RESOLUTION N0. 6338
A RESOLUTIOV OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
DECLARING ITS INTENTION TO ORDER VACATION OF A PORTION OF
BOLLINCER ROAD LOCATED AT THE NORTHEAST CORNER OF BOLLINGER
ROAD AND DE ANZA BOULEVARD, RETAINING IT AS A PUBLIC UYILITY
EASEMENT AS PROVIDED IN SECTION 8320 ET SEQ. OE THE STREETS AND
NIGHWAYS CODE OF TNE STATE OF CALIFORNIA, FIXINC TIME AND
PLACE FOR PUBLIC HEARINC AYD PROVIDING FOR NOTICE THEREOF
WHEREAS, tha[ portion of a City street known as 9ollinger Road and more
particularly described in description and map attached hereto and made part
hereof as Exhibits "A" and "e", reapec[ively, is unnecessary for preeent or
proapec[ive public atreet purpoaea; and
WHEREAS, it wi11 be retai~ed as a public utility easement; and
WNEREAS, the City Council elects to proceed pureuant to the proviaiona of
Section 8320 et aeq. of the Streets and Highways Code of the 5tate of
California; and
WHEREAS, it ie deemed to be in the public interesta [hat the City Council
elects to proceed to order said vaca[ion;
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby declarea ita ,
intention to vacete the aforesaid portion of City s[reet.
BE IT FURTIIER RESOLVED:
1. That the 18th day of June, t984 at 6:45 p.m., in [he Council Chamber,
City Hall. l0300 Torre Avenue, Cupertino, California ie the time and place
fixed for hearing on the above propoaed vacation;
2. That [he aforesaid date is not lese than 15 days from paseage of thia
resolution pureuant to law;
3. That the City Clerk shall cause a cer[ified copy of this reeolution to
be p~bliehed in the manner preacribed by law, and ehall cauee certified copiea
to be posted along the line of aaid proper[y proposed to be vacated at leaet 10
daye Defore the date of hearing and no more than ~00 feet apart vith a minimum
of 3 being Poated.
