A RESOLUTION OF THE CITY COUNCII. OF THE'. CITY OF CUPERTINO
MAKING ITS ORDER DESCRIBING THE BOUNDARIES OF THE REORGANI-
ZATION DESIGNATED "SEVEN SPRINGS 80-17" TO BE ANNEXED TO
THE CITY, AND A PORTION THEREOF TO BE ALSO ANNEXED TO THE
CUPERTINO SANITARY DISTRICT, AND ORDERING ANNEXATION TO
THE CITY APPROXIMATELY 155 ACRES GENERALLY BOUNDED BY
RAINBOW DRIVE. TO THE NORTH, STELLING ROAD TO THE EAST,
PROSPECT ROAD TO THE SOUTH, AND BY THE FREMONT OLDER
OPEN SPACE PRESERVE AND UPLAND WAY TO THE WEST.
WHERF.AS,a petition for annexation was filed in the County of Santa
Clara for certain uninhabited territory situate in the County of Santa Clara,
State of California hereby designated as "Seven Springs 80-17"; and
WHEREAS, the Santa Clara County Local Agency Formation Commission, by
Resolution No. 83-12 adopted the lath day of April, 1983, has authorized the
City of Cupertino to annex the territory described in Exhibit "A" (Annexation
to the City of Cupertino) without notice, hearing or election in accordance with
Section 56439.5 of the Government Code, and the territory described in
Exhibit "A" (Annexation to Cupertino Sanitary District) to be annexed to the
Cupertino Sanitary District without notice, hearing or election in accordance
with Section 56439.5 of the Government Code;
NOW, THEREFORE, BE IT RESOLVED that the territy described in both
Exhibits "A" , attached hereto and made part hereof, are hereby annexed to the
City of Cupertino and the Cupertino Sanitary District, respectively.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 20th day of April 1983 by the following

EXHIBIT "A"
Annexation to City of Cupertino
Name of Annexation: SEVEN SPRINGS 80-17
Date
All of that certain territory situate in the County of Santa Clara, State of California,
described as follows:
BEGINNING in a City limit of the City of Cupertino at the Intersection of the centerline
of Rainbow Drive and Bubb Road as shown on the ,flap for Tract No. 3281 recorded in
Book 155 of Maps at pages 28 and 29, Santa Clara County Records, and also as shown
on the certain Record of Survey filed in Book 342 of Maps at pages 34 through 37, inclusive,
Santa Clara County Records, said intersection being a Southwesterly corner of that
certain 1.04 square mile annexation to the City of Cupertino entitled, "San Jose/Cupertino
Municipal Reorganization" described and adopted under Cupertino Ordinance No. 924.
(1) Thence from said point of beginning along the City limit line described in said annexation
and along the Easterly prolongations thereof, being said centerline of Rainbow Drive
as shown on said Tract and Record of Survey, North 890 27' 42" East 2087.22 to the
intersection of said centerline with the Northeasterly Right -of -Way line of Southern
Pacific Railroad Company mentioned in said annexation.
(2) Thence along said Northeasterly Right -of -Way line as shown on said Record of Survey
which is coincidental with portions of the City limit lines described in said annexation
South 190 25' 47 East 1004.73 feet to the Northwest corner of that certain 1.530 acre
parcel shown on said Record of.Survey.
(3) Thence along the Northerly line of said 1.530 acre parcel North 890 27' 42" East 214.56
feet to a Westerly line of said annexation in the centerline of 5telling Road in the section
line between Sections 25 and 26 in T.7S., R.2W., M.D.B. do M.
(4) Thence along said Westerly City limit line along said Section line (being the original
centerline of Stelling Road before realignment) as shown on said Record of Survey, South
000 21' 18" East 681.95 feet to a corner of said annexation in the Westerly prolongation
of the Northerly line of Tract No. 4254, the map for which last named Tract was recorded
in Book 222 of Maps at page 15, Santa Clara County Records.
(5) Thence along a Southerly City limit line established under said annexation along said
Westerly prolonged line, North 890 25' 12" East 20.98 feet to the Northwesterly corner
Of said Tract No. 4254 in a Southwesterly City limit line of the City of Cupertino described
under said Ordinance No. 924 in said Northeasterly Right-of-way of Southern Pacific
Railroad Company.

(6) Thence along said last named City limit line being said Northeasterly Right -
of -Way line and the Southwesterly line of said Tract No. 4254 as shown on
said Record of Survey, South 190 25' 47" Fast 456.86 feet to an angle therein.
(7) Thence continuing along said last named City limit line, Right -of -Way line
and Southwesterly line of Tract No. 4254 as shown on said Record of Su_*vey,
South 190 50' 21" East 150.00 feet.
(8) Thence continuing along said last named City limit line and Right -of -Way Lir e,
as shown on said Record of Survey, Southeasterly along an arc of a curve to
the left from a tangent which bears South 200 33' 17" East with a radius of 3779.83 feet, through a central angle of 070 07' 42", an arc distance o

City of Saratoga as established by Incorporation on October 22, 1956, in an
Original' Southerly line of Prospect Road as shown on that certain Record of
Survey filed in Book 348 of Nips at page 52, Santa Clara County Records.
(10) Thence along said corporate city limit line of the City of Saratoga being
said Southerly line Of Prospect Road, as sho•.,m and/or derived from said last
named Record of Survey, North 860 02' 33" West 421.37 feet to an angle in the
Southerly line of said Prospect F%ad (formerly Farr Road 40 feet wide), as
established in the Deed to the County of Santa Clara recorded Nay,27, 1924,
in Book 92 of Official Records, page 76, Santa Clara County Recara .
Thence continuing along the original Northerly corporate city limits of the
City of Saratoga being the general Southerly lines of Prospect Foad as
established in said Deed (the centerline of ctdch Road is shown on the r4ap
for Tract No. 3974 hereinafter referred to) the five following courses and
distances:

17) Thence along the most Northerly line of said Saratoga No. 64-1 annexation as
shown on said Map for Tract No. 3974, being the Northerly line of said Lot 3
also being said : section line as shown on said Record of Survey filed in
Book 342 of Maps at page 34, et seg., South 890 27' 15" West 990.89 feet to a
Northwesterly corner -of said Saratoga No. 64-1 annexation at the Northeasterly
corner of that certain parcel of land conveyed to J. C. Bothin by deed
recorded in Book 350 of Deeds, page 13, Santa Clara County Records at a North-
westerly corner of said Tract No. 3974.
_E) Thence leaving said Northerly line of Lot 3 and said : section line along a
Southwesterly City limit line of said Saratoga M. 64-1 annexation being the
Northeasterly line of sai(a parcel conveyed to Bothin and also a Southwesterly
line of Tract No. 3974, South 140 27' 26" East 108.90 feet to an angle in the
general Northwesterly line of said Saratoga No. 64-1 annexation at the South-
easterly corner of said parcel conveyed to Bod-dn.

annexation, being the Southeasterly line of said parcel conveyed td Bothin and

469.41 feet to the most Westerly corner of said Saratoga M. 64-1 annexation

tion of said Nbrtheesterly line of Tract No. 3974, South 740 43' 40" West
190.59 feet, more or less, to an angle in the general Southeasterly lire of
that certain 411.315 acre parcel of lam shvnn on said Record of Survey filed
in Book 342 of Maps at page 34, et seq., said last named angle being a South-
easterly corner of that certain parcel of land described as Parcel No. 16 in
the deed to midpeninsula Regional Park District recorded September 24, 1975,
in Book B627 of official Records, page 730, et seq., Santa Clara County
Records.

_2) Thence along the Easterly line of said Parcel "B" and along the Easterly line of Upland
Way shown on the Map for Tract No. 492 filed for record in Book 18 of Maps at pages
4 and 5, Santa Clara County Records, as said last named lines are shown on said Record
of Survey filed in Book 342 of Maps at page 34, et seq., North 000 41' 45" West 1298.23
feet to the point of beginning containing 154.97 acres of land more or less.
All bearing and distances in the hereinabove described 154.97 acre territory are based
on or are derived from said Record of Survey filed in Book 342 of Maps at pages 34 through
37, inclusive, Santa Clara County Records.

BEGINNING at the Northeasterly corner of that certain annexation to Cupertino
Sanitary District entitled "Prospect No. 1" adopted under Resolution No. 103 by said
District and approved by the Board of Supervisors of the County of Santa Clara by
Resolution dated February 27, 1961; said corner being at the intersection of the
original Northerly line of Prospect Road (40.00 feet wide) with the Southwesterly line
of the right-of-way for the lands of Southern Pacific Company as shown upon that
certain Record of Survey filed in Book 348 of Maps at page 52, Santa Clara County
Records;
thence from said point of beginning along the Northerly boundary lines of said
annexation being the Northerly lines of said Prospect Road, the five following courses
and distances:
(1) North 860 0213311 West 307.25 feet,
(2) South 830 09' 10" West 301.92 feet,
(3) South 890 27' 15" West 147.93 feet,
(4) North 850 3013011 West 113.90 feet,

(8) thence continuin& along said last named boundary along a Southwesterly line of said
