Ordinance.
Please note, however, that an appeal of this decision can be made within 14 calendar days from
the date of this decision. If this happens, you will be notified of a public hearing, which will be
scheduled before the Planning Commission and the tree cannot be removed until a final decision
on the appeal has been made. If no appeal is made within the appeal period, the tree(s) may be
removed after Monday,July 23,2013.

A Review of an Oak Tree At
10231 Hillcrest Road
Cupertino,California �
Assignment
I was asked by Mr. George Schroeder,Assistant Planner,City of Cupertino,to review an
oak tree, located at the end of Hillcrest Road,Cupertino, California.
A Topographic Survey plan, prepared by WEC and Associates, Palo Alto,California,
E�chibit C.0 was provided for site reference.
Observations
I inspected the tree and the site conditions on May 7, 2013.
The subject tree is a coast live oak(Quercus agrifolia). In is located at the end of
Hillcrest Road at the entrance to a vacant lot,which will apparently have the address
10231 Hillcrest Road.
This coast live oak has a trunk diameter of 203 inches DBH(Diameter at Breast Height).
The canopy height is approximately 45 feet and the approximately canopy spread is
approximately 35 feet.The canopy is dense.T'here are no obvious disease or insect
infestation. Overall this tree is in very good condition.
The tree has a structural branching weakness called co-dominant leaders with imbedded �'�
bark.This weakness can usually be successfully managed by pruning,cabling or both.
This tree is cunently no threat to adjacent structures.
There are several other trees on or adjacent to the property boundaries of this vacant lot,
which may be at risk of damage by a proposed new residence. I have listed these trees on
the attached Field Data Sheet.Tree# 8, a large Italian stone pine, was included because it
is influencing the growth of Trees#4 and 5, not because Tree# 8 would be exposed to
risk by construction. I added Tree#6 to the Topographic Survey provided. Trees# 1, 2,
3, 6, 7, 9, 10 are protected trees. . r - �'�"r 1

Conclusions
Currently there is no compelling reason to remove the coast live oak Tree# 1.
As proposed construction plans for this site become available,Tree# 1 may be in conflict
with the new driveway, but there is no current risk or hazard.
