CC Resolution No. 309RESOLUTION NO. 309 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO DEFINING THE POSI- TION OF THE CITY IN RELi,TION TO PRESENT AND PROPOSED ANNEX;.TION LAWS I-11D PROCEDURES. WHEREAS, the Assembly Interim Comm''Lttee on Municipal and County Govern- ment has requested the City to state it :s views on present annexation laws and procedures, and WHEREAS, the City Council feels it to be in the public interest'to make specific recommendations on principles to be observed in future leg- islation;. NOW, THEREFORE, BE IT RESOLVED: 1. The incentive for annexation should be limited to the ability to and willingness to supply services rather than the breaking down of pre- existing zoning requirements and development requirements. 2. The City Council is opposed to the formation of a State ,agency. The Santa Clara County Board of Supervisors is the proper agency for any overall jurisdictional. authority. The Board is certainly fully aware of the problems of Santa Clara County. This is undoubtedly true of any County Board of Supervisors. 3. The City Council is unalterably opposed to any tampering with the present disannexation statutes. To do so would convert "annexation problems" into "disannexation problems" with a resulting chaos that would leave tax payers completely vulnerable to the negotiated "gentlemen's agreements" of the few. 4. In the matter of islands, Cupertino is not confronted by this pro- blem and therefore takes no position. BE IT FURTHER RESOLVED that the City Clerk be and hereby is instructed to deliver fifteen (15) certified copies of this resolution to the .Assembly Interim Committee on Municipal and County Government attention Christine B. Harrison, Committee Secretary, 4148 ;state Capitol, Sacramento, California. BE IT FURTHER RESOLVED that a certified copy of this Resolution be addressed to the Board of Supervisors of Santa Clara County.
