The landxape and irrigation system have been installed as specified in the landscape and
ircigation design plan and complies with the crKeria of the ordinance and the permit.
Inspection Fi�dings:
i.The landscaping and irrigation system are installed as specified in the landscape and irrigation system plan,system tu�e-up,
system test with distribution uniformity,reporting overspray or run off that causes overland flow,and preparation of an irrigation schedule.
Hardscape:
t.Re-compact and stabilize DG at the come�of the from door.
Planting:
1.Relocate Echiveria 'Afte�glow'succulents from behind Berberis to within the Aeoniums to avoid them being ove�grown by
Berberis.
2.Keep Bamboo tied for a while until the root balls can become established since they are so tall and may pull over from the
wind.
3.Add(26)missing Heucherella in the front by the building under the maples.
4.Add Calamagrostis and Ceanothus along the street to infill dead or missing ones.
5.Note that a differe�root barrier was i�stalled in the back bamboo planter than specified.The barrier installed is a panel
system ihat clips together in shoh sections and has numerous connection points that create potential weakness for bamboo
rhizomes to escape through.The spec�ed barrier is a continuous roll that wraps the entire length and has only one
connection point.No direction was given to change this out as it is almost impossible at this point.However,it is not what
was submitted nor prefeRed by SSA,This change should be documented on the as-buiRs.
6.Prune trees:Maples ffi building need their canopy raised and branches thinned.Trident Maples need to be laced out about
20%to allow wind though them as they are very tall and top heavy right now and may snap in the wind.
7.Continue to montitor the Birch by the front door that was in stress during construction.The tree is showing new leaf growth
and seems to be making a recovery.
8.Monitor one Trident maple behind the Apple sign-showing signs of leaf scorch and stress.Tree root ball was wet during site
visit apparently from supplemental hand walering.
IrrigaGon:
• Change umbrella bubblers to flood bubblers at the back by ihe berberis to match the Chondropetalum.
• Cap the bubblers at the Echiveria that is being transplanted and change the noules out at the Aeonium to overspray onto the
relocated Echiverias.
- Change rotary nozzles at the planting area at the front door nea�the bike rack to spray nozzles per the plan.

Subject: Director's Minor Modification, DIR-2013-04, to allow parking lot restriping,
accessibility upgrades, fa�ade changes, landscape changes, and addition of 318
square feet of building area at an existing light industrial (ML-rc) office
building located at 10161 & 10181 Bubb Rd.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports their
decision to the City Council and Planning Commission in time to allow an
appeal of the decision within fourteen calendar days.
DISCUSSION
The applicant, John Noori, representing Apple Inc., is proposing interior and exterior
modifications to an existing light industrial building located at the above referenced
addresses. The project includes the following:
• An expansion of 318 square feet of office space;
• New exterior building colors, storefronts, and garage doors; and
• Installation of roof screens to mitigate the appearance of rooftop mechanical
equipment.
The City will transfer 318 square feet of office allocation from the Heart of the City Area
to the Bubb Road Area to accommodate the additional square feet.
Additional site work proposed includes landscape changes, with modifications
exceeding 2,500 square feet of landscaped area. Therefore, the project is required to
demonstrate compliance with the City's Landscape Efficiency Ordinance prior to final
occupancy. Other site modifications include accessibility upgrades, the installation of

electric vehicle charging stations, bike racks, parking lot restriping, and demolition of
an existing sound wall.
As part of the approval, the applicant is required to provide the required public
improvements (including a new detached sidewalk) along the project frontage (along
the west side of Bubb Road). As an alternative, in-lieu of required frontage
improvements along the project frontage, the applicant may opt to provide a new
sidewalk system along the east side of Bubb Road, from 10300 Bubb Road (Bubb 5) to
the intersection of McClellan Rd & Bubb Rd. These improvements may include but are
not limited to a new sidewalk, any related curb and gutter work, potential adjustments
to the street geometry, and the required signage, striping, crosswalk/signal
enhancements as deemed appropriate and necessary by the City Traffic Engineer. A
condition of approval has been added to reflect this requirement.
ACTION
The Director of Community Development deems the modification minor and approves
the project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Bubb 15 Apple, Director's Minor
Modification," prepared by Gensler Architects, Kier & Wright Civil Engineers, and
SSA Landscape Architects, Inc., dated January 28, 2013 and consisting of 13 sheets
labeled Title Sheet, 0.0, 1.0, 1.1, 2.0, 2.1, 2.2, 3.1, 3.2, 3.3, 3.4, 4.0, and 4.1; except as
may be amended by the conditions contained in this resolution.
2. BUILDING PERMIT
The applicant shall consult with the Building Division to obtain the necessary
permits required for the proposed work.
3. DEVELOPMENT ALLOCATION
The City shall deduct 318 square feet of office General Plan allocation from the Heart
of the City Area to the Bubb Road Area. Thereafter, the City shall deduct 318 square
feet of office General Plan allocation from the Bubb Road Area.
4. SIDEWALK IMPROVEMENTS & SIGNAL ENHANCEMENTS
The applicant shall work with the City to provide either a detached sidewalk
fronting the subject property, or the applicant may opt to construct a new sidewalk
system along the east side of Bubb Rd, from 10300 Bubb Road (Bubb 5) to the
intersection of McClellan Rd & Bubb Rd, including but not limited to the following:
a new sidewalk, street frontage improvements, new curb and gutter, signage,
striping, crosswalk enhancements, street narrowing, and other pertinent

improvements as prescribed to be necessary and appropriate by the Public Works
Department. The final improvement plan shall be reviewed and approved by the
City prior to building permit issuance.
5. TRASH FACILITIES
Appropriate centralized trash facilities shall be provided off-site at 10300 Bubb Rd
(Bubb 5) that will service all of Apple's facilities in the Bubb Road area. The final
design and location of this trash facility shall be reviewed and approved by the
pertinent trash agency and the City's Public Works Departxnent. If the centralized
off-site trash facilities will no longer be available for the subject property's use
and/or if Apple is longer a tenant of the project building, then a City approved trash
facility must be provided on-site. Any future changes to the proposed trash facilities
and its operations must be reviewed and approved by the City. A covenant shall be
recorded on the property memorializing this condition prior to the final occupancy
approval of the building.
6. LANDSCAPE PROTECT SUBMITTAL:
Prior to issuance of building permits, the applicant shall submit a full landscape
project submittal per sections 14.15.040 A, B, C, and D of the Landscaping
Ordinance. The Water-Efficient Design Checklist (Appendix A of Chapter 14.15),
Landscape and Irrigation Design Plans, and Water Budget Calculations shall be
reviewed and approved to the satisfaction of the Director of Community
Development prior to issuance of building permits.
7. LANDSCAPE INSTALLATION REPORT:
Prior to final inspection, a landscape installation audit shall be conducted by a
certified landscape professional after the landscaping and irrigation system has been
installed. The findings of the assessment shall be consolidated into a landscape
installation report. The landscape installation report shall include, but is not limited
to: inspection to confirm that the landscaping and irrigation system are installed as
specified in the landscape and irrigation design plan, system tune-up, system test
with distribution uniformity, reporting overspray or run-off that causes overland
flow, and preparation of an irrigation schedule. The landscape installation report
shall include the following statement: "The landscape and irrigation system have
been installed as specified in the landscape and irrigation design plan and complies
with the criteria of the ordinance and the permit."
8. LANDSCAPING MAINTENANCE SCHEDULE:
Per the Landscape Ordinance (CMC, Chapter 14.15), a maintenance schedule shall
be established and submitted to the Director of Community Development or his/her

designee, either with the landscape application package, with the landscape
installation report, or any time before the landscape installation report is submitted.
a) Schedules should take into account water requirements for the plant
establishment period and water requirements for established landscapes.
b) Maintenance shall include, but not be limited to the following: routine
inspection; pressure testing, adjustment and repair of the irrigation system; aerating
and de-thatching turf areas; replenishing mulch; fertilizing; pruning; replanting of
failed plants;weeding; pest control; and removing obstructions to emission devices.
c) Failed plants shall be replaced with the same or functionally equivalent plants
that may be size-adjusted as appropriate for the stage of growth of the overall
installation. Failing plants shall either be replaced or be revived through appropriate
adjustments in water, nutrients, pest control or other factors as recommended by a
landscaping professional.
9. LANDSCAPING MAINTENANCE AGREEMENT:
Prior to final inspections and final occupancy, the owner(s) of the property shall
enter into a formal written landscape maintenance agreement with the City. The
City shall record this agreement, against the property or properties involved, with
the County of Santa Clara Recorder's Office and it shall be binding on all subsequent
owners of land served by the proposed landscape. The landscape maintenance
agreement shall require that the installed landscape not be modified and that
maintenance activities not alter the level of water efficiency of the landscape from its
original design, unless approved by the City prior to the commencement of the
proposed modification or maintenance activity.
10. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with
regard to the proposed project for additional conditions and requirements. Any
misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
11. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the
City, its City Council, its officers, employees and agents (the "indemnified parties")
from and against any claim, action, or proceeding brought by a third party against
the indemnified parties and the applicant to attack, set aside, or void this ordinance
or any permit or approval authorized hereby for the project, including (without
limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any
such action with attorneys of its choice.

12. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66020(d) (1), these Conditions constitute written notice of
a statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you
fail to file a protest within this 90-day period complying with all of the requirements
of Section 66020, you will be legally barred from later challenging such exactions.
This approval of the modification is effective March 25, 2013. The fourteen calendar
day appeal period will expire on Apri18, 2013.

This applicatbn is for the planned tenant improvements which fndude demolition of interior features and exterior
openings,modifications to exterior door locations for accessibility and egress,new interior tenant improvements and new
paint applications to exterior facades.
The project also plans to capture existing exterior outdoor space beneath the roof overhang as new building square
footage,adding approximately 318 square feet to the building floor area. The project also requires modificaUons to
existing mechanical and elecUical systems,fire sprinklers and fire alarm systems to meet code requirements.
The projecYs site work includes only the minimum accessibility improvements required for repair and�nsUuction of
existing sidewalks,accessible stalls,driveways and other flaNvoric. These required improvements Vigger the removal of 5
trees and minor landscaping repairs. Additional site work includes demolition of an existing soundwall along the street
frontage and minor restriping of some pa�lcing areas.
