CC Resolution No. 6147• RESOLUTION HO. 6147 A RESOLUTION or THE CITY COUNCIL OF THE CITY OF CUPERTINO RELATED TO THE USE OF 4R INTERSTATE FUNDS FOR STATE ROUTE 17 WHEREAS, State Route 17, the Nimitz Freeway, is a vital element of the transportation system on the easterly side of the San Francisco Bay; and WHEREAS, said Freeway serves as the major highway access for the delivery of goods to and from the U. S. Coast Guard Facility on Government Island, U. S. Naval Air Station at Alameda, the Naval Supply Center -Alameda Facility, the Naval Supply Center -Oakland Facility, the Oakland Army Base and the Port of Oakland; and WHEREAS, access to the above named facilities is vital to the national defense; and WHEREAS, that portion of State Route 17 from I-80 near the San Francisco Bay Bridge to I-80 in San Jose has been included in the Interstate System as a nonchargeable route under Sec. 139(a) Title 12 U. S. Code; and WHEREAS, State Route 17 is in serious need of resurfacing, restoring, rehabilitating and reconstructing; and WHEREAS, states cannot now use new construction or 4R (repair) Interstate funds on nonchargeable Interstate segments; and WtiEREAS, California has 90 miles of nonchargeable Interstate highways; and 'r;HF.REAS, there are at least 374 miles of nonchargeable Interstate miles of roadway in seventeen states which would benefit from being eligible for use of Interstate 4R (repair) funds; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino hereby urges the Congress of the United States to adont legislation whereby Interstate highway mileage designated under Section 139(a), Title 23, U. S. Code, would qualify for IR (resurfacing, restoring, rehabilitating and reconstructing) funds. BE IT FURTHER RESOLVED that this City Council does and it hereby urges the members of Congress representing California to introduce and support legislation to qualify nonchargeable Interstate mileage for use of 4R (repair) Interstate funds. BE IT FURTHER RESOLVED that this City Council does and it hereby urges the California Department of Transportation, the Metropolitan Transportation Commission, and the Counties of Alameda and Santa Clara to encourage and support efforts and to take such other actions as may be necessary to achieve legislation whereby Interstate highway mileage designated under Section 139(a), Title 23, U. S. Code, will 0 • qualify for IR funds. BE IT [FURTHER RESOLVED that the City Clerk be and is hereby directed to forward copies of this resolution to the California members of Congress, California Department of Transportation, the ttetropolitan Transportation Commission, County of Alameda, the County of Santa Clara, the Cities of San Jose, Milpitas, Newark, Union City, San Leandro, Fremont and Oakland, and such other offices and agencies which may be interested.
