RESOLUTION NO. 6011
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
INITIATING PRELIMINARY PROCEDURES FOR REORGANIZATION BE-
TWEEN CUPERTINO AND SAN JOSE IN ACCORDANCE WITH THE DIS-
TRICT REORGANIZATION ACT OF 1965
Application for the reorganization of territory involving:
a) Detachment from the City of San Jose, located in County of Santa
Clara
b) Annexation to the City of Cupertino, located in County of Santa
Clara
c) Annexation to the Central Fire District of .2s acre designated
as "Stern Avenue 82-1"
To the Local Agency Formation Commission of the County of Santa Clara:
The City Council of the City of Cupertino does hereby apply for change
of Urban Service Area and reorganization for a certain portion of Stevens
Creek Boulevard as follows:
a) This proposal is made pursuant to the District Reorganization
Act of 1954, commencing with Section 56000, Government Code.
b) The nature of the proposed reorganization and the names of all
districts (and cities) for which any such reorganization is proposed are
as follows:
1. Detachment: City of San Jose
2. Annexation : City of Cupertino
3. Annexation: Central Fire District
c) No new districts will be formed.
d) The territory proposed for the reorganization is uninhabited.
A description of the boundaries of the territory is more particularly
Jescribed in Exhibit "A" attached hereto and made a part hereof and shown
in Exhibit "B" attached hereto and made a part hereof.
e) The reason for this proposal is to enable the annexation of
a certain portion of real property previously prezoned by Cupertino whose
owners are petitioning to annex to said City.
f) It is desired that the proposed reorganization provide for and
be made subject to the following conditions:
' That LAFCO designate the City of Cupertino as the conducting agency
for this reorganization pursuant to Section 56271.1 of the
Government Code.
g) Terms and conditions as authorized by Section 56470 of the Government
Code be considered by LAFCO as said terms and conditions.
h) Boundary agreements between the two cities be modified as required.
i) It is hereby requested that proceedings be taken for the reorganiza-
tion herein proposed.
The City Council of the City of Cupertino finds the proposed reorganiza-
tion is consistent with the General Plan and has no significant environmental
impacts.

Ali that certain real property situate in the City of San Jose, Couaty of Santa
CLara, State of California, more particularly described as follows:
Eaginning at the intersection of the northerly "colon-ation of the •rester rly '
line of Tract No. 1164, which eat was recorded in the Office of the Couaty
Recorder, County of Santa Clara, in Book 42 a'• Naps, at Pa;e 22, vita the
centerline of Stevens Creek Boulevard, as it formerly existed, 90 fact aide,
