SURREL IZONARD an individual,, hereinafter called Grantor, in
consideration of the value received from the CITY OF CUP RTIUO a
municipal corporation, hereinafter called Grantee the adequacy and
receipt whereof are hereby acknowledged hereby g rants to Grantee
the rig ht to excavate for install„ replace (of the initial or any
other size), maintain, and use for conveying storm water, such pipe
line or lines as Grantee shall Prod time to time elect within the
hereinafter described stri of thoi;e certain premises which are situate
in the County of Santa Clara, Itate of C;.�xlifornia, =and described as
follows:
PARCEL 1
A strip of land. twelve (12) feet In width the northerly line
of which Is more particularly described as follows**
Reginning at the northwesterly corner of that certain tract
of land conveyed to Burrel Leonard by deed recorded In Book 305J#
Official Records, page 216, SEata Clara County Records sala
corner being also on the southerly line of Homestead Road as it
formerly existed, 4o feet in width; thence easterly along the
northerly line of said tract of land conveyed to Durrel Leonard
399.10 feet, more or less, to the northeasterly corner thereof.

A strip of land seventeen (17) feet In width, the westerly
line of which is more particularly described as follows:
Beginning at a point on the! northerly line of Lot 1 as snald
Lot 1 is described in deed to Burrel Leonard as recorded in Book
3055s Official Records, page 2:16, Manta Clara County Pecords
said point being North 90 00 East 19 feet distant thereon along
the said. northerly line of Lot 1 from the northwesterly corner
of said Lot 1 thence South 1 12 West 1572*23 feet parallel to
and 19 feet p;rpendIcul, distant easterly from the westerly
line of said Lot 1 to the intersection thereof with the easterly
prolongation of the northerly line of that 1.674 acre parcel
shown on the map of a Record cf Survey for Burrel Leonard, as
filed for record in Book 60 of Maps, page 30, Tanta Clara County
Records; thence South 2 31 21 Oest 205,67 feet, more or leas
to the intersection thereof with the southerly line of said
Lot 1, said point being North 90 00 East 14.25 feet from the
southwesterly corner of said Lot 1.
Grantor hereby further grants to Grantee the right and privilege
to enter upon his lands contiguous to and along the line of said here-
inabove described strip for the purpose of locating constructing,
repairing maintaining, or relaying said pipe line or lines or a
thereto, and, for the purpose of doing any necessary or lawful act in
connection with the construction or maintenance of said pipe line or
lines; there is also granted the right of the use of sufficient land
contiguous to said strip on either or both sides thereof for the
rurrose of and. as may be necessary and convenient for the purpose of
excavation of and (leposit of earth anet necessary buildir4. material
during the time of constructinp and any repair
said line or lines,
thereof.
The foregoing Is subject to the following express conditions:
The Grantee agrees to restore the ground surface and any Improve-
ments thereon to Its original Frr-ade or condition Insofar -as it is
practicable and reasonable to do so.
This grant shall bind the heirs and assigns of the parties
hereto.
