Subject: Director's Temporary Use Permit, TUP-2012-03, to allow the time extension of
a permitted air quality monitoring station at Monta Vista Park.
Chapter 19.12.030 of the Cupertino Municipal Code allows for
administrative approval of a temporary use permit, authorizing the use of
a site in any zoning district for a temporary use. The Director reports his
decision to the City Council & Planning Commission in time to allow an
appeal of the decision within fourteen calendar days.
BACKGROUND
The Bay Area Air Quality Management District (BAAQMD) proposed to locate an air
quality monitoring station at Monta Vista Park in Cupertino.

The objective was to investigate air quality potentially impacted by industrial sources in
the Cupertino area. The monitoring station was originally approved by the Director of
Community Development on May 6, 2010 (Exhibit A) with a BAAQMD-suggested
effective date of July 31, 2010. BAAQMD expected to operate the station for a full year
from mid-summer 2010 to 2011. BAAQMD had internal permitting and construction
issues that delayed its construction until late September 2011. BAAQMD requested a
time extension for the air quality station to September 30, 2012 so it could conduct
another full year of air quality monitoring. That one-year extension was also granted by
the Director of Community Development on July 18, 2011. The extension expired in
2012. BAAQMD staff has requested another one-year extension for air quality
monitoring at the direction of its Board of Directors and the request of Cupertino
officials.
DISCUSSION
The air quality monitoring station consists of two components:
(1) A trailer with instrumentation that measures or samples the following air
pollutants: ozone, oxides of nitrogen, sulfur dioxide, carbon monoxide,
particulate matter (two size distributions), gaseous hydrocarbon compounds,
and various metals; and
(2) A 30-foot tall, meteorological tower mounted with instrumentation to measure
atmospheric conditions.
The existing station complies with its previously issued planning and building
approvals.
The Director of Community Development approves the temporary use permit expiring
September 30, 2013. The fourteen calendar day appeal period will expire on January 29,
2013.

The objective is to investigate air quality potentially impacted by industrial sources in
Cupertino. The station consists of two parts:
1) A trailer with air quality monitoring instrumentation to be sited in the park parking
lot; and
2) A 30-foot tall meterological tower to collect atmospheric data near the corner of
Foothill Boulevard and Voss Avenue on the grassy field (Attachment 1).
BAAQMD expects to have the monitoring station operational by mid-summer 2010 and
operate it for a full year.
DISCUSSION
The air quality monitoring trailer will have instrumentation to measure or sample the
following air pollutants: ozone, oxides of .nitrogen, sulfur dioxide, carbon monoxide,
particulate matter (two size distributions), gaseous hydrocarbon compounds, and
various metals. For security reasons, the trailer will be in a fenced enclosure with
dimensions of 15' x 25' x 8', occupying 3 parking stalls (Attachment 2). The trailer will
need power and telephone connections, available at the recreational building, and
brought to the trailer site on temporary overhead lines.
The meterological tower is a 30-foot tail lattice tower mounted with instrumentation to
measure atmospheric conditions (Attachment 3). The tower does not need power or
telephone connections but must also be fenced in a 5' x 5' enclosure for security reasons.
The tower is sited off of existing walkways in a remote portion of the grassy field away
from the baseball diamond.
Neighborhood Meeting
On April 29, 2010, BAAQMD and the City held a neighborhood meeting on the
proposed air quality monitoring station at the Monta Vista Recreation Center. Public
notices were sent to neighbors within a 1,000-foot mailing radius of the project site and
the project information was posted on the City website. The Air District, City staff and
19 members of the public were present. Resident questions focused on the types of
chemicals and metals being measured and the appropriate location of the monitoring
station in order to measure air pollutants from the Lehigh Quarry and Cement Plant.
The Air District staff confirmed that their monitoring equipment was very sensitive to
ever� minute concentrations of pollutants and the District wanted the station in an
urban area close to the general population, so it can assess the quality of the air that
directly affects Cupertino residents.
The Director of Community Development approves the temporary use permit for the
maximum period of one year, effective May 6, 2010 to coincide with future building
permit review and subject to the following conditions of approval:

1) The applicant shall provide two to three feet of interior clearance between the trailer
and fence enclosure on the fence sides that face a parking stall or a driveway aisle.
2) The applicant shall place appropriate signs on the monitoring trailer and
meterological tower (or on the enclosing fences) with the Air District's contact
information.
3) This permit is effective for one year from commencement of the operation, or July
31, 2011,whichever is soonest.
The fourteen calendar day appeal period will expire on May 20, 2010.
