BACKGROUND Community Development Department Agenda Date: Tune 2, 2008 At the May 27, 2008, budget study session several Council members asked about the details of the economic development program. Recently Economic Development/Redevelopment Manager Kelly Kline prepared a list of "Economic Development Key Initiatives" and last year she provided a list of "06/07 Redevelopment Agency Accomplishments" (both documents are attached). The economic development program provides staffing for the Economic Development Committee. Attached is the latest Economic Development Committee packet. Also, the Economic Development program budget manages the housing programs and supports the economic development effort with Senior Planner Vera Gil reporting to Kelly and includes a portion of Senior Planner Gary Chao 's time. Cupertino Square -Leasing Strategy, and Strategic Direction far Mall Kline introduced this item by sharing copies of an article published in the San Jose Mercury News on 2/1/08 by retail writer Mike Antonucci. The article does a great job of highlighting some of the exciting new developments at the mall. Mike Rohde, General Manager of Cupertino Square elaborated on many of these items, including: s Ne~v leases with Steve & Barry's and R~unich's Hof~rau House ® More leases to come with major fitness club, bakery, and De Anza college. ® Ne«~ restrooms, HVAC, daycare facility, leasing office, flower pots, and renovated fountains. o Mac}r's is taking back 20,000 sf to house more boutique lines and an expanded shoe area. ® New ownership group plans to spend $8 million in 2.008. 17-7 2/6/08 Economic Der>elopment Committee Atinutes Page 2 Kline summarized by noting that the overall strategy is gearing toward recruiting " junior-anchors'' threaded together by the ty=pically smaller mall tenants. This ensures a quicker lease-up of the mall. Additionally "look and feel" items are taking top priority= -which provides an immediate new experience for the customer. B. Buxton Report -Trade Area and Culstomer Profile far Cupertino Kline shared with the committee the results of a trade area study conducted by the Buxton Company for the City of Cupertino ~=hich provides the psychographic profile and spending habits of the residents and employees contained «=ithin a 7- minute drip=e radius. This study is a powerful tool in recruiting specific tenants «=ho rely= on psychographic data to ensure that the trade area matches with their primary customer base. C. Economic De`teloprr~ent I1'Ianager Report ^ Development and Leasing Activity since October: o The HP site at Stevens Creek and Tantau has been sold to Sand Hill Properties. o Eight new businesses: Harvest, Beard Papa, Visique, Simply Thai, Great Buffet, Pizza My Heart, and Curry House o Five new leases: Ritz Camera, Max Muscle, LS. Ste«= House, Amici's, and Gumba's. o Five businesses under construction: KC Bistro, Marukai, Daiso, Yogurtland, and Regus. ^ Redevelopment Accomplishments for 06-07 were shared with the group. These accomplishments were sent to the State Controlle.r's office for official filing. ^ NOVA has produced a Cupertino specific report on services provided. Over 300 Cupertino residents are registered at their jab seeker center. There is an oppoz-tunity to hold a future committee meeting at NOVA which could include a tour of the facility. y ^ Staff is beginnng to strategize about the best «=ay to approach the development of a Crossroads streetscape plan. Any such effort would seek broad community input at the front e.nd of the process. The comnuttee indicated that the further discussions should take place on the approach and parameters, beginning no earlier than July 2008. ^ Other activities: o New E-letter distributed on 11/1/07. o Kline will be the co-chair of the ICSC retail conference, March 18- 20 in Monterey. Restaurant Outreach Effort invol~~ng Chamber and Flint Center The inaugural effort to promote Cupertino restaurant collaboration v,~as held on November 8~' with a reception at Flint Center prior to "Movie' Out". Sufficient interest was generated to kick off a Cupertino Restaurant Association meeting on January 15 at Rio Adobe. This will be an ongoing effort to encourage cross- marketing opportunities. 7. The rebirth of Vallco Fashion Park as Cupertino Square is stalled by a loan dispute that has landed in court The ov/ners of the 32-year-old mall allege in a recently filed la~a~suit that their lender has refused to pay out millions of dollars for construction ~~~ork. They complain that this has jeopardized pending leases v~~ith trendy retailers Steve & Barry's, the Hofbrau Beer Hall and 24 Hour Fitness. In a lawsuit filed April 2 in Santa Clara County Superior Court, Cupertino Square ov~~ners allege that Gramercy Warehouse Lending will not release funds from a $195 million construction loan agreed upon in August 2006 to pay for renovations to the aging mall. Orbit Resources, which bought the mall in September when it was still called Vallco, alleges that Gramercy's actions are "hamstringing" their ability to retain tenants and attract retailers to the 1.3-million-square-foot center on Wolfe Road in Cupertino. "There's enough money in the construction budget to pay for tenant improvements for Steve & Barry's lease," says James Evans, a la~a~~er with Fulbright and Javdorski LLP in Los Angeles v/ho represents Cupertino Square. "They told us you will have to fund most of it out of your pocket." According to the lawsuit, Gramercy v~~rote to Orbit in March, demanding that the owners deposit X3.8 million before the lender will approve the leases for Steve & Barry's, the 400-seat hofbrau and the fitness center -- a direct violation of the contract behNeen Orbit and Gramercy. Gramercy's representative Heidi Gillette did not return calls for comment. It's yet another sign that the credit crisis plaguing the residential markets is worming its way into the commercial sector. Cupertino Square's ability to attract these three retailers ~a~as considered by industry obsen~ers as a sign that the mall's fortunes were on the mend. The center has struggled for years as one ovdner alter another has walked away from what ought to be prime retail real estate given its location in a city ~~~ith one of the nation's highest median incomes. Evans called Gramercy's actions inexplicable: "When a construction lender comes in to a project, you would think that filling a project up with tenants v~~ho pay rent and whose leases sense the lender's interest as vdell as those of the tenants" ~n~ould be a priority. 17 - 1 ~ But he says he suspects after reading Gramercy's 10-K filings with the Security and Exchange Commission that the New York company has run into the same credit problems affecting lenders all over the world. "In the 2007 10-K SEC filing, they state that the squeeze in the capital market may make it impossible to perform on their outstanding and existing loan commitments," Evans says. "We have a lender who is not performing and is telling the world they might not be able to perform. Hopefully the filing of the lawsuit will bring the lender to the table.° Stephen V~ei, one of the center's new owners, says Orbit still believes in newly named Cupertino Square and has invested millions installing a new ventilitation system and preparing the new food court, scheduled to open this summer. "We're thrilled to be there," he says. "Occupancy is up, the momentum is up. G~uite a few things are in fine, teed up and ready to go. That's ~~~hy we were very shocked and saddened and hurt by Gramercy's actions. Wei says the owners tried to resolve the issues "amicably" before resorting to filing a lawsuit. Nonetheless, he says Orbit remains committed to the mall partly because of the city's support, but mainly because of the stellar demographics of the area. Despite the fiact that the inner mall remains almost half empty, current tenants including anchors I/acy's, Sears and JCPenney are sprucing up their space. "The existing tenants are doing fabulous," Wei says. "Ah~C is in the top 10 out of 81 theaters in the Bay Area. Strike Cupertino is popular, and it's tough to get into Alexander's Steakhouse." But in another indication that all is not well, the familiar 88-foot tall Vallco Fashion Park sign that serves as a beacon over Interstate 280 has yet to be removed. Every v,+eek features a different genre from classical, to Zydeco, to ~n+orld jazz. 17 - 14 SOUTH VALI.CO MASTER PLAN COMMUNITY WORKSHOP SUMMARY In March of 2008, the City of Cupertino City Council asked Sand Hill Property Company, operating under 500 Forbes, LLC, to conduct a public outreach effort for the South Vallco Master Plan (see map below). Sand Hill recently purchased the 17.4 acre site bordered by Vallco Parkway, Tantau Avenue, Stevens Creek Boulevard and the Metropolitan development. In response to the City Council request, the following community vdorkshops were held by Sand Hill Properties Company at the Quinlan Community Center: April 10, 2008 - Input on the draft Master Plan concepts for the South Vallco area ~ April 23, 2008 - Input on the refined Master Plan concepts Invitations were sent to approximately 3,000 residents around the 5. Vallco Area in March and April of 2008. Approximately 50 and 70 residents attended the first and second community meetings, respectively. The meetings were conducted in a workshop format with a general assembly in the beginning, break out groups to discuss specific issues or topics and the participants reconvened at the end to share any final thoughts and conclusions. The goals and objectives of the master plan were the focus of the first meeting. More refined master plan concepts were discussed and Sand Hill Properties shared some of their general concepts about the development concepts and potential land uses with bubble diagrams at the second meeting. Description: 5icycle and pedestrian bridge footbridge and related site and landscaping improvements. status: Feasibility study originally reviewed by the City Council in October 2001. budget and design changes were made by the City Council on February 1, 2005. Public meetings were held on February 24, 2005 and April 14, ZD05, at the Quinlan Center to reacquaint the neighborhood with thz new design. Phase 1 construction ~a~as completed in December 2005, Phase 1 included demolition, rough grading and the construction of security / pri~racy fencing. The City Council awarded a 57.3 million construction contract to Golden Stare Bridge, Inc. on November 2D~'to build a newly designed steel bridge. Construction began February 1, 2008 and ~n~ill continue through December. Ground breaking occurred on January 24th.
