WHEREAS, the City Council desires to modify the salary and becrefit '
schedules for eligible persons under the Confidential Compensation
Ptogram; and
NOW, THEREFORE, BE IT RESOLVED that the Confidential Compensation ,
Program be amended as shown in Attachment "A" which is incorporated in
this resolution by this reference.

' PROGRMI PURPOSE AND ' •
DEFINITIUNS FOR ELIGIBILITY '
It is City of Cupertino policy that those certain persons holding positions
hereinafter defined and designated as confidential shall be eligible for partici-
pation under the Confidential Compensation Program as hereby adopted by action •
of the City Council and as same may be amended or as otherwise modified from ,
time to time.
It is the stated purpose of this Confidential Compensation Program to give
recognition to and to differentiate those eligible employees from repre~ented
employees who achieve economic gain and other conditions of employment through
negotiation. It is the intent that through this policy and those which are~
adopted or as may be modified or rescinded from time to time such recognition
may be given. ,
Eligibility for inclusion wi[hin this Confidential Compensation Program is
limited to persons holding positiona as confidential employees. These are as
designated by the Appointing Authority and may be modified as circumstances
~ warrant.
As defined under Section 2.52.290 of the Cupertino Pfunicipal Code, a con-
fidential employee is an employee who is privy to decisions of Ci[y management
affecting employer-employee rela[ions.
Although subjec[ to change in nccordance with provision of the Personnel

It is City of Cupertino policy that eligible persons under the Confiden-'
tial Compensation Program shall be compensated for services rendered to and .
on behalf of the City on the 6asis of equitability of pay for duties and
responsibilities assigned, meritorious service and comparability with aimilar
work in o[her public and private employment in the same labor marke[; all
of wnich is contingent upon the Ci[y's ability to pay consistent with,its
, fiacal policies.
As rates of pay and schedules of pay grades developed through meet
, and confer processes are subject to the underlying provisions of the Pay •
Plan for administration purposes so are those rates of pay and schedule of
' pay grades included herein as a part of this Confiden[ial Compensation
Program. The incluaion herein of said ra[es and schedules does not affec[
any effective dates or otheiwise reflect on the approval processes required
, but is shown as an integral part of this Program for completeness of record.

' AUTOMOBILE ALLOWANCES AND • ' ' '
' DIILEAGE REIMBURSIIlENTS
It is City of Cupertino policy that eligible persons under the Confidentiat
Compensation Program shall be compensated fairly for the uae of personal auto-
' motive vehicles on City business. In same instances the use of personal vehicles
is a condition of employment when there may be an abaence of sufficient ftty vehicles
for general transportation purposes. It is not intended, however, that such a
condition of employment should work an undue hardship. For this reason the
' following policies shall apply for automobile allowances and mileage reimburse-
ments. ~ ~
Those persons who occasionally~are required to use their personal auto- ,
mobiles for City buainess shall be reimbursed for such use at an appropriate
rate established by the City Council. Submission of a reimbursement requesC
must be approved by the department head.
' Those persons who are required to use their personal vehicles for City
business on a recurring and often basis shall, with the approval of the City
Manager, be reimbursed at the rate of fifty dollars ($50.00) per month for
' a given number of miles to be determined by a schedule adopted by the City
' Council and at the established rate per mile; provided, however, that a
' record of all mileage for the use of personal automobiles on City business
shall be filed as a prerequisite to any such reimbursement on forms provided.
' While recognition is given [hat similar or modified automobile allowance
' and mileage reimbursemen[ schedules may be applicable to employees not eli-
' gible under the Confidential Compensation Program, its inclusion as a policy
under said Program is for completeness of record.

COMPENSATORY TIME OFF
It is Ci[y of Cupertino policy that eligible persons under the Confiden-
tial Compensation Program shall be entitled to compensa[ory time off in ~
like amount for such time worked in excess of what o[herwise might be considered
as a normal workday or work week for other employees. Such "overtime" worked
or compensatory time taken off shall not be recorded for attendance or pay-
roll purposes. '
Individuals occupying conEidential posi~ions are employed to perform
specific functions. In many cases the fulfillment of a given Eunctio~ requires ,
effort without regard to regular working hours. Often Chese additional require-
ments are cyclical and provide later opportunities far some relief from the
ex[ended work efforts. At such times when i[ is possible to do so, it is ex-
pected that the affected person and his supervisor mutually will agree as Co
• when compensa[ory time off will be taken.
It is the stated purpose of this policy [o provide some periods of
time for eligible employees to relax and become disassociated from the stresses
of work and, in part, Co offer recognition for.the demands of required but
unrecorded "overtime".

FLEXIBLE HOLIDAYS ~ • ,
It is the policy of the City of Cupertino to recognize days of historical
and national significance as fiolidays of the City without loss of pay or '
benefits. Recagnizing the desirable continuance of municipal services by
; confidential employees resulting from acheduling of occasional
holidays at variable times [hroughout the year, i[ 1s the policy of the City
of Cupertino to provide days off in lieu of holidays for confidential '
employees at such times as are convenient for ~ach employee
! and supervisor, ahen such policy is compatible with the workload and achedule
of tiie City.
Employees occupying confidential positions shall be provided two days
per calendar year as a non-work day with full pay and benefits in addition
to those holldays set forth in Sec[ion 8.1 of the Rules on Conditions of Em-
ployment. For payroll purposes, each such in-lieu-of day off shall be re-
corded as a holiday.

LIFE AND LONG-TERM DISABILITY INSURANCE
It is the policy of the City of Cuper[ino to make available group '
insurance for Confidential employees that will mitigate the personal
and family financial hardships resulting from continuing disability that
prevents an employee from performing gainfully in his or her occupatlon.
It is further the policy of the City of Cupertino to provide life insurat~ce
. benefits five times the employee's annual salary to a maximum of $250,000.00,
for confidential employees.
Employees occupying Confidential positions may enroll in the disability ~
income program and the life insurance program offered if eligible under the
contract provisions of the policy and the personnel rules of the City. The
full cost of premiums for these insurances shall be paid by the City for

Procedural and Administrative Supplement to Policy No. 8 '
Personalized Compensation ,
The following procedural and adminiatrative rules and regulktions~are ~
those under which the program of personalized compensation wili be admin-
istered. In the event that further clarification is needed as to the intent
' of the program or that some modification is required in these rules and regulaj
tions such shall be as set forth in writing by either the Appointing Authority.

1. The payment or equivalen[ direct compensation for services
performed (allowance) under Policy No. 8 is effective with ,
[he month of July, 1980. For each succeeding month,
the referred to allowance will be credited to the account ~
of each eligible confidential employee on the first of each
month of assure proper disbursesnent as required during that ~
month.
2. Said monChly allowances will be disbursed on authorization
of the City's personnel office only after having received
from the e~ployee a written designation as to [he manner of
disbursemen[. Such written designations shall have the
approval of the City Manager and the Personnel Officer to
be valid.
3. Written designations as to the manner of disbursement of
allowances may be changed or modified from time to time;
providing, however, Chat a completely new designation shall
be prepared and filed whenever any change or modification is
made. This should not be more often than once each quarter.
4. All written designations shall be on forms provided by the
. peraonnel office for that purpose.
S. Allowances, whether in whole~amounts or unused porcions, may
be accumulated from month [o month but will be disbursed as
a direct cash payment upon request and automatically during
the month of December so as to clear all such credits prior to
the end of the calendar year.
6. Direct cash payments will be subject to normal payroll vlth- .
holdings. For other than direct cash payments, any question
of tax liability is a mat[er between the enployee and the ,
appropriace agency.

7. The accounting for a11 records [o be main[ained under [his

9• All disbursements made under this Policy No. g shall be to the
employee or to a designated third party pursuant to a City ,
sponsored program. Eligibility for direct cash payments to
[hird party entities is contingent upon submission by the e~n- ~
ployee of docianentary evidence to suba[an[iate acceptability
for City sponsorship; i.e. a doctors certificate prescribing .
membership in a health maintenance facility, course identifi-
cation and tuition cost for furtherance of educational achieve-
ment, etc.

11. Requests by confidential employees for new programs under this
Policy or for modifica[ion to exis[ing programs shall be sub-
mitted in writing to the Personnel Officer who with the City
Manager and vith such other assis[ance as they may deem appro-
priace will evaluate the requests for acceptability under
standards for City sponsorship. These standards shall include
but may not be limi[ed to the following:
a. Availability for participa[ion by all confiden-
tial employees on a voluntary basis.
b. eeneficiality to the health, education or
welfare of the employee and results of vhich
will have a probability of having an affiima-
tive effec[ on vork performance.
c. Costs of administration and processing being
compatible with those of other eimilar typea ~
of approved programs. ~
12. The City reserves the right ~oilaterally to make disbursements ~n
direct cash payment to the employee vhen written designationa are~
rejected as being unacceptable, failure of the employee to make '
a timely designation, cancellation of program previously ~nder ~ ~
City sponsorship or for other good and sufficient reasons. '

DEFERRED CON3ENSATION ~
It is the policy of the City of Cupertino to pravide equitable curren[
compensation and reasunable retirement security for confidential
employees for services performed for [he City. The City partici- '
pates in S[ate and Federal retirement systems and deferred compensation •
plans have been eatablished. Both the employee and employer may make con-
tributions from current earnings to these plans. The purpose of this policy
is to promote means by which compensation may be provided in such manner and
form [o best meet the requirements of the City and the needs of individual
employees, thereby increasing the ability [o attract and retain~competen[
confidential employees. ,
The City shall maintain and administer means by which employees in conPi- '
dential positions may 3efer portions of their current earnings
for future utilization. Usage of such plans shall be subjec[ to such agree-
ments, rules and procedures as are necessary Co properly administer each plan. -
Employee contributions [o such plans may be made in such amounts as felt proper

~ It is the policy of the City of Cupertino to provide dental.insurahce '
under which employees in Confidential positions and their dependents may
be covered. The purpose of this program is to promote and praserve the
health of employees. •
The premium cost for the insurance provided by the City shall not ~
exceed $35.50 Per month per employee. Enrollment in the plan or plans
made available pursuant to this policy shall be in accordance with
Personnel Rules of the City and the provisions of the contract for such
insurance between the City and carrier or carriers. ~
