This letter confirms the decision of the Director of Community Development, given on July 26, 2012,
approving a retroactive tree removal permit to remove one hazardous 80" trunk diameter Coast Live Oak hee
in the parking lot of the Crossroads Shopping Center at 20750 Stevens Creek Boulevard with the following
conditions:
1. APPROVED PROTECT
This approval is based on the arborist report entitled, "Coast Live Oak Tree #37, Crossroads Shopping
Center, 20730 Stevens Creek Boulevard, Cupertino," prepared by David Babby, Registered Consulting
Arborist #399/Master Arborist #WE-4001B dated June 28, 2012; and the arborist report entitled,
"Cupertino Crossroads Pad F, Tree #37: Quercus agrifolia- Coast Live Oak," prepared by Maxine Espinola,
Certified Arborist#4439A dated June 22, 2012.
2. TREE REPLACEMENT
The applicant shall plant one (1) 72-inch box Valley Oak (Quercus lobata) tree in accordance with the
approved replacement plan and the arborist report prepared by David Babby dated June 28, 2012. The
replacement tree shall be planted prior to final inspection of building permit#11110132.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication requirements,
reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these
Conditions constitute written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval
period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally barred from later challenging
such exactions.
Staff has made the findings necessary to grant the tree removal permit for the hazardous tree in accordance
with Section 14.18.120A (Exemptions) of the Protected Trees Ordinance.

Dear Mr. Schroeder:
As requested, I recently examined the large coast live oak #37 located at the above-
referenced site (site visit performed on 6/26/12), and this letter provides a brief,
preliminary summary of my observations, conclusions and recommendations.
OBSERVATIONS
The oak has a measured trunk diameter of 80 inches, and its age far predates development
of the subject site.
My initial observations of this tree in March 2011 revealed it to be viable and producing
healthy foliage, but also that is has extensive decay around and within the lower trunk,
visible buttress roots, and along major limbs throughout the canopy. It also has a massive
cavity (hollow) filled with concrete at the lower trunk. The extent of decay present led me
to initially conclude that the tree's structural integrity is significantly debilitated or
impaired, and further investigation is needed.
Recent root collar excavation work (performed on 6/20/12) fully exposed the top and
bottoms of most all buttress roots, and revealed an increased extent of decay throughout
the trunk's base and beneath some buttress roots. It also provides a fairly reliable indication
(what is externally visible) that an advanced level of decay has decomposed the vast
majority of the internal trunk area, and resulted in a significant loss in wood strength.

I was also able to identify that there are numerous buttress roots mostly absent of decay
and growing sound wood along the top sides, the presence of which serves to enable the
tree to continue growing, showing signs of viability, and remaining upright (i.e. serving to
anchor the tree to ground). I did observe decay along the top of one buttress root.
Despite the extensive decay and rot, the sound growth of buttress roots essentially replaces
some of the buttress root support, and appears to have effectively done so when
considering the trees many additional years of life. Based on the extent of visible decay, I
suspect an advanced level of decay was present long before the site was initially
developed. As such, the new and ongoing buttress root growth would have been occurring
approximately at or before this timeframe.
Based on the tree's canopy extension and weight, targets currently within striking distance
include contractor personnel, contractor trailer, parking lot (mostly or entirely the rear lot),
and any persons within the planter area.
The tree has a long history of major limbs breaking from the tree, as evidenced by the
many tears and breaks seen throughout the canopy.
CONCLUSIONS AND RECOMMENDATIONS
Based on my evaluation, I conclude the following:
■ Decomposition of sound wood exceeds and accelerates the level of new wood
production.
■ Given the extent of decay, a continuing, progressive and irreversible decline in the
structural integrity is imminent.
■ The tree presents a potential, omnipresent danger of falling.
• There are major defects along the majority of limbs throughout the canopy, defects
that warrant significant reduction in the canopy to effectively reduce the potential
for one to break and fall.

� The tree is beyond repair, and there are no reasonable measures that can be
employed to create a safe condition beneath or around it without debilitating its
health and impairing its natural form.
■ Significant pruning, to potentially severe levels, is needed omit section of the tree
within striking distance of frequently occupied (now and in the future) locations by
persons and vehicles.
■ Severe pruning to achieve effective canopy reduction would only remove the
majority of remaining foliage, weaken the tree's health, and hasten or exacerbate
decline and potential demise.
■ Removal is the most appropriate management approach, conforms to the Town
Code, and I recommend it occur as soon as possible. Any immediate concern could
be addressed through additional pruning, and restricting access in areas within
striking distance of the tree.
■ For mitigation, replacement with a larger specimen appears appropriate given the
tree's very large size and long history. I suggest a valley oak (Quercus lobata) with
a minimum 72-inch box size, and that the particular oak is evaluated and tagged by
me at the nursery before being shipped to the site.
I will follow-up with a more extensive report, including photos, in the upcoming weeks. In

Tree#37: Quercus agrifolia—Coast Live Oak
The purpose of this report is to assess the health of Oak tree#37 after the work recommended in the
tree report dated July 22, 2011 prepared by David L. Babby-consulting arborist.
The existing river cobbles stones and pervious pavers were manually removed, dead branches in excess
of 1"were removed and limbs pruned to reduce heavy limb weight,the existing support cables were
inspected and deemed reliable at this time and did not require adjustment.
On June 20th 2012, a root collar excavation was performed using an air spade and hand tools to expose
the top and bottom of the scaffold roots approximately 16-24" from the trunk's base,which has
revealed three large open cavities with areas of rot that appear to compromise much of the structural
strength of the tree. David Babby was called immediately and informed of the findings,we have
requested that he personally inspect the exposed roots and verify our findings. Construction activities
around the vicinity of this tree continue, and grading/excavation tasks have been performed with no
exposed roots. The tree does not appear to be impacted by surrounding construction, however due to
the health condition of this tree,we recommend its removal.

1.0 INTRODUCTION
The City of Cupertino Community Development Department has retained me to review the
proposed removal of one coast live oak (Quercus agrifolia, assigned and tagged #37)
located at Crossroads Shopping Center, 20730 Stevens Creek Boulevard, Cupertino.
Specific tasks performed are as follows:
■ Examine the tree on 6/26/12 to [1] identify the extent of decay, or lack thereof,
revealed following a root collar excavation performed by others on 6/20/12; [2]
verify whether the excavation exposed sufficient trunk and root area to assess the
extent of decay, and if not, determine whether an internal detection device was
needed to acquire that information; and [3] present measures to mitigate any risk or
hazard to less-than-significant levels.
■ Review observations and recommendations presented in my reports dated 4/4/11
and 7/22/11, as well as a summary letter dated 6/28/12.
■ Review a letter (not dated) by Kahn Design Associates, emailed to me on 6/25/12,
requesting the oak be further evaluated.
■ Review a letter by Medallion Landscape Management, dated 6/22/12,
recommending removal of the oak.
■ Provide findings as to whether the tree's removal conforms to City Code, and if it
does, recommend a replacement tree to mitigate removal.
■ Prepare this report presenting my observations, conclusions and recommendations,
and email it as a PDF document.
2.0 BACKGROUND
I initially observed this tree in March 2011, and at that time, found it to be viable and
producing healthy foliage, but also to have extensive decay within the lower trunk, visible
buttress roots (large roots forming expanded growth at the trunk's base and serving as
anchors for the trunk), and major limbs throughout the canopy. I also noted that it has a

massive cavity (hollow) filled with concrete along the lower trunk, and many large tears
and breaks throughout the canopy, an indication of a long history of major limbs breaking
from the tree (and pruning of the tree likely non-existent for much of its life).
The extent of decay observed led me to conclude that the tree's structural integrity is
significantly debilitated or impaired, and as a result, I rated it to be in overall poor
condition and to have a low suitability for preservation. In response, I recommended (in
both reports) that further examination be performed, and measures for reducing the tree's
risk of potential of failure employed. Those measures, as outlined in my 7/22/11 report,
were recently performed, with the root collar excavation work completed on 6/20/12.

3.0 OBSERVATIONS
The subject oak is very large and mature, has a trunk diameter of 80 inches, and its age far
predates development of the subject site. Based on its species and size, it is regulated as a
"protected tree" pursuant to Section 14.18.035(B) of the City Code.
During my site visit on 6/26/12, I found the root collar excavation work fully exposed the
top and bottoms of most all buttress roots (these are massive roots serving to anchor the
tree into the ground), and revealed a sufficient segment of the trunk and major roots to
allow for a detailed assessment of decay. My examination ascertained extreme and
advanced levels of decay throughout the trunk's base and beneath buttress roots, decay that
has deteriorated or rotted the vast majority of internal trunk area, and significantly
decreased wood strength. A description of my observations at various locations around
the trunk are as follows, and photographs illustrating my observations are presented in
Exhibit A:
■ Southeast side: There is a major buttress root that appears sound (i.e. free of decay)
and forming new wood around its top; however, decay beneath is extensive. The is

also a massive hollow filled with concrete, a likely result of a large 21-inch
(approximately) limb failing many years ago.
■ East side: There is a hollow with extensive decay observed near the base, and the
decay extends inward beneath major buttress roots.
■ Northeast side: There is a major buttress root with extensive decay at its bottom, and
some is developing at its top.
■ North side: There is a four-foot tall and equally wide wall of deteriorating, decayed
wood, extending towards the SW. Looking NW, there is also extensive decay.
■ Northwest side: There is a major buttress root, the top of which appears sound.
■ West side: There is extensive decay visible in all directions.
■ South side: There is some decay within one buttress root, and an adjacent buttress
root that remains buried appears sound.
My examination also revealed that all but one buttress root have sound wood growing
around their tops and sides, a condition that explains, despite the extensive decay
discovered, why the tree has for many years� remained anchored into the ground, continues
growing, and exhibits signs of viability. If this were not the case, the tree would have
likely uprooted and fallen over many years ago.
Regarding the canopy (versus the lower trunk and roots), its structure is formed by five
major leaders originating between four and eleven feet above grade along the main trunk.
Along most all, decaying wounds are prevalent, and areas where this was observed are as
follows:
■ The northern leader divides at approximately 15 feet high, and limbs beyond have
extensive decay, large wounds from past limb failure, and dieback.
■ The western leader, the largest of them all, has three multiple locations where large
limbs have failed and resulted in substantial decay.
■ The other three leaders are predominantly along the east side of the canopy, and
have numerous, decaying wounds resulting from past limb failure.
' Based on the extent of decay found, I suspect decay was present long before the site was initially
developed, likely by many decades or more than 100 years.

4.0 DISCUSSION
A tree's ability to produce sound wood more rapidly than decay decomposes wood serves
as a potential threshold for determining whether a tree will continue thriving and remain
viable, or whether it will progressively decline and become increasingly prone to demise
and/or structurally failing (in whole or part).
For this tree, decay comprises the vast majority of its internal trunk area and locations
along most major limbs, and at rates far exceeding the tree's ability to produce new wood.
As such, the risk of the tree to potential fail in part(e.g. a major limb failure) or whole (e.g.
the tree uproots) is significant, a risk that is irreversible and will progressively increase
overtime. The hazard associated with this risk involves failure onto frequent or constantly
used targets (current and future), such as other persons, construction trailer, parking lot
(mostly or entirely the rear lot) and vehicles.
Options for potentially mitigating the risk or hazard to less-than-significant levels are as
follows:
a. Remove the tree.
b. Severely prune the tree to omit sections within striking distance of existing and
future targets; however, to effectively reduce the canopy, the majority of remaining
foliage would require removal, thus debilitating the tree's health, degrading its
aesthetic contribution, and hastening or exacerbating decline and potential demise.
c. Restrict targets from accessing areas within striking distance of the tree (limbs and
trunk); by doing so, the hazard effectively becomes eliminated or reduced. To
achieve this, however, significant design revisions or site modifications would
seemingly be necessary, parking spaces and drive accessibility reduced, the area
fenced off, and the economic enjoyment of the property may be restricted by
severely limiting the use of property in a manner not typically experienced by
owners of similarly zoned and situated property.

5.0 CONCLUSIONS AND RECOMMENDATIONS
Based on my observations and review of potential mitigation measures, I conclude and
recommend the following:
a. The tree is beyond repair, and there are no reasonable measures that can be
employed to create a safe condition beneath or around it without impairing its
health and natural form.
b. Removal is the appropriate management approach to effectively mitigate the risk
or hazard.
c. Removal should be permitted in accordance with finding number 12 and possibly
23 of Section 14.18.180 of the City Code.
d. To mitigate removal, the subject oak's massive size and long history should be
considered, and in doing so, replacement with a larger specimen appears
appropriate. I recommend a valley oak (Quercus lobata) of a minimum 72-inch
box size, and that the particular oak is evaluated and tagged by me at the nursery
before being shipped to the site. Its location and method of irrigation should also be
reviewed and approved by the City prior to installation, and if necessary, root
pruning performed prior to or during installation.
e. All new trees should be installed, including necessary irrigation, by an experienced
state-licensed landscape contractor or a professional tree-service company, and
performed to professional industry standards.
Z Finding number 1 is as follows: That the tree is irreversibly diseased, is in danger of falling, can cause
potential damage to existing or proposed essential structures, or interferes with private on-site utility
services and cannot be controlled or remedied through reasonable relocation or modification of the structure
or utility services.
3 Finding number 2 is as follows: That the tree's location restricts the economic enjoyment of the property
by severely limiting the use of property in a manner not typically experienced by owners of similarly zoned
and situated property, and that the applicant has demonstrated to the satisfaction of the approval authority
that there are no reasonable alternatives to preserve the tree.
