r A RESOLU'CION OF THE CITY OF CUPERTINO AFFIRPIING ITS POSITION
~ OF THE URGENT NEED FOR ACQUISITION OF REMAINING RIC{iT-OF-WAY
IN THE STATE HICf1WAY ROUTE 85 TRANSPORTATION CORRIDOR AND
FOR EARLY COlIPLETLON OF TRANSPORTATION FACILITIES FOR TNE
ENTLRE CORRIDOR
WHEREAS, State Highway Route 85 be[ween U.S. 101 near Floun[ain View and
tlonterey Road ~Rou[e 101) in South San Jose was planned in the 1950's [o serve
the highvay transporta[ion needa of [he West Valley Corridor area of Santa
Clara County; and
WHEREAS, the City of Cupertino is an integral part of the Route 85 corridor;
and
WfiEREAS, during the 1960's, planning nnd developmen[ in [he corridor areas of
[he cities of San Joae, Cupertino, Los Gatos, Mon[e Sereno, Campbell and Saratoga
aas predicated on the assump[ion that planned Route 85 would 6e completed as a
major link in the atreet and transportation network of Santa Clara County; and
WHEREAS, on March 3, 1961 a bond election was passed in Santa Clara County
to finance a network of regional roads and highways for San[a Clara County, and a
number of land parcels in the Route 85 corridor were purchased wi[h these local
funda and turned over to [he Sta[e for in[egration into the Sta[e Highway System;
and
WHEREAS, a portion of State Nighway Route 85 was cons[ructed in the mid-1960's
as a freeway extending from U.S. 101 near Stierlin Road in Mountain View to
Stevens Creek Soulevard in Cupertino; and
WHEREAS, cons[ruction was temporarily terminated at S[evens Creek Boulevard
in such a manner [o expect continuation; and
WHEREAS, failure to ex[end a transportation facility within the West Valley
Traneportation Corridor beyond Stevena Creek Boulevard has had a substantial
negative impact on the transpor[ation capacity and efficiency of the region and
an in[olerable nega[ive impact on [he City of Cuper[ino [hrough [raffic congestion,
noise and sir pollution, traasporta[ion time delay, suppression of deairable and
orderly grovth and development and severe detrimental impact on reaidential
streets and neighborhoode; und
WHEREAS, i[ ls essential to protect and acquire the neceasary right-of-way
to allow construc[ion of needed traneportation facility; and
WHEREAS, the City of Cupertino and ite Council has been hiatorically active
in favor of completion of a tranaporta[ion facility within the Route 85 corridor;
NOW, THEREFORE, BE IT RESOLVED by the City Council o[ the City of Cuper[ino
•[hat the State of California ahould insure complete protection of the Route 85
corridor right-of-way includtng prohibition of development, purchase of endangered
parcels and budgeting appropciate funding to acttvely puraue complete acquisition.

~ BE IT FURTNER RESQLVED that the City of Cupertino in recognition oE the County-
wide benefit of a transportation facility within Route 85 is willing to participate
in a regional effort [o determine the moat mutually agreeable and appropriate
facili[y to be placed within [he corridor.
FURTHER, that if after a reasonable regional effort a mutualiy acceptable
solution is no[ developed, then the Ci[y of Cuper[ino shall independently continue
to pursue the construciton of a facility within the City of Cupertino which in its
sole judgmen[ it deems [o be appropriate and utilizing whatever reaources might be
available.
