RESOLUTION ORDERING NFORK, DETERMINING PREVAILING
RATE OF 'STAGES, AND DIII� CTING NOTICE TO BIDDERS
IN CORTE MA.DERA HIGHLANDS LOCAL IIiPROVEMENT DISTRICT
IN THE CITY OF l'aUP CALIFORNIA
WHEREAS, the City Council of the City of
passed and adopted September 16, 1957, its Re
No. 56 to do the work and improvement therein
charge the expense thereof upon an assessment
described; and
WHEREAS, said City Countil thereafter on
Cupertino, California,
solution of Intention
described and to
district therein
October 7, 1957, duly
held a hearing on said Resolution :No. 56 at the time and place therein
appointed therefor, and at said hearing; heard and considered all pro-
tests theretofore filed against said proposed work or the extent of
the district to be assessed for the cost thereof, or both; and
WHEREAS, all of the property owners submitted a petition at
said hearing requesting certain changes in the proposed work, and
said petition is on file with the Clerk of said City Council; and
WHEREAS, said City Council th.sreupon held a hearing and con-
sidered all protests to the changes requested in said petition; and
WHEREAS, said City Council thereafter directed the Engineer of
Work for said Improvement District to prepare and submit to said
Council plans and specifications for said work of improvement as
described in said Resolution No. 56, and as proposed to be changed
as described in Resolution No. 60, passed and adopted by said City
Council on October 7, 1957, and in conformity with said petition
filed on October 7, 1957; and
WHEREAS, said Engineer of Work has submitted modified plans
and specifications as directed by raid City Council, and said City
Council by Resolution No. 62 , passed and adopted on October 21,
1957 has approved said modified plans and specifications and de-
clared intention to change work proposed to be done under said
Resolution No. 56; and
WHEREAS, all of the property owners on October 21, 1957,
have submitted a petition stating; that said modified plans and
specifications and. change of word: proposed to be done are the
same as those proposed in their petition on which hearing of pro-
tests was held on October 7, 1957, and said petition is on file
with the Clerk of said City Council; now, therefor
BE IT RESOLVED, that the public interest and convenience re-
quire, and said City Council hereby orders that said work and im-
provement be done as set forth in said Resolution of Intention
and according to plaris and specifications theretofore adopted
therefor as modified and changed by Resolution No. 62 , adopted.
October 21, 1957, reference to which is hereby made for a descrip-
tion of said work and improvement, and the terms and conditions
under which the same is to be done; and further
BE IT RESOLVED, that said City Council hereby determines the
general prevhiling rate of per diem wages, and rates for overtime
and legal holidays, in the locality in which said work is to be
performed, for each craft or type of workman or mechanic needed
to execute the contract therefor, to be stated in the Notice to
Bidders hereinafter set forth to 'be posted and published; and fur-
ther
BE IT RESOLVED, that the Clerk of said City Council shall
post conspicuously for five (5) days, on or near the main entrance
door to City of Cupertino Offices, 10031 Sunnyvale- Saratoga Road,
Cupertino, California, a Notice to Bidders in the form hereinafter
stated, inviting sealed proposals or bids for doing said work and
referring to said Plans and Specifications on file; and shall pub-
lish said Notice twice in the Cupertino Courier, a newspaper pub-
lished and circulated in the County of Santa Clara in said State,
and hereby designated for that purpose.
All such proposals or bids shall be submitted, received, and
publicly opened, examined, and declared, and shall be accompanied
by a certified check or bond, all as stated in said Notice to Bid-
ders, which Notice shall be as follows;

Pursuant to law and Resolution No. 63 of the City Council of
the City of Cupertino, State of California, passed and adopted on
October 21, 1957, ordering=; work, determining prevailing rates of
wager, and directing thin notice, said City Council invites sealed
proposals or bids for the followin;; work to be done, to -wit:
The construction of plant mix street pavements, concrete curbs
and. gutters, storm sewers, sanitary sewers, water lines, gas lines,
lighting, and all other work auxiliary thereto, to the extent, with
the materials and in the manner se', forth in Resolution No. 56,
passed and adopted by said City Council September 16, 1957► and in
accordance with plans and a0ecifICELtions adopted therefor, and modi-
fled and changed by Resolution No. 62 , passed and adopted by said
City Council on October 21, 1957, end by modified plans and specifica-
tions approved and adopted by said Resolution No. 62 for said work
as so changed, to which Resolution of Intention No. 56, Plans and
Specifications, Modified Plans and Specifications, Resolution No. 62
apDroving and adopting said Modified Plans and Specifications, and
said Resolution Ordering Work reference is hereby made for a descrip-
tion of said work and improvement and the terms and conditions under
which the same is to be done.
The Modified Plans and Specifications for the proposed work
may be seen an?. examined at the office of the Engineer of Work, P-Ia_rk
Thomas & Co., 18 North San Pedro Street, San Jose, California, or
may be secured at said office of :Mark Thomas & Co. by making payment
of Fifteen and No /100 Dollars 015.00). There will be a refund of
Ten and No /100 Dollars ( on said Modified Plans and Specifica-
tions to any bidder or interested bidder who returns the same in good
condition within five (5) days after the opening of bids.
Pursuant to law, the City Council of the City of Cupertino has
determined the general prevailing rate of per diem wages, and rates
for overtime and legal holidays, in the locality in which this work
is to be performed, for each craft or type of workman or mechanic
needed to execute this contract. The prevailing rates so determined
are as follows:

NOTICE IS ALSO HEREBY GIVEIv RIDDF;I S that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all sub-
contractors under him, to pay not less than said general prevailirg
rates of per diem wages, as above listed, to all laborers, workmen, and
mechanics emnployed in the execution of the contract.
Before submitting proposals, the bidder shall be licensed in
accordance with the provisions Of Chapter 9, Division III of the Business
and Professions Code, Chapter 37, of t: Statutes of 1 939, as amended,
Of the State of California, which provide for the registration and
licensing of contractors.

Each bidder must submit with his proposal a statement of his
financial responsibility, technical ability and experience on the
form to be furnished, prospective bidders, and. a statement as to
whether the bidder is an individual., a partnership, a ,joint venture
or a corporation.
Each bidder shall submit with his bid, on the form provided, the
name and address of each subcontractor, including the principal sup-
pliers of materials, and the portion of the work which each subcon-
tractor will do. If the contractor fails to name the subcontractors
in his proposal, he shall be deemed to have agreed to perform such
portion of the work himself and shall not be permitted to subcontract
said portion of work without previous written permission of said
City Council..
ALL PROPOSALS or BIDS shall be delivered to the Clerk of said
City Council at his office, to -wit: the City of Cupertino Offices
at 10031 Sunnyvale- Saratoga Highway, Cupertino, California, on the
18th day of November, 1957, up to the hour of 8 :00 o'clock p.m.,
or delivered to him at the meeting place of said City Council by
the hour of 8 :00 o'clock p. m., on which day at said hour of 8 :00
o'clock p.m. in said meeting place of said City Council at 10031
Sunnyvale- Saratoga Highway, Cupertino, California, said PROPOSALS or
BIDS shall be publicly opened, examined and declared, and each pro-
posal must be accompanied by a check: certified without qualifica-
tion by a responsible bank, payable to said City Council, for an
amount not less than ten per cent (1.0) of the aggregate of the pro-
posal, or by a bond. for said amount, and so payable, signed by the
bidder and two (2) sureties, all as presckibed by law.
