CC Resolution No. 13-056 Authorize City Attorney to Settle Claims up to $15,000 RESOLUTION 1V0. 13-056 A RESOLUTION OF THE CITY COUN�CIL OF THE CITY OF CUPERTINO AUTHORIZING THE CITY ATTORNEY TO SETTLE CLAIMS,LITIGATION, AND OTHER MATTERS IN AN AMOUNT UP TO $15,000 WHEREAS, Cupertino Municipal Code section 2.18.020(E) requires the City Attorney to obtain the City Council's permissi��n to compromise, settle, or dismiss any action for or against the City; and WHEREAS, Government Code section�a34.5 provides that a local public entity by ordinance or resolution, may authorize an em��loyee of the entity to perform certain functions of the governing body; and WHEREAS, in 1979, pursuant to Resolu.tion No. 5120, the City Council delegated to the City Attorney settlement authority up to one thousand five hundred dollars ($1,500.00), and staff has been unable to locate any documentation evidencing that the amount of authority delegated to the City Attor.ney has been updated since 1979. NOW, THEREFORE, BE IT RESOLVE�� that the City Council does hereby approve the following: Section 1: The provision of Resoluti��n No. 5120 delegating to the City Attorney settlement authority up to one thousand five hundred dollars ($1,500.00) is hereby rescinded and updated as set forth in �,ection 2 below. Section 2: The City Attorney has thE� authority, with the concurrence of the City Manager, to compromise, settle, or dismiss any claim or action for or against the City for a sum not exceeding fifteen thousand dollars ($15,000), when in the opinion of the City Attorney, such a settlement would be� in the best interests of the City.
