SUBJECT: TREE REMOVAL PERMIT ACTION LETTER - Application TR-2012-23
This letter confirms the decision of the Director of Community Development, given on July 31,
2012, approving a tree removal permit to allow the removal and replacement of a 35 inch Coast
Live Oak tree which is causing property damage to the residence located at 18650 Cynthia
Avenue. The application is approved with the following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by Arbor Resources, dated June 11, 2012,
consisting of 15 pages and a site plan dated June 12, 2012, except as may be amended by
conditions in this resolution.
2. TREE REPLACEMENTS
The applicant will be required to plant one (1) 36" box Coast Live Oak (Quercus agrifolia)
replacement tree in accordance with the Protected Tree Ordinance, arborist report, and
approved replacement plan. The replacement shall be planted within 30 days of the effective
approval date of this tree removal permit. The applicant is encouraged to coordinate with
neighbors to ensure the safe and timely removal of the subject tree.
3. PROTECTED TREE COVENANT
The applicant shall be required to record a covenant recording the replacement trees as
protected trees within 30 days of planting the replacement trees in accordance with the City's
Protected Trees Ordinance. Failure to do so may result in code enforcement and/or
administrative citations.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are
hereby further notified that the 90-day approval period in which you may protest these fees,
dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all of the
requirements of Section 66020, you will be legally barred from later challenging such exactions.
Staff has received comments from neighbors, inquiring whether the trees will be trimmed or
removed, the location of the subject tree, and how many replacements will be planted. The
Coast Live Oak tree is located just southwest of the structure and will be completely removed.
One 36" box replacement tree will be required with the tree removal in accordance with the
approved replacement plan.
Staff has made the findings necessary to grant the tree removal permit in accordance with
Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of
this decision can be made within 14 calendar days from the date of the mailing of this
decision. If this happens, you will be notified of a public hearing, which will be scheduled
before the Planning Commission and the trees cannot be removed until a final decision on
the appeal has been made. If no appeal is made within the appeal period, the tree(s) may be
removed after Wednesday, August 15, 2012.

1.0 INTRODUCTION
Mr. Joseph Li, property owner, has retained me to perform the following services with
regards to an oak located at 18650 Cynthia Avenue, Cupertino: .
■ Visit the property with you on 5/17/12 to observe the oak and its proximity to the
home, which appears to have the original foundation from 1955.
■ Identify the oak's size and ascertain its condition.
■ Review the foundation report by Larrabee & Associates, dated 5/25/12.
■ Opine as to whether removal of the oak adheres to City Code based on existing site
conditions.
■ Prepare this report, which has been submitted via email as a PDF document.
This report presents my observations, conclusions and recommendations. Photographs are
presented in Exhibit A, and were obtained during my site visit on 5/17/12.
2.0 OBSERVATIONS
2.1 Size
The tree in question is a large coast live oak (Quercus agrifolia) that is approximately 60
feet tall, and has a trunk diameter of 35.6 inches measured at 54 inches above ground level.
Based on its species, as well as its trunk diameter exceeding ten inches, it is regulated as a
"protected tree" pursuant to Section 14.18.035(B) of the City Code. Photographs taken of
the tree from a considerable distance are provided on pages A-1 (from the front of the
home) and A-2 (from backyard).
The canopy spreads an average of 75 feet across (diameter), and extends, from center of
trunk, 35 feet north, 50 feet south (to and beyond the rear fence line), 35 feet west and 30
feet east.

2.2 Location and Surrounding Site Conditions
The oak's center of trunk, at is base (where its trunk and ground meet), is situated 11 feet
west from the western property line, 37 feet from the southern (rear) property line, and two
feet from the home's foundation. At the roof eave, the trunk is nearly four inches away
(see page A-3).
The trunk's base nearly abuts the foundation (see pages A-4 and A-5). The dominant
northern buttress root (these are massive roots serving to anchor the trees into the ground)
is about 12 inches from the foundation, and a root extending from this buttress is surfaced
and visible two inches away. Given the trunk's proximity to the foundation, very large
roots below ground are expected to be growing along and beneath the foundation.
The dominant eastern buttress root abuts the southwest corner of the chimney (see pages
A-4 and A-5). A large five-inch root is seen surfacing towards and eventually growing
along the brick chimney.
I observed no damage to the adjacent foundation or fireplace. The foundation report
(pages 1 and 2) identifies a 1.6" � un-uniform lifting of the foundation near the tree.
Beneath the canopy is predominantly barren soil, a concrete patio, and single-family
residence. There are also two trees immediately adjacent to the trunk; one is a coast live
oak with a 23-inch trunk diameter, and the other a California bay tree (Umbellularia
californica) with a 13-inch trunk diameter (see page A-5). They are situated to the west
(near the fence line), and the oak is seven feet and the bay eight feet away. Based on their
species and trunk diameters, both are also "protected trees" pursuant to Section
14.18.035(B) of the City Code.
The 23-inch diameter oak has a suppressed canopy due to growing beneath the dominant
canopy of the larger oak in question. Because of this, its branching architecture or habit is
forced mostly entirely towards the western neighboring property, and in a downward
direction towards the western canopy edge of the dominant, subject oak. The branches

appear heavy and prone to breaking, and there is an extensive dead branches throughout
the canopy.
The bay tree's trunk is three feet from the foundation of the residence. Its structure is
comprised of two trunks that form a weak structure prone to failure.
A utility pole is situated at the southwest edge of the canopy, on the adjoining western
neighboring property.
2.3 Condition
The subject oak appears very healthy and vigorous as shoot growth, foliage color and
canopy density are nearly optimal. Dead branches are found throughout the canopy,
however, the levels are typical for a tree of this size, and do not indicate weakened health.
Note that there is a dead branch hanging over the roof, and it should be pruned away due to
being prone to breaking and falling.
The tree's structure appears stable, and i found no apparent signs of weak attachments or
unstable rooting structure. My examination of the trunk's base reveals a healthy and
exposed root crown, with no apparent signs of decay or infection.
There is indication of some very minor infestation of Western Sycamore borer
(Synanthedon resplendens), evidenced by the sawdust-like frass at the base of the trunk.
Oaks, however, are prone to attacks, and are not known to be adversely impacted,
particularly at minor levels.
Along the lower eight feet of the trunk's east side, I observed numerous wounds from what
appears to be from spikes used to climb the tree. I find the damage to be minor, and the
tree is unlikely adversely impacted. However, it is important to note that the use of spikes
to ascend a tree is not an accepted industry standard as it can result in sites of decay and
infection for the tree; the exception to this rule is when a tree is being removed, or for other
reasons (e.g. pruning or aerial inspection)to protect a climber should a tree be hazardous.

3.0 FINDINGS LISTED IN CITY CODE
Pursuant to Section 14.18.180 of the City Code (Review and Determination of
Application), one of the following three findings must be established for issuing a tree
removal permit:
1. That the tree is irreversibly diseased, is in danger of falling, can cause potential
damage to existing or proposed essential structures, or interferes with private on-site
utility services and cannot be controlled or remedied through reasonable relocation or
modification of the structure or utility services.
2. That the tree's location restricts the economic enjoyment of the property by severely
limiting the use of property in a manner not typically experienced by owners of
similarly zoned and situated property, and that the applicant has demonstrated to the
satisfaction of the approval authority that there are no reasonable alternatives to
preserve the tree.
3. That the protected tree is a detriment to the subject property and cannot be adequately
supported according to good urban forestry practices due to the overplanting or
overcrowding of trees on the subject property.
4.0 CONCLUSIONS
Based on my review and observations, I conclude the following:
■ Removal of the subject oak adheres to criteria provided in finding number one,
as it clearly presents potential damage to the foundation and structure, and may
have already caused lifting per the foundation report.

■ The oak's trunk nearly abuts the foundation, and due to future trunk and buttress
root expansion, there is a significant potential that serviceability of the foundation
and/or structure will be severely impaired in the foreseeable future.
■ Alternatives to mitigate the threat of damage to less-than-significant levels do not
appear reasonable, practical or safe, as is would require the home's foundation and
structure being modified, and/or massive roots serving to anchor the tree being
removed. The consequence of root pruning would jeopardize the tree's stability,
while creating a hazardous situation that threatens life and property below.
My conclusions consider the following criteria and assumptions:
a. The home and foundation comprise an "essential structure."
b. A 1.6" � un-uniform lifting of the foundation near the tree was found (per the
foundation report).
c. Existing site conditions are being considered.
d. The property is not being planned for development.
e. The home is not being planned for an addition/remodel.
f. The home is not being planned for demolition and rebuilding.
Given the tree's large size and healthy and structurally stable condition, my conclusion
would likely differ if items "d thru f" above are planned to occur, the reason being that
there is the potential opportunity for controlling any threat to the home by constructing
around the tree (per language contained in finding number one listed in Section 3.0 of this
report).

5.0 RECOMMENDATIONS AND TREE REPLACEMENTS
Pursuant to my conclusions, I recommend the tree is permitted for removal in
accordance to finding number one contained in Section 14.18.180 of the City Code, and a
replacement or replacements are installed as mitigation.
Additionally, note that removal of the subject oak would expose the adjacent, suppressed
23-inch diameter oak to limb and branch failure, and pruning of the adjacent oak would be
necessary and imperative for safety reasons (it is currently being "sheltered" from wind
and other elements by the subject oak, and this "shelter" will effectively be removed by
removing the subject tree).
For replacements, applying Table A, Section 14.18.185 of the City Code, a total of either
two trees of 24-inch box size or one tree of 36-inch box size are required for installation
to mitigate removal of the oak.
For this property, I recommend coast live oak, valley oak, red oak or coast redwood are
considered. They should be installed beyond canopies of existing trees, and at least 15 to
20 feet from the home.
All new trees should be installed, including necessary irrigation, by an experienced state-
licensed landscape contractor or a professional tree-service company, and performed to
professional industry standards.

6.0 ASSUMPTIONS AND LIMITING CONDITIONS
■ My conclusion considers existing site conditions, and assumes that [1] the property is not being
planned for development, [2] the home is not being planned for an addition/remodel, or [3] the
home is not being planned for demolition and rebuilding.
■ The scope of work assigned for this report pertains solely to the subject oak. I hold no opinion
towards other trees on or surrounding the property, except to a limited extent, the adjacent oak
and bay beneath the subject oak's canopy.
■ All information presented herein considers the condition and appearance of the subject oak at
the time and location of viewing.
■ My observations were performed visually from the ground, and did not involve probing, coring,
dissecting or excavating. I cannot, in any way, assume responsibility for any defects that were
not observed, or could only have been discovered by performing the mentioned services in the
specific area(s)where a defect was located.
■ I cannot provide a guarantee or warranty, expressed or implied,that deficiencies or problems of
the subject tree ar property in question may not arise in the future.
■ No assurance can be offered that if all my recommendations and precautionary measures
(verbal or in writing)are accepted and followed,that the desired results may be achieved.
