Easement which is in good anc sufficient form, conveying to CITY
OF CUPERTING, a municipal corporation, grantee, an easement for
the location, maintenance, construction, repair, replacement anc

hereinafter called Grantor, in consideration t the value received
from the CITY OF CUPERTII�0 a municipal corporation, hereinafter
called Grantee, the adequacy and re --eipt whereof are hereby acknow-
ledged hereby grant] to Grantee th° right to excavate for, install,
replace (of the initial or any other size), maintain, and use for
conveying storm water such pipe line or lines as Grantee shall from
time to time elect within the hereinafter described strip of those
certain premises which are situate in the County of Santa Clara,
State of California, and described as follows:

in width; thence easterly along the northerly line of said

Grantor hereby further grant_j to Grantee the right and
privilege to enter upon . jr lands contiguous to ?nd along the
line of said hereinabove described strip for the purpose of locating,
constructing, repairing, maintaining, or relaying said pipe line or
lines or annurtenances thereto, anc.for the purpose of doing any
necessary or lawful act in connection with the construction or
maintenance of said pipe line or lines; there is also granted the
right of the use of sufficient land. contiguous to said strip on
either or both sides thereof for the purpose of and as may be nec-
essary and convenient for the purpose of excavation of and deposit of
earth and necessary building: material during the time of constructing
said line or lines, and any repair thereof.
The foregoing is subject to the following express conditions:
The Grantee agrees to restore the ground surface and any im-
provements thereon to its original grade or condition insofar as
it is practicable and reasonable tc do so,
This grant shall bind the heirs and assigns of the parties
hereto.
