Subject: Director's Minor Modification, DIR-2013-02 to allow the conversion of an
existing attic space to a storage space and a second story balcony to a two-
story single family home located in the Oak Valley Planned Residential
District, 10878 Sycamore Court.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports their
decision to the City Council and Planning Commission in time to allow an
appeal of the decision within fourteen calendar days.
DISCUSSION
The applicant, Laura Whitney, representing the Mehuys residencne, is proposing to
convert an existing attic space to a storage space (accessible from the master bathroom)
and construct a second story balcony facing the rear yard. The total amount of square
footage will remain unchanged at 4,176 square feet.
Privacy planting is required to be installed to mitigate any privacy impacts to adjoining
neighbors associated with the proposed balcony. In consultation with the neighboring
property owners, the applicant has proposed to install privacy screening in accordance
with the approved plan set.
No other interior or exterior changes are proposed. The project is consistent with the
City's ordinance and the applicable development standards prescribed in the Oak
Valley Planned Residential District. See the attached plan set for more information.
ACTION
The Director of Community Development deems the modification minor and approves
the project with the following conditions of approval:

1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Marianne & Dave Mehuys Residence, 10878
Sycamore Ct, Cupertino, California," dated February 20, 2013 and consisting of 3
sheets labeled A-1.1, A-2.1, and A3.1; except as may be amended by the conditions
contained in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with
regard to the proposed project for additional conditions and requirements. Any
misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
3. BUILDING PERMIT
The applicant shall consult with the Building Division to obtain the necessary
permits required for the project.
4. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City,
its City Council, its officers, employees and agents (the "indemnified parties") from and
against any claim, action, or proceeding brought by a third party against the indemnified
parties and the applicant to attack, set aside, or void this ordinance or any permit or
approval authorized hereby for the project, including (without limitation) reimbursing the
City its actual attorneys' fees and costs incurred in defense of the litigation. The City may,
in its sole discretion, elect to defend any such action with attorneys of its choice.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66020(d) (1), these Conditions constitute written notice of
a statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you
fail to file a protest within this 90-day period complying with all of the requirements
of Section 66020, you will be legally barred from later challenging such exactions.
This approval of the modification is effective March 21, 2013. The fourteen calendar
day appeal period will expire on Apri14, 2013.
