CC Resolution No. 6116N RESOLUTION NO. 6116 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO ADOPTING PLAN FOR PURCHASE OF SURPLUS SCHOOL PROPERTY FOR PARK PURPOSES AND MAKING NECESSARY FINDINGS WITH RESPECT THERETO I WHEREAS, the City Council of the City of Cupertino is concerned that school playgrounds, play fields, recreation real property will be lost even where those communities in their planning process have assumed that such property would be permanently available for recreation purposes; and WHEREAS, the Cupertino Union School District has designated four school sites within the City of Cupertino as surplus school sites; and WHEREAS, the Cupertino Union School District has offered for sale to the City of Cupertino two of said school sites; and WHEREAS, pursuant to Section 36397.5 of the Education Code no public agency may purchase school site property unless it has first adopted a plan for the purchase of school site property; and WHEREAS, the City Council of the City of Cupertino has heard evidence both written and oral concerning said surplus school sites. NOW THEREFORE, BE IT RESOLVED as follows: 1. That the plan for the purchase of said school site property as described in Exhibit "A" and "B", hereto attached is hereby adopted. 2. That with respect to the Hoover and Jollyman school sites which the Cupertino Union School District has offered for sale that the public lands in the vicinity of said school sites are inadequate to meet the existing and foreseeable needs of the community for playground, play field or other outdoor recreational and open space purposes.
