CC Resolution No. 323i i RESOLUTION NO. 323 MWWTI(JN OF THE C1T�f '�IL OF THE CITY, OF CUPERTINO, �i'ING ONSEGT To � SA ITARY ]DISTRICT OF SANTA cLAitA L[i.Ih y 'MYTH "'" ' To l orAL 1WROVEMENT Tl:C IUCT 'WHEREAS, the Board of Mroci,ors of Cuo4rtin Sanitary District hi* filed a resolution �Ath this City Council for the construction of cGrLain improvements, more particularly describ *d in said Resolution; and M EREAS, a ;portion of said work will be dons in streets, high- rays, and public places over which this City has jurisdiction; and WHEREAS, the public interest and general welfare will be served by undertaking and completing said project; , THEREFORE, IT IS ORDERED as follows: 1. That consent be, and the same is hereby granted to said Cupertino Sanitary District (Local Improvement District No. 5) to construct said improvements as described in said Resolution, and to the levy and collection of assessments in whole or In part upon the lands and lots benefited by the construction of said sewage collecticn system. 2. That consent be, and the same is hereby granted to said Cupertino Sanitary District (Local Improvement District No. 5) to open all such public streets, roads, hi.ghirays, and public places as are under the Jurisdiction of said City, end as are required for the construction of said improvements. All work $iertaini.ng to said project shall be done under the directia-n of the Engineer of said District and to the satisfaction of the City Engineer of the City of Cupertino, and in conformity with good engineering practice ►. Said Engineer of said District shall require of the contractor that all of the provisions of the specifications are complied w1th by the contractor, to the end that no greater amount of ditchas are open at, any time than 14 necessary, that they shell be adequately lighted and barricaded, and th*t t1h &y shall bo promptly backfilled and that the pave- **tit *hall be r asrtoriaW u4th moo torialt of 11 k* gaatlity and cf4r*tter as those existino therein at the ilea of cuoh work s Ca its forcer condition and state of usofulness as nearly as awy be, and in foralty with City Ordinances o ttablished therefor. The Cupertino Sanitary District (Local Imp rovoment District No.. 5) will indemnify and hold harmXens the City of Cupertino, State of California, its officarrs and employees from all suits and actions of every name arA description brought for or on account of any damages or Injuries received or Gustained by any person or persons, by or fzvm the contractor, his servants or agents, in the construc- tion of the work or by or in consecpience of any negligence in guard - Inn; and - warning of the same in improper materials used in its construction, or on account of any act or omission of the contractor or his agents or employees. 3. That the City Clerk: be, and he is hereby directed to file with tj�.e aecrefiaxy of the Bosx-a of Directors of Cupertino Sanitary District A certififsd copy of this Resolution.
