CITY OF CUPERTINO CERTIFYING CFiE FINAL ENVIRONMENTAL IMPACT REPORT FOR A GENERAL PLAN AIIENDMF.NT AS TO ITS COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND SPATE AND LOCALLY ADOPTED GUIDELINES WHEREAS, at a public hearing held this date the City Council has reviewed and considered the contents on the final Environmental Impact Report as a part of the decision making process concerning the proposed general plan amendment and WHEREAS, upon conclusion of said review, the Council has found the final Environmental Impact Report to be in complete compliance with the California Environmental Quality Act and State and locally adopted guidelines for the implementation of said Act. WHEREAS, the significant environmental effects of the project identified in the Environmental Impact Report have been mitigated by the following General Plan policies. SIGNIFLCANT EFFECT MITIGATION MEASURES A. Increased Evening Activity Policy 6c (1) discourages late B. Employment growth relative to housing C. Traffic Impacts evening activities on properties which are in close proximity to residential areas. Policy 6 a regulates land use intensity commensurate with the carry capacity of the City's surface street system. - 1 - Resolution No. 6137 (continued) • Traffic Impacts (continued) Fiscal Impact and Community Services Policies 7-13 establish standards for acceptable levels of traffic on various street types; establishes the need for traffic management plans to protect residential neighborhoods from through traffic, and facilitates the installation of mass transit and "para" transit systems. policies 14 and 15 will ensure that new development will not overburden public services, particularly fire and police. Policy 18 establishes guidelines for th,- acquisition of park land and Policy 19 establishes a system to monitor the long term fiscal impact associated with various forms of development. WHEREAS, the following significant environmental effect of the project identified in the Environmental Impact Report cannot be mitigated, a statement of overriding considerations based upon information of record and the Final Environmental Impact Report are set forth below: SIGNIFICANT EFFECT A Conversion of Agricultural Land OVERRIDING C014SIDERATION The eventual development of the community based upon either the Existing or Proposed General Plan, will result in the conversim of approximatrely 225 acres of agriculture. land to urban uses. A recently prepared EIR assessed the viability of continued agricultural land use on a 140 acre parcel on the City's urban fringe. Th,� report indicated that continued agricullm use on said parcel was not economically viable. Since said parcel is the largest agricultural holding in the City, it Is highly unlikely that remaining small infill parcels with present agriculturaL uses can remain indefinitely. (Refer to the Seven Springs Ranch Development Environmental impact Report for a detailed discussion of the viability of agricultural activities in the City). NOW, 11IEREFORE, It is hereby found, determined and ordered that the City Council of the City of Cupertino, as responsible agency, has considered said Environmental Impact Report and hereby certifies that It has reviewed and considered the information contained therein and that the Environmental Impact Report has been completed in compliance with the CEQA and State Guidelines. City Council finds further that alterations have been incorporated into the project which mitigate or avoid each significant environmental Lnpact identified in the Environmental Impact Report to an acceptable level as defined in Section 8.7 of the. - 2 - Resolution No. 6137 •mtintie (1) • i Cupertino Environmental Cuidelfnes.
