WHEREAS, on Tuesday,Jan.17, a petition in the files of the City Clerk of the City of Cupertino was presented to the City Council of the City of Cupertino requesting the Council to give its consent to the commencement. of annexation proceedings in connection with that certain inhabited territory therein referred to and generally described, which is contiguous to the City of Cupertino; and MIE LEAS, said petition was referred to the Planning Cornission of the City of Cupertino for investigation, report and recommenda- tion; and V,'TiEREAS, th© Plannini Corunission rendered its report and recommendation to the Council can the Jan. 1.8, 1956 , favoring the commencement of annexation proceedings; and MM --LAS, the County Boundary Commission of Santa Clara County has heretofore approved the proposed boundary of said Stellin Road No. 1 -C as to definiteness and certainty; and WHI1FtWs it is the desire of the City Council to give its consent to the commencement of such annexation proceedings. NMI.. T=�EFOR , BE IT RMOLV D by the City Council of the City of Cupertino: SECTION 1. That consent be and hereby is granted for the commencement of annexation proceedings in connection with said inhabited territory in accordance with the Annexation Act of 1913 provided the petition for annexation contains a request that the -:Lm question to be submitted to tho electors residing in the territory proposed to be annexed shall bo whether the territory shall be annexed and the property in tho territory subjected to taxation after annexation equally with property within the City of Cupertino. SECTION 2. That said unincorporatod territory be and hereby is designated as the Stellin� Load No. 1 -C is bounded generally as follows: That area generally to the south of the Cupertino City limits as incorporated, to the east of Stelling Road, north of Prospect Road and east of C Creek and north of Wardell Road and west 5T Saratoga-Su Tv Roa ' " - S.
