CITY OF CUPERTINO MAKING ITS ORDER DESCRIBING THE BOUNDARIES OF THE REORGANI- ZATION DESIGNATED "SEVEN SPRINGS 80-17" TO BE ANNEXED TO THE CITY, AND A PORTION THEREOF TO BE ALSO ANNEXED TO THE CUPERTINO SANITARY DISTRICT, AND ORDERING ANNEXATION TO THE CITY APPROXIMATELY 155 ACRES GENERALLY BOUNDED BY RAINBOW DRIVE. TO THE NORTH, STELLING ROAD TO THE EAST, PROSPECT ROAD TO THE SOUTH, AND BY THE FREMONT OLDER OPEN SPACE PRESERVE AND UPLAND WAY TO THE WEST. WHERF.AS,a petition for annexation was filed in the County of Santa Clara for certain uninhabited territory situate in the County of Santa Clara, State of California hereby designated as "Seven Springs 80-17"; and WHEREAS, the Santa Clara County Local Agency Formation Commission, by Resolution No. 83-12 adopted the lath day of April, 1983, has authorized the City of Cupertino to annex the territory described in Exhibit "A" (Annexation to the City of Cupertino) without notice, hearing or election in accordance with Section 56439.5 of the Government Code, and the territory described in Exhibit "A" (Annexation to Cupertino Sanitary District) to be annexed to the Cupertino Sanitary District without notice, hearing or election in accordance with Section 56439.5 of the Government Code; NOW, THEREFORE, BE IT RESOLVED that the territy described in both Exhibits "A" , attached hereto and made part hereof, are hereby annexed to the City of Cupertino and the Cupertino Sanitary District, respectively. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cupertino this 20th day of April 1983 by the following vote: Vote Members of the Citv Coun cil AYES: Johnson, Plungy, Rogers, Sparks, Gatto NOES: None ABSENT: None ANSTAIN: None APPROVED: ATTEST: �Vciei of Cu tino Z—) City Clerk EXHIBIT "A" Annexation to City of Cupertino Name of Annexation: SEVEN SPRINGS 80-17 Date All of that certain territory situate in the County of Santa Clara, State of California, described as follows: BEGINNING in a City limit of the City of Cupertino at the Intersection of the centerline of Rainbow Drive and Bubb Road as shown on the ,flap for Tract No. 3281 recorded in Book 155 of Maps at pages 28 and 29, Santa Clara County Records, and also as shown on the certain Record of Survey filed in Book 342 of Maps at pages 34 through 37, inclusive, Santa Clara County Records, said intersection being a Southwesterly corner of that certain 1.04 square mile annexation to the City of Cupertino entitled, "San Jose/Cupertino Municipal Reorganization" described and adopted under Cupertino Ordinance No. 924. (1) Thence from said point of beginning along the City limit line described in said annexation and along the Easterly prolongations thereof, being said centerline of Rainbow Drive as shown on said Tract and Record of Survey, North 890 27' 42" East 2087.22 to the intersection of said centerline with the Northeasterly Right -of -Way line of Southern Pacific Railroad Company mentioned in said annexation. (2) Thence along said Northeasterly Right -of -Way line as shown on said Record of Survey which is coincidental with portions of the City limit lines described in said annexation South 190 25' 47 East 1004.73 feet to the Northwest corner of that certain 1.530 acre parcel shown on said Record of.Survey.
