A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AUTHORIZING EXECUTION OF "AGREEMENT FOR THE POSITIVE LOCATION
OF UNDERGROUND UTILITIES" BETWEEN THE CALIFORNIA DEPARTMENT
OF TRANSPORTATION AND THE CITY OF CUPERTINO
WHEREAS, positive location services (potholing) are required on all California
Department of Transportation (Caltrans) projects; and
WHEREAS, the current process for utility owners to perform positive location
services when Caltrans requests potholing requires intensive scheduling and performance
in order to complete the task; and
WHEREAS, the Department of Transportation has agreed to assume
responsibility for the performance and payment for positive location services required on
all Caltrans' projects; and
WHEREAS, the provisions, terms, and conditions of the aforementioned
agreement have been reviewed and approved by the City Attorney and the Director of
Public Works.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Cupertino hereby approves the aforementioned agreement and authorizes the Director of
Public Works to execute said agreement on behalf of the City of Cupertino.

Cupertino this 4th day of March, 2002, by the following vote:
