SUBJECT: TREE REMOVAL PEIZMIT ACTION LETTER—Application TR-2012-50
This letter confirms the decision of the Director of Community Development, given on January 11, 2013,
approving a tree removal permit to allow the removal and replacement of 17 Purple leaf Plum trees at an
existing office complex (Apple, Inc.), located at 1 Infinite Loop. T'he application is approved with the
following conditions:
1. APPROVED PROJECT
This approval is based on the arborist report prepared by Paul Cebrowski (#WE-9608A) consisting of
nine (9) pages, dated November 16, 2012, and by the peer review report prepared by David Babby
(#WE-4001B) consisting of nine (9) pages, dated December 11, 2012, except as may be amended by
conditions in this resolution.
2. TREE REPLACEMENT
'The applicant will be required to plant six (6) 60-inch box Olive (Olea europaea, 'Swan Hill') replacement
trees in accordance with the Protected Tree Ordinance and approved replacement plan. Modifications
to tree species and location may be made to the approved replacement plan pending staff approval. The
required replacement trees shall be planted within 30 days of the effective approval date of this tree
removal permit
3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication requirements,
reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1),
these Conditions constitute written notice of a statement of the amount of such fees, and a description of
the dedications, reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and other exactions,
pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally barred from
later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can
be made within 14 calendar days from the date of the mailing of this decision. If this happens, you
will be notified of a public hearing, which will be scheduled before the Planning Commission and
the trees cannot be removed until a final decision on the appeal has been made. If no appeal is made
within the appeal period, the tree(s) may be removed after Friday,January 25, 2013.

INTRODUCTION
The following arborist report was produced in collaboration with Arborwell and is for the removal of
seventeen (17) Purple-Leaf Plum Trees, Prunus cerasifera, on the Apple Campus at 1 Infinite Loop, Cupertino,
California (see Figure 1) at the IL1 Lobby Entrance. These trees were surveyed on 11/12/2012.

Note that the recommendations in this report are based on visual inspection on the above ground parts of the
tree at the time of the site visit. No soil was removed for below-grade inspection. This report contains the
following: Introduction, Survey, Onsite Conditions, Problems, Past Trouble At Apple, Replacement Strategy,
Appendix 1 (Tree Disposition Table) and Appendix 2 (Removals Map &Architect's Rendering)
TREE SURVEY
Data collected per individual tree for the inventory are as follows: tree tag #, common name, scientific name,
diameter at breast height 4.5' above grade (inches) or just under multi branch crotch split, approximate height
(feet), approximate canopy spread (feet), health and structural condition rating, action recommended, and
comments. In addition to the collected observational data, the locations of the trees were plotted on a map
using high-precision GPS technology. The site was visited on November 12th, 2012. Of the data collected in
the field, health and structural condition (0 - 5; 0 = extremely poor, 5 = excellent) were observed. The health
and structural condition of a tree is determined by the extent and size of foliage, the appearance of any
abnormalities, and the overall health of the trunk and crown, in addition to the specific individual's general
appearance relative to the ideal specimen of the species. Health and structural condition are subjective and
species-dependent.
ONSITE CONDITIONS
Soil conditions on the property were observed. The soil moisture throughout the surveyed landscape was
noticeably moderate. Observations suggest that the landscape is well irrigated and soil moisture conditions
are good.
PROBLEMS
The 17 Plums at the 1 Infinite Loop entrance were planted over 20 years ago, are nearing their end of lifespan
now, are water-needy, and of greatest concern, many have upheaved/uprooted rootballs (visible at the soil
surface) in combination with leaning trunks (visible from a distance) evidence of compromised structural
integrity of the trees, some to a potentially dangerous degree (see Figure 2 & 3) Some of these hazardous
trees are also within target range of passing and sitting pedestrians below them which only increases the
liability to Apple. The Plum trees are quite inconsistent in their size, shape, and health condition, overall are
quite thin in terms of canopy density, have poor branching structure, are quite crowded in their planters, and
the majority of foliage is produced by suckering shoots as opposed to true branch laterals, which is less than
desirable (see Figure 4) Advanced decay and decline is also appearing, evidenced by tip dieback and cambium
loss (see Figure 5 & 6) The value of replacing these Plums at this time with a superior species appears to
exceedingly outweigh their preservation. The condition of each of the Plum trees can be reviewed in the tree
disposition table below (see Appendix 1)

PAST TROUBLE AT APPLE
Multiple Plum trees have apparently fallen over in these planters over the years, fortunately not landing on
anyone in the process. However, the potential threat for recurring failure continually looms, within dangerous
proximity to the ever-present target of high pedestrian traffic flow daily between these planters. These
fruiting Plums have also proven notorious for fruit drop and creating an enormous mess and maintenance
nightmare over the main entrance hardscape, even despite bi-annual attempts to inhibit fruit production.

REPLACEMENT STRATEGY
It is recommended that the Plums be removed and replaced with a superior tree species that possesses the
following desirable qualities; long-lived, hardy, structurally strong, drought-tolerant, evergreen, pest-resistant,
non-fruit bearing and Mediterranean climate adapted.
We are proposing to replace these seventeen (17) Purple-leaf plums, Prunus cerasifera, with six (6) 60-inch
boxfruitless Olives, O/ea europaea 'Swan Hill' (see Figure 8) which we feel successfully meet the
criteria/qualities listed above. Per City of Cupertino Protected Tree Ordinance, removal trees 12" DBH or less
require one (1) 24" box replacement tree. Our proposition is to replace the Plums with vastly superior trees
(Olives) that exceed the standard mitigation box size of 24" by 3 full box sizes (60") We feel that each of the
proposed 60" box Olives present a mitigation value that could reasonably be considered equivalent to every 3
inferior Plums we are proposing to remove and replace, when comparing the polarizing qualities of the Plums
to the Olives, and the much larger replacement tree box sizes proposed for the Olives. Planting 3—60" Olives
for each of the raised planter beds down the center will also provide more space and less competition for the

Olive trees to establish stronger and more consistently, while providing sufficient space to showcase their
spectacular structure. Please see Appendix 2 for aerial view of proposed re-planting locations along with an
architect's rendering of the proposed design and layout.
The Olives are not only immensely longer-living, hardier, structurally stronger, exceedingly more drought-
tolerant, and a vastly superior Mediterranean climate adapted species than the existing Plums, but the Olives
also possess the attractive qualities of being evergreen, and non-fruiting, also promoting pesticide reduction.

You have asked me to review the proposed removal of 17 purple-leaf plum trees (Prunus
cerasifera) from the above-referenced site. Specific tasks performed are as follows:
■ Review the applicant's report, dated 11/16/12.
■ Visit the site on 12/6/12, and identify the 17 trees proposed for removal.
■ Ascertain each tree's health and structural condition.
■ Confirm the trees' approximate locations and trunk diameters.
■ For location purposes, utilize the map showing tag numbers; it was emailed to me
on 12/3/12, and I have attached it to this report.
■ Utilize tree numbers provided in the applicant's report, as well as shown on the
racetrack-shaped tags affixed to the trees' trunks.

OBSERVATIONS
The 17 subject plum trees are assigned and tagged as #238 thru 254, and align both sides
of the walkway leading to the building's lobby entrance. They are of relatively equal size
with trunk diameters ranging between eight and ten inches, heights of 15 to over 20 feet,
and canopy spreads of around 10 to 20 feet across. Photographs of the trees, by assigned
number, are assembled on the attached sheets.
Based on the site, it is assumed that the trees were planted or retained as part of a
previously approved and planned development. As such, they can be considered regulated
and defined as"protected trees"pursuant to Section 14.18.035(C) of the City Code.
My assessment of their condition reveals that they are in overall poor to very poor
condition, and beyond recoverable status. Large deadwood, highly excessive pruning over
the years, weak structural integrity, and possibly fruit control applications all contribute to
their weakened condition.
Several of the trees' actual locations, as shown on the attached map, vary slightly from
what is shown on the supplied map attached to this report (and more so on the map
presented as Appendix 2 in the applicant's report). On the attached map, from their plotted
locations, #243 and 244 are roughly ten plus feet west, and#246 thru 250 are about ten feet
east.

CONCLUSIONS AND RECOMMENDATIONS
Upon consideration of my observations, it is my opinion that the plum trees' continued
decline and structural degradation will occur during their remaining lifespan, and their
useful and functional life have reduced significantly. As such, I find that the removal of
all 17 conforms to fmding one of Section 14.18.180 of the City Code. Their removal and
replacement with a more suitable species will greatly benefit and promote a more
prominent future tree landscape, while enhancing and complementing the architectural
building features.
Applying Table A, Section 14.18.185 of the City Code, mitigation for their removal would
involve the installation of 17 trees of 24-inch box size. The applicant is requesting to
alternatively install six olive trees of 60-inch box size (fruitless variety named Olea e.
'Swan Hill'), three along each side of the building. Their proposal does not identify
replacements within the individual planters nearest the drive aisle (the ones that contain
existing trees#238 thru 240 and 252 thru 254).
Based on my assessment of the proposed planting areas, I find that installation of six
multistem olives of 60-inch box size (three per side) are an excellent selection as they will
instantly provide recognizable stature and promote a superior future landscape; the 60-inch
boxes are approximately 12-14' tall and 10-11' wide, and the 24-inch boxes are only 5-6'
tall and 4-5' wide. I recommend they are evenly spaced within the planters. Additional
landscape (ground cover, shrubs, etc.) should also be identified as there will be a sizeable,
exposed ground area following installation.

For the stand alone planters nearest the drive aisle, I am unclear as to the future landscape.
I suggest that short, ornamental trees are considered there,perhaps one or more per planter,
and be low-growing to not impede the aesthetic value provided by the olives. Examples
include Acer palmatum 'Dissectum Ever Red' and Prunus serrulata 'Weeping Double
Pink'. The installed size should be 24-inch box.
