SUBJECT: TREE REMOVAL PERMIT ACTION LETTER -TR-2013-13
This letter confirms the decision of the Director of Community Development, given on May 22, 2013,
approving a Tree Removal Permit (TR-2013-13) to allow the removal and replacement of 1 White Birch
tree, 1 Raywood Ash tree and 4 Iron Bark Eucalyptus trees at an apartment complex (The Markham
Apartments), located at 20800 Homestead Road, with the following conditions:
1. APPROVED PROTECT
This approval is based on an arborist report prepared by a Certified Arborist (Sarah Hon WE-
9519A) consisting of 5 pages and a peer review letter prepared by Consulting Arborist, Michael
Bench (WE-1897A) consisting of 2 pages and the Tree Replacement Planting Plan.
2. TREE REPLACEMENTS
The applicant shall plant seven (7) 24-inch box replacement trees and two (2) 36-inch box
replacement trees in accordance with the Protected Trees Ordinance and approved tree
replacement plan. Modifications to tree species and location may be made to the approved
replacement plan pending staff approval. The replacement trees shall be planted within 30 days of
the effective approval date of this tree removal permit.
3. NOTICE OF FEES DEDICATIONS. RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can
be made within 14 calendar days from the date of the mailing of this decision. If this happens,you
will be notified of a public hearing, which will be scheduled before the Planning Commission and
the trees cannot be removed until a final decision on the appeal has been made. If no appeal is
made within the appeal period,the tree(s) may be removed on or after Thursday June 6, 2013.

Background I was contaded by Prometheus Real Estate Group concerning their property at 20800 Homestead Road,
information Cupertino,CA 95014.The property complex is known as The Markham,formerly Villa Serra Apartments.
Prometheus is seeking to obtain tree removal permits for seven(7)trees located on the property at
various locations.

Analysis
�ISCUSSIOtI The trees are causing issues that will eventually cause bui�ding damage and safety toncerns for residents.
What options a�e available to the properry owner to mitigate these issues?For the White Birch removal is
the aniy aption_For the Mexican Fan Palm transplanting is an option but not as good as planting a new
one.A new plantinQ would or tould be of same size and would be less expensive to transplanting the
curre�t palm.For the Raywood Ash removal is the only option due co its current size and the previous
root cutting.The Ironbarks are too large to transptant and struduraliy unsound.

A Review of Seven Trees

Assignment
I was asked by Mr. Simon Vuong to review the seven trees requested for removal and
replacement at the Markham Apartment Complex, 20800 Homestead Road, Cupertino,
California.
Observations
The trees are described in an Arborist's Report by Sarah Hon, Certified Arborist,
representing A Plus Tree Service, Vallejo, California.
Tree A–European white birch (Betula pendula)
In addition to the description by Ms. Hon, the roots of this tree have been colonized by
Oak root fungus (Armellaria mellea), which I observed in clusters around the trunk. The
trunk itself is also under attack by the Turkey tails fungi (Trametes versicolor). These
disease pathogens are very serious. There is no question that this tree inust be removed.
The suggested replacement for this tree is coast live oak (Quercus agrifolia), but Quercus
agrifolia would not survive long term in the lawn. The frequent irrigation would make it
extremely susceptible to Oak root fungus (Armellaria mellea). If Quer-cus agrifolia would
be used, a section of turf would require removal, a minimum diameter of 30 feet and the
replacement Quercus agrifolia would have to be planted at the highest elevation of the
landscape and planted on a mound (approximately 12-15 inches above grade) as well.
Otherwise, Southern live oak (Quercus virginiana) would be an acceptable replacement in
the turf, except for a 4 foot radius around the trunk, which should not have turf.
Tree B –Mexican fan palm (Washingtonia robusta)
Indeed this palm has been planted adjacent to the building. However, this species is a
monocot, and as such, its trunk does not grow growth rings and will not become wider in
diameter. The roots are fiberous and somewhat fleshy, which do not damage
infrastructure and are not deemed a risk to the adjacent patio.
The overall height of this tree has surpassed the existing roof gutter by a few feet.
Although some fronds extend into the adjacent balcony, these fronds can be removed. In
fact all of the fronds up to the bottom of the gutter may be removed, which would clear

The trunk of this tree pu�es a small visual obstruction to the view of the resident(s) in the
apartment. However, there are several other apartments, which have a similar visual
obstruction posed by another species.
In my opinion, there is not adequate justification to remove this palm tree.
Tree C—Raywood ash(Fraxinus oaycarpa `Raywood')
Ms. Hon's description of this tree is accurate. I also recommend removal and
replacement.
Trees D, E, F, G—Red ironbark(Eucalyptus sideroxylon)
Ms. Hon's description of these trees is accurate. However, Tree G is among a group of 5
Red ironbark (Eucalyptus sideroxylon), all with similar structural integrity, all poor. I am
surprised that the management only wants to replace Tree G in the cluster. All of the 5
red ironbark trees in this immediate area pose approximately the same level of risk and
should all be replaced relatively soon(2-3 years).
I recommend that coast redwood (Sequoia sempervirens) not be used as a replacement
species,because of its need forincreasing large quantities of water as it matures,
compared to other species.
The previous commentary about Quercus agrifolia (replacement for Tree A) also applies
concerning the replacement for Tree G.
All of the replacement trees will require deep irrigation(minimum depth of 18-24 inches)
on a weekly basis for the first year, every 2 weeks the second year, and every 3 weeks the
3 third year. Sprinkler irrigation in turf does not achieve this objective. Thus, the
replacement trees will require special hand watering, which must be inspected every
month using a soil probe. An even better alternative, would be to put all new trees on
separate imgation valves, apart from shrubs and turf.
