Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION Proposed Modifications The applicant, Robert Colledge, representing Apple, Inc. Real Estate Department, proposes to modify an existing wireless communication facility on the roof of 1 Infinite Loop, by replacing one existing antenna for an LTE (Long Term Evolution) panel, relocating three antennas from the rooftop of 1 Infinite Loop to the roof of 2 Infinite Loop, and installing one new LTE antenna and associated base equipment to the roof of 2 Infinite Loop. Location The subject project site is the roof of the existing Apple Campus buildings located at 1 and 2 Infinite Lop, bounded by Interstate 280 to the north, Larry Way to the east, Mariani Avenue to the south and North De Anza Boulevard to the west. Visibility Setback 20'± from the parapet wall, the rooftop equipment is anticipated to be minimally visible between brief gaps in tree foliage when traveling south on the N. De Anza overpass, and when traveling northbound on Highway 280. Views from the south and east are fully obscured by Apple Campus buildings, and views from N. De Anza to the west are obscured by mature tree canopies. ACTION In accordance with Cupertino Municipal Code Section 19.164, the Director of Community Development deems the modification minor and approves the modification described in the plan set titled: "APPLE CNU1039 1 Infinite Loop, Cupertino, CA 95014" prepared by Pacific Telecom Services LLC, and consisting of eight (8) sheets labeled T-1, A-1 to A-71ast revised 04/22/13 and stamped as received 5/01/2013, except as may be modified by the conditions enumerated below. 1) BUILDING PERMIT CORRECTIONS Prior to building permit submittal, the following plan set corrections shall be required. 2) BUILDING PERMIT REQUIRED This approval does not constitute building permit approval; a separate building permit is required. 3 DIR-2013-11 1 &2 Infinite Loop 2 3) ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and require additional review. 4) CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 5) NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. 6) RADIO FREQUENCY ENERGY EXPOSURE CAUTIONARY SIGNAGE At the building permit stage, the plans shall reflect signage details and locations and other measures consistent with Federal Communications Commission regulations and guidelines to prevent public exposures to radio frequency energy emissions that are in excess of federal safety standards. Signage should be in multiple languages, including English and Spanish. 7) RADIO FREQUENCY ENERGY EXPOSURE The independent, and cumulative emissions for the proposed facilities shall meet Federal Communications Commission regulations and guidelines to prevent public exposures to radio frequency energy emissions that are in excess of federal safety standards. Signage should be in multiple languages, including English and Spanish. 4 DIR-2013-11 1 &2 Infinite Loop 2 8) RADIO FREQUENCY ENERGY REPORT An RF study demonstrating compliance with the Federal Communications Commission ("FCC") standards and exposure limits shall be required prior to building permit final. 9) DEMOLITION PERMIT Prior to the issuance of any building permits, building plans shall reflect the � demolition/removal of existing AT&T equipment not required for the operation of the modified wireless communication facility. 10)ABANDONMENT In the event the antennas, associated equipment, or any portion of the facility thereof, are left unused for a period of 18 months the property owner or applicant shall bear the entire cost to remove the subject equipment arid to restore the site to its previous condition. 11)PERMIT EXPIRATION In accordance with state law, this permit is granted for a period of ten (10) years, expiring on May 29, 2023. Prior to the permit expiration, the applicant may apply for a renewal of the permit, at which time the Community Development Director may review the state of wireless communication technologies to determine if the aerial facility can be reduced in height, size, or utilize better camouflage techniques. This approval is effective May 29, 2013. The fourteen calendar day appeal period will expire on June 12, 2013. Project Description: AT8�T proposes to modify an existing unmanned telecommunications facility by relocating (3) 4'-3" antennas from 1 Infinite Loop to 2 Infinite Loop, and installing (1) new 4'-3" antenna at the 1 Infinite Loop location. The Project also entails installing ancillary equipment near the antennas. Justification: The purpose of the facility modification is to enhance Apple's, and other nearby offices, in-building coverage, extend and enhance coverage to the 280 corridor, and increase network the much-needed capacity to the area to better serve AT8�T customers, visitors to the area, and the emergency service providers who rely on their service. There is an intense demand on AT8�T's network in this area of Cupertino and this improvement upgrade and antenna relocation is an essential for AT8�T's networks. The project design as presented will utilize the minimum amount equipment while providing the optimal coverage and capacity to this area of Cupertino. SubmitFal Items: 1.
