CC Resolution No. 60140 RESOLUTION NO. 6014 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO ORDERING VACATION OF A PUBLIC UTILITY EASEMENT SOUTHEAST OF THE CUPERTINO ROAD/FOOTHILL BOULEVARD INTERSECTION PURSUANT TO SECTION 50430 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA WHEREAS, hearing on Resolution of Intention No.5993 was held on January 3, 1983, at a regular meeting of the City Council at 10300 Torre Avenue, Cupertino, California; and WHEREAS, it appears that notice thereof was duly given as required by law; and WHEREAS, from the evidence presented, both oral and documentary, it appears to be to the best interest of the City to vacate the hereinafter described portion of public utility easement; that said portion of said easement is unnecessary for present or prospective public purposes; NOW, THEREFORE, BE IT RESOLVED: 1. That all or any protests against the vacation of said portion of public utility easement be and hereby are overruled and denied; 2. That the certain portion of public utility easement described and shown in Exhibits "A" and "B" attached hereto and made part hereof, be and hereby is vacated. BE IT FURTHER RESOLVED: That the City Clerk be and hereby is instructed and directed to cause a certified copy of this resolution, attested to and sealed with the official seal of the City, to be recorded with the County Recorder of the County of Santa Clara, California, forthwith. Thence 75.00', N 89° 53' Id along said Cupertino Road; Thence, S 0° 07' W, 30.' to the southerly right-of-way line'of said Cupertino Road; Said point being the True Point of Beginning. Thence, S 0° 07' W, along a prolongation of the said aforementioned line to a line which is parallel and distant, measured at right angles, 10' from the centerline of Palo Vista Road as said road is shown on that certain map entitled "Map of Inspiration Point, Monts, Vista" filed in Book P of Maps on Page 18; Said aforementioned line is the southwesterly boundary of the area described herein; Thence, southeast, more or less, along said parallel line to a line which is per- pendicular to the said centerline and which is originated at the intersection of the southerly prolongation of the easterly line of Lot 20 of said map, and northerly boundary of said Palo Vista Road.
