PROMETfiEUS DEVELOP1Et~T CO,; AUTHOflIZING EXECUTION OF IMPHOVEt1ENT AGREEHENTS; AU'fHORIZItIG SIGNItIG OF PARCEL hiAP AtID IIiPROVEHEt~T PLAGS WNEREAS, there has been presented Lo the C1ty Council for ' approval of the parcel map and improvement plans of property located at the southwest corner of Stevens Creek Boulevard and Torre Avenue by Prometheus Development Co.; and WIIEHEAS~ there has been presented to the City Council a proposed standard agreement and a deferred agreement for the construction of streets, curbs, and eutters. and for other improvements. and Eood and sutficient bonds (letter of credit), fees, and deposits as set forth in Exhibit "A" having been presented for the faithful performanee of said Work and the carrying o~t of said agreements, And said map. agreements, and bonds having been approved by the City Attorney; YOW, Tt1EflEFORE !3E IT RESOLVED THAT a. :;aid parcel map and improvement plans herein referred to are hereby approved. b. The offer of dedication for street areas and all easements is hereby accepted. c. 7'he City E~gineer is hereby authorized to si~n said improvement plans. d. '[7~e City Engineer and the City Clerk are hereby authorized to sign said pa~cel map and have it recorded. e. The t~ayor and the City Clerk are hereby authorized t~ execute a standard street improvement agreement between the City and Cupertino City Center Associates 8, a California Limited Partnership. f. The t'ayor and the City Clerk are hereby authorized to execute a deferred street improvement agreement betaeen the City and Cupertino City Center Associates A, a California Limited Partnership; Cupertino City Center Associates C, a California Lir~ited Partnership; and Cupertino City Center Associates D~ a California Limited Partnership. g. The deferred agrecment shall be recorded with the County Recorder.
