A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
PROVIDING FOR LIEN ASSESSh1ENTS AND FOR TfIE COLLECTION OF
; SAME RESULTINC FROM THE ABATEMENT OF PUBLIC NUISANCES
WHEREAS, after due notice a public hearing tliereon was held at a reRular meeting
of the City Council of December 7, 1981 a[ which time the City Council declared
that the growth of weeds, the accumulation of garbage, refuse, cuttings and other
combustible trash upon certain properties as described in City oE Cupertino Resolution
No. 5758 to be a public nuisance; and
WHEREAS, from the evidence presented, hoth oral and written, the City Council
acquired ~urisdiction over and aba[e said nuisances; und
WNEREAS, after duenotice of a report on proposed assessments was sent by registered
letter to the affected property owners a[ the address appearing on the tax roles, which
letter advised tha[ a hearing would be held at the City Council meeting of September 7,
1982; and
WHEREAS, said hearing was held by [he City Council at the time and place fixed
for thereceiving and considering of such report and proposed assessment.
NOW, THEREFORE, BE IT RESOLVED that the City Cauncil does hereby confirm that the
cos[s of ahating said nuisances shall be as set forth on Exhibit "A" attached hereto
and made a part hereof and said costs shall constitute a lien on the affected property.
BE IT FURTtiER RESOLVED that the County Fire Marahal shall cause the amount of the
assessments to be entered on the County Assessment Roll opposite the description
of the particular proper[y, which assessment so entered on the County rolls shall be
collected toge[her with all other [axes thereon upon the property at the same time and
in the same manner, as general City taxes are collected and ahall be sub,ject to the
same penalties and interest, and the same procedure and sale in the case of delinquency
as provided for City taxes.
