1. That, pursuant to the provisions of the "Annexation
of Uninhabited Territory Act of 1939," a petition signed by
owners of not less than one-fourth of the land in the herein-
after described territory by area and by assessed value as
shown on the last equalized assessment roll of the County of
Santa Clara, was duly filed with the Council of the City of
Cupertino requesting annexation of the hereinafter described
territory to said City; that said territory which said
petitioners request be annexed to the City of Cupertino and
whALch said Cit7 and its Council propose to annex to the City
of Cupertino is situate In the County of Qanta Clara, State
of California, hereby designated "Homestead No. 1-C", and
described as follows:
Beginning at a point in the center line of
homestead Road, said point being also the north-
westerly corner of that certain parcel of land
conveyed to John Komenovich,, et ux,, by deed re-
corded in Book 1289., Official Records, page 76,
Santa Clara County Records; thence southerly
along the westerly line Of said parcel, said line
being also an easterly boundary line of the City
of Cupertino, to the southerwesterly corner thereof,
said point being; also on the northerly line of
Tract No. C62., Garden Gate Villaie,, Unit No. 2,
a map of which is recorded In Book 26 of Maps,,
pages 24 and 25, Santa Clara County Records;
thence easterly along the southerly line of said
parcel of land as conveyed to John Komenovich,
et ux, to 'the southeasterly corner thereof; thence
northerly alone the easterly line of said parcel
of land as conveyed to JDhn Komenovich, at ux
to the northeasterly corner thereof, said point
being also on the cantor line of Homestead Road;
thence westerly along the center line of said
homestead Road to point of 'beginning.

2. That the County BOU11dary Commission of Santa Clara
County, California, did approve the proposed annexation
boundaries of said "Homestead No, l-C", as above described,
and as submitted to said Commi`ssion by the proponents of
said annexation ol' said territory to said City.
3. That on March 5, 19"i6 at the hour of 6:00 o'clock
P,M, of said day, In the Library of the Cupertino Union School
in the City of Cupertino, Couaity of - -,anba Clara California,,
is hereby fixed as the time and place when and where any person
ownInS real property within the uninhabited territory above
described and proposed to be annexed to the City of Cupertino
and having any objections to the proposed annexation may
appear before the Council of the City of Cupertino and show
cause why such aninhabited territory should not be so annexed
to said City of Cupertino. Such protest must be in writing,
may be filed at any time before the hour set for hearing, ob-
jections to the pr annexation, and shall state the name
or names of the ourner or owners of - property al'fected and the
description and area of such property in General. term
4. The 1 0 4 uty Clerk of the City of Cupertino is hereby
authorized and directed to cause a copy of this Resolution to
be published at least twice but not oftener than once a
in The Cupertino Courrier, a newspaper of general circulation
published in said City of Cupertino, the city to which it is
proposed to annex the aforesaid territory, and also In The
San Jose Mercury, a newspaper of general circulation published
outside the City of Cupertino, but in the County of Santa Clara,
California, the county in w 1 hi,ah Is located the territory proposed
to be annexed to the City of Cupertino, said publication to be
complete at least twenty (20) days prior to the date set for
hearing;

And the said City Clerk is further authorized and directed
to cause written notice of such proposed annexation to be
mailed to each person to whom land within the territory proposed
to be annexed is assessed in the last equalized county assess-
ment roll available on the date the above said proceedings were
initiated, at the addresses shown on said assessment roll or
known to said Clerk, and to aay Person who has filed his name
and address and the designation of the lands in which he has
an interest, either legal or equitable, with said Clerk, such
notice to be given not less than twenty (20) days before the
first public hearing on the proposed annexation-
And in the event any land within the territory proposed to
be annexed is owned. by a county, the said City Clark is directed
to cause written notice of suoh proposed annexation to be mailed
to the .Board of Supervisors of such county, such notice to be
given not less than twenty (20) days before the first public
hearing on the proposed annexation;
And, in the event there Is, upon the land proposed to be
annexed to said City, as structural improvement owned, being
acquired or leased by a county fire protection district, the
said Clerk is directed to cause written notice of such proposed
annexation to be mailed to the g overning body of such district,
such notice to be sent not leas than ten (10) days before the
first public hearing upon sucb.proposed annexation;
And the said City Clerk is directed to cause written
notice to be given to such other persons as may be leSally
entitled thereto, in the manner required by law.
The foregoing Resolution was introduced at A meeting of the
City Council of the City of Cupertino held on January 23. 1956.
