BETWEEtI CUPEHTINO AND THE COUNTY OF SANTA CLANA AND WITHDRANAL

DISTRICT flEORGANIZATION ACT OF 1965 WITHOUT A PUBLIC HEARING

OF IMPERIAL AVENUE
~ WHEREAS, pursuant to provisions of the District Reorganization Act o}'
1965~ a petition for reorganization was filed with the L.ocal Agency
Formation Commiaalon involving:
a) Annexation of unincorporated area in the County of Santa Clara to
the City of Cupertino;
b) Withdraual from the County Lighting Service Area.
WHEflEAS. the Santa Clara County Local Agency Formation Commission, by
Resolution t~o. 84-3 adopted the 8th day of February, 1984, has authorized
the City of Cupertino to annex thls uninhabited terrltory designated
"Lomita 84-2" and described in Exhibit "A" without notice~ hearing or
election in accordance with Section 56439.5 of the Government Code; and
WHEREAS, annexation has no environmental impact on the area; and
WHEREAS, the Clty Council finds that it i~ to the best interest of the
City and of the territory proposed to be annexed that the territory be
annexed without public hearing; and
NON, TIIEREFORE~ BE IT RESOLVED that the territory de~cribed in Exhibit
"A"~ attached hereto and made part hereof. is hereby annexed to the City
of Cupertino and ?+ithdrawn from the County Lighting Service area.
PASSED AND ADOPTED at a regular meeting of the City Council of Lhe
City of Cupertino on this 27thday of February, 1984 by the follor+ing vote:

Califor~ia, more particularly described as follows:
Beginning at a point on [he northerly boundary of Lot B in Block 8, as shown on
the "Reaubdivision of subdivision No. 1, Town of Monta Vista", which map was
filed for record in [he office of the Coun[y Recorder, County of Santa Clara,
State of California on F[ay 11, 1917 in Eiook P of ltaps, a[ page 24, said point
being 30 feet westerly of the easterly lot line of said Parcel B;
Thence East, 100.00 feet along the boundary of that certain annexation to the
City of Cupertino entitled "Cuva 72-4";
Thence Sou[h, 96.00 feet;
Thence West, L00.00 feet;
Thence North, 96.00 feet along tha boundary of said annexation "Cuva 72-4" to
the Poin[ of Beginning.
