Subject: Director's Temporary Use Permit, TUP-2013-02, to allow Sprint a temporary
COW (unmanned wireless cell on wheels facility) for a period of one year at
10435 N. Tantau (Apple); APN: 316-06-039, to allow time to identify and
permit another permanent cell site.
Chapter 19.12.030 of the Cupertino Municipal Code allows for
administrative approval of a temporary use permit, authorizing the use of
a site in any zoning district for a temporary use. The Director reports
his/her decision to the City Council & Planning Commission in time to
allow an appeal of the decision within fourteen calendar days.
DISCUSSION
The applicant, Michelle Thompson (FMHC Corp.), on behalf of Sprint, is requesting
approval to allow the installation of a temporary COW (unmanned wireless cell on
wheels facility) for a period of one year in the parking lot of the subject Apple owned
property. The temporary facility is needed as Apple will be demolishing the building
upon which the existing cell tower in located. The proposed facility seeks to prevent
any interruption in service while Sprint works on identifying and permitting a new
permanent cell site.
Location
The subject property is an existing office complex occupied by Apple, bounded by the
Interstate 280 to the south, N. Tantau to the east, and Calabazas Creek to the east and
north.

The temporary COW is proposed towards the rear of the existing building in a
landscape area.
Equipment
The proposed equipment includes a new temporary unmanned mobile
telecommunication facility consisting of a new Sprint MMBS Cabinet, a new sprint

battery cabinet, a new GPS antenna, 3 new sprint antennas, and 6 new RRU's. Overall
the facility will be 60' tall, 12.5' wide, and 28.75' long once setup.

Visibility
The COW is proposed to be located towards the rear of the existing Apple office
building. While proposed at 60' tall, it will be obstructed from views from the north,
west, and south from trees. The facility is anticipated to have the greatest visibility
when viewed from Highway 280 when passing over the Calabazas Creek where no
trees will serve to obstruct the view.
Noise
No significant noise impacts are anticipated, provided that the equipment does not
generate noticeable noise or vibration and the closest residential use is located
approximately 640 feet away from the proposed equipment.
Duration
The facility is proposed for a period of one year while Sprint works on identifying and
permitting a new permanent cell site.

FINDINGS
Prior to approval, the Community Development Director must make the following
findings as outlined in Section 19.160.030 of the City of Cupertino Municipal Code. Staff
analysis is shown below the required findings in italics.
A. The granting of the application will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public, healtlz, safety,
general welfare, or convenience; and
As proposed, the temporary COW shall provide adequate protective barriers.
The plans will be required to be submitted as part of a building permit for review
for consistency with applicable code and safety requirements.
The temporary COW is proposed to mitigate any loss of cellular service in the
area while Sprint attempts to find a new permanent facility. Due to the
temporary nature of the use, no significant impact to public convenience is
anticipated.
B. The proposed use will be located and conducted in a manner in accord with the Cupertino
General Plan and the purposes of tl�is title.
As conditioned, the project shall be conducted in a manner that serves the
General Plan Guiding Principals in that adequate safety measures have been
taken to mitigate potential impacts to people, property, and the environment.
The proposed location promotes attractive community design in that the facility
is temporary and not highly visible.
The facility has also been reviewed for consistently with the setback requirements
stipulated in the City of Cupertino Wireless Facilities Master Plan. The facility meets the
required setbacks being greater than 75 feet to any residential property (closest is
approximately 640 feet to the east on Howard).
ACTION
The Director of Community Development deems this application as minor, and
approves the temporary COW subject to the following conditions of approval.
1. APPROVED PROTECT
This approval is based on the plan set entitled "SF99XT511 — RC 1 TEMP COW"
consisting of eight (8) sheets (T-1 and A-1 through A-7), stamped as received

May 16, 2013, except as may be amended by the following conditions.
2. ACCURACY OF PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data
including, but not limited to, property boundary locations, building setbacks,
property size, building square footage, any relevant easements and/or
construction records. Any misrepresentation of any project data may invalidate
this approval and require additional review.
3. DURATION
The temporary COW and all associated equipment shall be removed from the
site no later than June 3, 2014. A new Temporary Use Permit shall be submitted
to the City for review and approval prior to the Temporary Use Permit
expiration.
4. BUILDING PERMIT REQUIRED
Issuance of a building permit shall be required prior to installation of proposed
equipment and facilities.
5. GRADING AND CONSTRUCTION HOURS
All grading activities shall be limited to the dry season (April 15 to October 15).
Grading hours shall be limited to Monday through Friday, 7 a.m. to 8 p.m.
Grading, street construction, demolition or underground utility work shall not
occur on Saturdays, Sundays and holidays, and during the nighttime period as
defined in Section 10.48.053(b) of the Municipal Code. Construction activities
shall be limited to Monday through Friday, 7 a.m. to 8 p.m. and Saturday and
Sunday, 9 a.m. to 6 p.m. Construction activities are not allowed on holidays.
The developer shall be responsible for educating all contractors and
subcontractors of said construction restrictions. Rules and regulation pertaining
to all construction activities and limitations identified in this permit, along with
the name and telephone number of a developer appointed disturbance
coordinator, shall be posted in a prominent location at the entrance to the job site.
6. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions set forth shall be attached to, incorporated into, or annotated on
the first page of the building plans.
7. NOISE
Noise shall not exceed the maximum Daytime and Nighttime exposure limits
prescribed in Chapter 10.48 of the City of Cupertino Municipal Code.

8. CONSULATION WITH OTHER DEPARMENTS
The applicant is responsible to consult with other departments and/or agencies
with regard to the proposed project for additional conditions and requirements.
. Any misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
9. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (1), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
10. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless
the City, its City Council, its officers, employees and agents (the "indemnified
parties") from and against any claim, action, or proceeding brought by a third
party against the indemnified parties and the applicant to attack, set aside, or
void this ordinance or any permit or approval authorized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and
costs incurred in defense of the litigation. The City may, in its sole discretion,
elect to defend any such action with attorneys of its choice.
This approval is granted on May 17, 2013. Please note that an appeal of this decision can
be made within 14 calendar days from the approval date. The fourteen calendar day
appeal period expires on May 31, 2013. If an appeal is filed, a public hearing will be
scheduled before the Planning Commission. If no appeal is filed, the Director's
Temporary Use Permit becomes effective on June 3, 2013.
