RECOMMENDATION:
Determine if the Council wishes to subsidize the cost to process building permit
applications for installation of photo-voltaic systems for quasi--public uses such as
churches. The Council should identify the exact amount of the reduced fee to be
inserted into the attached resolution. Staff suggests a fee of $1,123 representing an 80%
reduction or $2,500 representing a 55% reduction to reflect the relative size of
residential and quasi-public photo--voltaic systems.
BACKGROUND:
At the September 2, 2008 City Council meeting, a representative from Bethel Lutheran
Church raised a concern regarding the photovoltaic installation permit fees charged to
quasi-public buildings. On April 1, 2008, the Council adopted Resolution No: 08-044,
which, in part, lowered residential photo-voltaic permit fees to $240. The representative
from Bethel Lutheran Church asked the Council to consider lowering the photovoltaic
fee for quasi-public buildings by 84% to be proportional to the fee reduction approved
for residential installations.
All user fees are reviewed each year in conjunction with the preparation of the budget
and the city's policy of providing cost recovery. Presently the fee schedule categorizes
all building permits as being either residential or commercial in keeping with current
California building codes. A consultant study assessing the costs of the building
functions yielded a new building fee schedule in 2006. The fee study goals included:
updating the fee schedule, establishing the full cost of operation and allocating the full
cost of fees. All fees are set at full cost recovery, except for residential photovoltaic
systems, which are charged aCity-subsidized $204 rate approved by Council on April 1,
2008. The residential fee reduction to $200 reduced the previously charged fee by 80%
for a typical 12 panel residential installation.

DISCUSSION:
The average project size for Cupertino's quasi-public building permit is 12.5 times the
size of a residential installation at 150 panels drawing 24 kilowatts. Presently, the
permit fee for such a project is $5,617. This fee includes initial and corrected outside
plan checking including the structural evaluation to ensure the panels can be safely
installed on the existing roof or structural support elements. Additionally, the building
inspectors conduct inspections for rough and final electrical, structural support
elements, panel installation and loading and a final installation inspection. The fee
encompasses all of the administrative support and staffing to answer initial questions
. and process the building permit application including logging the application into the
computer system, shipping the plans out for plan check and scheduling the inspections
plus the building capital, equipment, operating and general overhead costs that support
the building function.
Staff surveyed the cities of Menlo Park, Mountain View, and Sunnyvale which showed
that residential solar/photovoltaic fees were reduced below the $300 as recommended
by the Sierra Club but there was no evidence that commercial including quasi-public
buildings fees were subsidized. The City of Milpitas charges $1,767 for commercial
installations between 8 to 4$ kilowatts but we could not determine if this fee is
subsidized or if it is based on a full cost.recovery formula {see attached Milpitas fee
schedule).
FISCAL IMPACT:
An 80%. reduction would yield a permit fee of $1,123. This, in turn, would mean that
the General Fund would backfill the Building Department approximately $4,500 per
photovoltaic permit issued. Historically, the building department has issued an
average of two such permits per year. Should Council choose to approve an 80%
reduction in photovoltaic permit fees for quasi-public buildings, as it has far residential
photovoltaic permit fees, the General Fund subsidy would total approximately $4,500
per quasi-public installation or an annual subsidy of $9,000 based an the historical
average of two such permits per year. We may see an increase in applications given
the increasing attention on green measures combined with an 80% reduction in the
associated building permit fees and an increase in the cost to the General Fund.
Alternatively, the Council may consider a proportional fee based on the average size of
the system (12 panels versus 150 panels}, which would reduce the quasi-public fees to
$2,500 (12.5 X 200). This would cost the General`Fund $5,000 per year for two
installations. If the number of photovoltaic installations increases the amount of the
subsidy would increase proportionally.

of permits for residential photovoltaic. Our fee of $155.80 for a typical single family residential system is well
under the $300 recommended by the Sierra Club in its report a few years ago.

Master Fee Schedule to Eliminate All Fees Associated
With Residential Solar Array Related Installations
Effective Immediately.
RECOMMENDATION
Staff recommends that the City Council adopt a resolution to amend the City's Master
Fee Schedule to eliminate all fees associated with residential solar array related
installations effective immediately.
BACKGROUND
The Master Fee Schedule reflects fees charged by all City departments. It is amended
at least- annually so that fees reflect current costs to provide services or, in some cases,
to add new fees. for new City services and/or to eliminate fees for services that are no
longer offered. The Master Fee Schedule was last amended March 20, 2007. -
One category of fees is property development processing fees. These include fees for
use permits, variances, building permits, building inspections, map applications, and
planning services. These fees cannot exceed the reasonable cost of providing the
service. Any new fee or increase to existing fees in this category can be effective no
sooner than sixty days after approval by City Council. A decrease or elimination of a fee
• can go into effect immediately.
On June 19, 2007, the City Council adopted the fiscal year 2007-08 budget. As part the
Council's deliberations, it considered recommendations provided by the Green Ribbon
Citizens Committee (GRCC). .One of the recommendations of the GRCC was to
eliminate residential solar permit fees as an incentive toward adoption of residential
solar power generation. Staff indicated that this modification of the Master Fee
' Schedule could be accomplished with current City staff resources and funding levels
during the current fiscal year, and Council directed staff to follow through on the
recommendation. At this time staff is returning to the City Council for clear authoriza#ian
to eliminate resides#ial solar permit fees in a two step process. The first step would
amend the Master Fee Schedule to eliminate the relevant fees, and the second step
would be to reduce the associated budgeted revenues as part of the mid-year budget
report.
The elimination of fees associated with solar array installation is ~ consistent with
California Government Cade Section 65850.5, which calls on local agencies to

encourage the installation of solar energy systems by removing obstacles to, and
minimizing costs of, permi#ting for such systems.
APIALYSIS
A solar array is a group of solar panels that capture sunlight and convert it into direct
current power. Through the use of an inverter, the direct current power is converted to
an alternating current and a voltage that is consistent with that of electricity being
supplied by Pacific Gas and Electric. The converter is connected to a main electrical
panel. Most solar arrays are roof mounted and oriented to capture the maximum
amount of sunlight for the greatest length of time.
The City of Menlo Park requires a permit for the installation of solar arrays. This permit
may be issued for solar array.instaNation as a stand-alone project when the work is
being done on an existin structure, or may be issued as part of the construction permit
for a new structure. There is no fee in the Master Fee Schedule specifically identified
as a Solar Array Installation Fee. Rather, the following three general building-related
fees in the Schedule apply to the installa#ion of solar arrays: plan review fee, electrical
fee and documentation preparation fee. All three of these fees typically apply to solar
array installations done as a stand-alone praject. For solar array installation on a new
strut#ure, typically only the electrical fee is charged, since the plan review fee and
document preparation fee are already included in the cast of the permit for the new
structure.
The total cast for a permi# is not fixed but is dependent on the size of the installation.
The plan review fee is based on the cost of the installation. The Building Division
requires plans showing the location of the photovoltaic modules on the roof, the existing
roof structure design, and manufacture's specification for the weight of each module
which s#aff reviews to insure that the additional weight added to the existing roof
structure does not exceed that allowed by the Building code. The plan review. fee
recovers the City's cost for staffs time to review the plans and process the permit
application.
The elec#rical fee is made up of a base fee of $50 and additional fees based on the
quantity of photovoltaic modules, electrical equipmen#, and electrical conduit being
installed. This fee recovers the City's. cost for staff time to inspect the installa#ion.
The document preparation and storage fee is based on the number of plan sheets, plan
sheet size, and the number of pages of supporting documentation such as product
specifications. This fee recovers the City's cost to scan and store digital images.
With Council's direction to eliminate solar array installation fees, the plan review,
electrical, document preparation and storage fees associated with such installations will
no longer be charged. Anew category will be added to the Master Fee Schedule
indicating that there is no fee for any of the services associated with plan review; permit
issuance, inspection or administration of permits for solar array installations.

User fees provide an important source of cost recovery for the City. The elimination of
the fees associated with an installation of a solar array would reduce revenue by an
estimated $8,000 for the remainder of fiscal year 2007-08. This estimate is based on the
year-to-date revenue ($8,000 for four months adjusted downward to account for a
typical slowdown of construction activity during the winter months. The revenue
reductions associated with the recommended revisions to the Master Fee Schedule will
be built into the fiscal year 2007-08 mid-year budget revisions to the General Fund. The
actual cost of this revision will be reviewed as part of 2008-09 budget process.
POLICY ISSUES
Although the associated fees would be eliminated, the review of plans, issuance of
. building permits, and inspection of solar array installations would still be required,
resulting in a limited set of subsidized services in this area. It is a policy choice for
Council to direct that the City provide these services without a fee, with the intent of
encouraging increased use of electricity generating solar arrays.
ENVIRONMENTAL REVIEW
Revisions to the Master Fee Schedule are statutorily exempt under current California
Environmental Quality Act guidelines.

WHEREAS, under the provisions of the City of Menlo Park Municipal Code
.Section 1.25.010, fees and charges assessed by the .City of Menlo Park may be
amended or modified upon the adoption of a Resolution by the City Council; and
WHEREAS, the City Council of the City of Menlo Park considers that said
amended fees, as per the attached staff report dated November 20, 2007 are
appropriate and should be adopted;
The City Council of the City of Menlo Park makes the following findings:
1. User fee services are those performed by the City on behalf of a private
citizen or group with the assumption that the costs of services benefiting
individuals, and not society as a whole, should be borne by the individual
receiving the benefit. However, in some circums#ances, it is reasonable to
set fees at a level that does not reflect the full cost of providing service but
to subsidize the service.
2. The City should make all reasonable efforts to comply with California
Government Code Section 65850.5. (a) which reads as follows: The
implementation of consistent statewide standards to achieve the timely
and cost-effective installation of solar energy systems is not a municipal
affair,. as that term is used in Section of Article XI of the California
Constitution, but is instead a matter of statewide concern. It is the intent of
the Legislature that local agencies not adopt ordinances that create
unreasonable barriers to the installation of solar energy systems,
including, but not limited to, design review for aesthetic purposes, and not
unreasonably restrict the ability of homeowners .and agricultural and
business concerns to ins#all solar energy systems. It is the policy of the
state to promote and encourage the .use of solar energy systems and to
limit obstacles to their use. It is the intent of the Legisla#ure that local
agencies comply not only with the language of this section, but also the
legislative intent to encourage the installation of solar energy sys#ems by
removing obstacles to, and minimizing costs of, permitting for such
systems..
NOW THEREFORE, BE IT AND IT IS HEREBY RESOLVED that the Master Fee
Schedule amended March 20, 2007, is hereby amended to eliminate residential solar

PHOTOVOLTAIC SYSTEMS (SOLAR) FOR QUASI PUBLIC BUILDINGS
WHEREAS, the State of California requires fees charged for service rendered not to exceed
the cost of delivering said services; and
WHEREAS, a public hearing has been held to review user fees; and
WHEREAS, the CiTy Council of the City of Cupertino has established guidelines for setting
user fees;
NOW, THEREFORE, BE IT RESOLVED that:
1. A user fee is added to Schedule D, Miscellaneous Items Photovoltaic Systems
{Solar) for Quasi Public Buildings as shown on Attachment A.
2. Photovoltaic Systems (Solar) for Quasi Public Buildings are effective December
8, 2008.
