SUBJECT: TREE REMOVAL PERMIT ACTION LETTER—Application TR-2012-51
This letter confirms the decision of the Director of Community Development, given on February 12, 2013,
approving a tree removal permit to allow the removal of three (3) Coast Redwood trees (27" trunk
diameter, 25" trunk diameter, and 19" trunk diameter) and replacement with one (1) 36"box plum tree, two
(2) 24" box crepe myrtle trees, and one (1) 24" box magnolia tree in accordance with the City's Protected
Tree Ordinance to be planted on common area of the Seven Springs Home Owners' Association (HOA).
The application is approved with the following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by David Babby, the City Arborist, consisting of
nine (9) pages, dated June 29, 2012,except as may be amended by conditions in this resolution.
2. TREE REPLACEMENT
The applicant will be required to plant four trees consisting of one (1) 36"box plum tree, two (2) 24" box
crepe myrtle trees, and one (1) 24" box magnolia tree in accordance with the City's Protected Tree
Ordinance to be planted on common area of the Seven Springs Home Owners' Association (HOA).
Modifications to tree species and location may be made to the approved replacement plan pending staff
approval. The required replacement trees shall be planted within 30 days of the effective approval date
of this tree removal permit
3. NOTICE OF FEES, DEDICATIONS. RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication requirements,
reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1),
these Conditions constitute written notice of a statement of the amount of such fees, and a description of
the dedications, reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and other exactions,
pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally barred from
later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can
be made within 14 calendar days from the date of the mailing of this decision. If this happens, you
will be notified of a public hearing, which will be scheduled before the Planning Commission and
the trees cannot be removed until a final decision on the appeal has been made. If no appeal is made
within the appeal period,the tree(s) may be removed after Thursday,February 26,2013.

Dear Ms. Honda:
You have asked me to review the proposed removal of three coast redwoods (Sequoia
sempervirens) from the two above-referenced locations; two of the redwoods are at 11608
Birch Spring Court (trees #3 and 17), and the other is at 11651 Timber Spring Court (tree
#5). I visited the site on 6/26/12, and was accompanied by both property owners, the
property manager, and president of the HOA.
I previously evaluated trees #3 and S last year for my report 6/6/11 report, one I concluded
that their removal does not meet findings presented in Section 14.18.180 of the City Code
(Review and Determination of Application). Tree #17 (referred to as "x" in the Arborist
Transmittal Form) is a redwood not previously evaluated, and is assigned#17 to following
the sequential numbering pattern established for my 6/6/11 report.
OBSERVATIONS
The trunks of trees #3 and 17 are located seven feet from the adjacent home's foundation
at 11608 Birch Spring Court. A new walkway and wood fence align the north side of the
home, and some lifting, although minor, was observed along the existing walk. I am
informed by the homeowner that the same conditions observed for tree #5 (see below)
applied to tree#3 before this new fence and walkway were installed.

Tree #5's trunk is situated an estimated six feet from the home's foundation at 11651
Timber Spring Court. The adjacent fence is damaged, and two sizeable roots (not shown
to me for my 2011 report) were found surfaced and directed towards the foundation, both
of which can be expected to be growing along the foundation.
Based on the trees' size, root pruning at the existing fence line would significantly impair
their structural integrity, and create a hazard to occupants and property below; as such, it is
not advised. Root pruning and installing barrier along the foundations is possible, however,
the benefit will only be temporary(such as two to three years) as roots can grow above and
below the barrier.

photographs, and a site map showing the trees' locations.
CONCLUSIONS
Based on my evaluation, I conclude the following:
■ Given tree #5's large trunk diameter, close proximity to the adjacent home's
foundation, and sizeable roots demonstrated to be growing towards and likely along
the foundation, this tree presents the potential to damage the foundation. I do not
anticipate damage to occur in the immediate time frame, but escalating root-related
issues will progressively increase overtime. Based on this, tree #5's removal
conforms to finding number one within Section 14.18.180 of the City Code.
■ The potential damage from tree #3's roots is likely the same as for tree #5,
particularly when considering the trees' similar trunk size, distances close to the
foundations, and damage reported to the fence and walk. As such, the removal of
tree#3 also conforms to City Code.

■ Based on the distance of tree#17's trunk to the adjacent foundation being the same
as for tree #3, there is the potential for tree #17's roots to eventually damage the
foundation. As such, tree#17's removal also conforms to City Code.
• The locations of where the three redwoods were installed are inappropriate for
allowing a redwood's mature growth, protecting the safety of persons and property,
and maintaining the serviceability and normal lifespan of a home's foundation.
■ Root pruning along the foundations and installing root barrier does not seem
practical or reasonable given the trees' sizes (particularly#3 and 5), close proximity
to the foundations, root regrowth, and for 11608 Birch Spring Court, digging
through the existing walkway. There is also concern of extensive root pruning
debilitating tree stability and presenting a hazardous situation.
• Based on the substantial amount of existing and established trees throughout the
HOA, the loss of these three would be insignificant, and the tree landscape at the
HOA could be improved by installing new redwoods at more appropriate locations.
■ The trees are too big for reasonably relocating, and as such, mitigation would
include installing new ones.
REPLACEMENTS
Applying Table A, Section 14.18.185 of the City Code, either three trees of 36-inch box
size or six trees of 24-inch box size (or two trees of 24-inch box for every 36-inch box)
would be installed to mitigate removal of the three redwoods. The new trees should
consist of coast redwood and installed in open space, at least 15 feet beyond canopies of
existing trees, and at least 20 feet from existing hardscape, foundations, the street,
underground utilities and storm drains. All additional replacement recommendations
presented in my June 2011 report shall also apply.
