CC Resolution No. 62060 0 RESOLUTION NO. 6206 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO IN SUPPORT OF RELICENSING OF HYDROELECTRIC PROJECTS TO THE PACIFIC GAS AND ELECTRIC COMPANY WHEREAS, certain hydroelectric facilities consisting of projects licensed by the Federal Power Commission, now known as the Federal Energy Regulatory Commission (FERC), are subject to consideration for relicense by FERC; and WHEREAS, efforts are being made by certain municipal entities to secure for themselves many hydroelectric power plants through applications to FERC. Efforts which if successful would transfer ownership and operation of these hydroelectric facilities away from the current supplier of electrical power to Cupertino, PG &E, and would thus divert this low cost power from Cupertino custo- mers; and WHEREAS, this increased cost impact would detrimentally effect the local Cupertino economy by substantially raising industrial, commercial, and residen- tial electrical rates; and WHEREAS, PG &E initially developed these resources at their risk, acquiring know- ledge and experience taking many years to establish and has continued to improve these facilities to the advantage of their customers; and WHEREAS, PG &E is regulated through a legally appointed Government agency, the Public Utility Commission (PUC) whose charter is to mediate customers interests and the interests of investor owned utilities for the good of both; NOW, THEREFORE, BE IT RESOLVED that the City of Cupertino hereby urges and request that the Federal Energy Regulatory Commission promptly relicense the following hydroelectric facilities: 1. Mokelumne River Project (Project No. 137); and 2. Rock Creek - Cresta Project (Project No. 1962); and 3. Phoenix Project (Project No. 1061); and 4. Haas - Kings Project (Project No. 19881); and; All future hydroelectric relicense requests for projects initially developed by PG &E; and reject the applications of the municipally -run utilities seeking to divert these projects away from PG &E and its Cupertino customers. BE IT FURTHER RESOLVED that the City of Cupertino hereby requests that all hear- ings concerning Pacific Gas & Electric Company's hydro relicensing applications be conducted in the service territory of the Pacific Gas & Electric Company where the projects are located and where the public they serve live and work. BE IT FURTHER RESOLVED, that copies of this resolution be provided to: Mr. Kenneth F. Plumb, Secretary Federal Energy Regulatory Commission 825 North Capitol Street, N.E.
