m3nagemen[ employee is any empioyee having significant responsibilities
for Eormulnting and adminlsterinF Ctty policies and programe, including
but not limited to [he chief execu[ive officer and department heads; and,
any employee having authority to exercise independen[ judgment to hire,
transfer, suspend, lay off, recall, promo[e, discharge, assign, reward or
discipline otlier emplnyees, or having the responsibility to direct them,
or to adjus[ tlieir grievances, or effectively to recommend such action if

ment Compensatlon Pragram ahall be compensated For services rendered to and
on belialf of tlie City on the basis of equitability of pay for duties and
responsibilities assigned, meritorious service and comparability with aimilar
work in other public and priv~te employment tn the same labor market; all
of wliicli is contingent upon the City's ability to pay coneistent with its
fiscal policies.
As rates of pay and schedules of pay grades developed through meet
and confer processes are subJect to [he underlying provisions of [he Pay
Plan for administration purpases so are those rates of pay and scUedule of

' A. Management Personnel
It is City of Cupertino policy that eligible persons, other than the Ci[y
htanaFer, under the Management Compens~tion Program shall be reimbursed
in acr.ordance w{Lh the schedules, terms and conditions as set forth here-
[n fnr at[endance :~t conferences, meetings and [r~tning sessions as de-
fined helow Cor each. It is the in[ent of thts policy to encourage the
contim~ing education and awareness of said persons in the technical im-
provcmen[s :~nd innovations in thelr fields of endeavor as they apply to
~l~e City. One moans of implement[ng [his encouragement is through ~ formal
reimUursement schedule for authorized a[tendance at such conferences,
meeting5 and tr~ining sessions.
B. tVon-Management Personnel
When authc~rized by a department head, a non-management person may attend
a con[erence, meeting or [raining session subjer.t [o the stated terma
and conditions included herein for each with payment toward or reim-
Uursement of certain expensea incurred being limited to authorized
actual costs thereof.
II. DEFINITIONS

LII. REIMBURSEh1ENT SCHEDULE
A. Registration ~

or training session will be paid by the City.
B. Transportation
When an exp~ndlture is au d~orized or is eligible for reimbursement, the
City witl pay transpor[ation costs from the attendee's home to the

by air at alr co~ch fare. Transportation costs ulso may include limousine

Reimbursement for use of a personal automobile on City businesa within

' Pnyments tnward or relmbursement of hotel or lodging expenses is limited
to the actual costs of the room. Such payments or reimbursements shall
not be madc for hotel or lodging expense when incurred within the local
~ area. F.xceptions to tliis requlrement shall be for attendance at tl~e
Annual Le~gue of California Cities Conference and for those nights
when attendance at other conferences, meetings and training sessions
i official functions would preclude the return to the City by the attendee
~ within two hours after ttie end of the normal working day.
~ D. Per Diem

~ For conferences, meetings and training sessions lasting two or more
days, per diem allowance shnll be allowed in lieu of actual costs
for Cood, tips, miscellaneous expenses, etc., unless otherwise noted
lierein [o the contrary. Payments toward or reimbursement of attendance
at such functions las[ing less than two days shall be limited to the
actual costs consistent with the application of reasonable etandarda.
Costs of special luncheon or dinner meetings or other programs on [he
agend~ and no[ covered by registration feea may be paid or reimbursed
in additton to the per diem allowance when approved by the City Council
or the City t4annger.
The authorized per diem rate shall be $30.00 for attendance at conferences,
meetinf;s or training aessions held within [he State and $35.00 for such
attendance out of state.
No payment si~all Ue made for any expenses i.ncurred whicL are of a personal
nature or not wltliin a standard of reasonableness for the ai[uation as
may be defined by the City Mana6er.
IV. ATTF.NllAtdCE AUTIIORIZATION ~
A. Budgetary Limitations
Notwlthstanding any attendance, autliorization contained herein, teimburse-
ment for expenses incurred or expenditures made relative to conferences,
mee[ings or training aessiona shall ?ot exceed [he budgetary limitations.
Ii. A department liend and one designa[ed assistant may attend a conference.
Attendancc by any otiier employee, managemen[ or non-management, may be
authorized by the department he~d subject to such attendance being on
the employce's own time (compensatory time off or vacation time) and
with transportaeton nnd loJging bcing at the employee~s own expenae.
Tiie City may pay registration fees. •
C. Meetings ~
My employee, management or non-management, may at[end a meeting when
' authorized by the depar[ment head.

V. FUI~DING
; A. Approprla[ion Policy
' It shall be the policy of the City to appropriate fund's as set forth
i herein with sucli appropriationa being sub,ject to availabili[y of resourcea.
~ B. Appropriations wLll be made on tlie basis of $1,320.00 for eacli depart-
~ ment head, $1,OL0.00 [or cach desi~nated ~st~ff, and S~+b0.00 for each desig-
• nated assistant to be used as paymen[s [oward or reimbursement of ex-
penses incurred for a[[endance at conferences anJ meetings. The confetence
or meetinp„ location and attendee shall be c~t the discretion of the de-
partment head.
C. Trainin~ Sessions
For payments toward or reimbursement of expenses incurred in attendance
at training session, appropriation caill be made on the basis of $150.00
for department hends and designated staff and $100.00 for each remaining
employee designated management.
There also wlll be nppropriated to thc Departmen[ of Parks and Recreation
$425.OU per year to be used ns payments toward or reimbursement of ex-
penses incurred for its in-service training programs.
Excluded from this funding capability !s that amount to be determined
each year and appropriated to the Feraonnel Division for costs incurred
in training programs of a general nature and applicable to all ~mployees.

nent Compensation ProFram shall be compensnted Cairly for the use of personal
a~itomotive vehicles on Ci[y businesa. In many inatances the use of personal
vehicles Is a condition of empLoyment due to [he absence of sufficient City
owned vehicles for general transporta[ion purposes. It is not intended,
however, that such a condition of employmenC ahould work an undue hardship.
For this reason ttie follorrinq policies sliall apply for automobile allowancea
and mileage reimbursements.

memUerships as well as receiving subscriptions to professlonal and technical
puUlication~. Sucl~ sponsorship, however, ehall be conditioned upon the several
factora as set forth below.
Each association for which membership is claimed mus[ be directly
rela[ed to the field of endeavor of the person [o be benefited. Each claim
for City sponsored membership shal.l Ue SuUmitted by or through the depart-
ment head wid~ his concurrence to the City Pfanager for approval.
Ptembersiiips in associations as sponsored by the City shall be limited
to not more than one perAOn for each association except as may o[herwise

Individuals designated as n part of management are employed to perform

ments are cyclical and provide later oppoctunities foc some relief from [he
extendeJ work efforts. At such [imes wheo it is possible to do so, it is ex-
pected [hat the affe~~[ed person and his supervisor mu[ually will agree as to
when compensatory time off will be taken.
It is the titated purpose of this poltcy to provide some periods of
[ime for eligihle employees to relax and become disaseocLated from the stresses
uf work and, in part, toc~fferrecognition for the demands of required but
unrecorded "overtlme".

FLEXIBLE HOLIDAYS
It is the policy of the City of Cupertino to recognize days of historical
and natlonal sLgnificance as I~olidays of tlie Ctty without loss of pay or
benefi[s. Recognizing the desiraUle continuance of municipal services by
management ermplayees resulti.nF from scheduling of occasional
holidays at variaole times throughout the year, it is [I~e policy of the City
of Cupec[ino to provide days off in lieu of holidays for management
cmpl~yees at such times as are convenient for each employee
and supervlsor, wi~en sucl~ policy is compatible with tlie workload and echedule
of tiie Ci[y.
Gmployees occupying management positions shall he
provided one day per calendar year as a non-work day with Eull pay and
benefits in ~ddition to tliose holidays set forth in Sec[ion 8.1 of the Rules
on Conditions of Employmen[. Sec[ion 8.1 of tiiese rules is furti~ermore ex-
pressly modified by this policy to permit each management and confidential
employee to observe a day off in lieu of Lincoln's Birthday at such [imea

of Cupertino to provide n certain sum per month that may be applied to the
' credit of eligiUle omployeeg in the form and mnnner preferred by each employee.
This program of personalized and flexible compensa[ion resul[s from the need
to maintain parity with the competitive labor market and to assure that internal
pay rcl~tio~ships are not distorCed be[ween managemen[ employees and employees
hargaining nver cundi[ions of employment, whtle recognizing [he advantages of
[ailoring c~~mpensation to the variety of individual circumstance.
Each employee designated as classified management by the Appointing Authority
shait receive p~yment or equivalent direct campensation for services performed in

Personalized Compensation
The following procediiral nnd administrative rules and regulations are
those under ~ahlch the program of personallzed compensation will be admin-
ititrred. In the event that Further clariticat[on is needed as to the inten[
of the program nr lhat some modification is requlred in these rules and regula-
tions such shall be ae set forCh in writing Uy either the Appointing Authority
(Ctty llanagcr) or the Personnel Officer.
1. The p:~yment or equivalent direct campen5ation for services
performed (.illowance) under Policy No. l0 is effective with
the month of Sep[ember, 1974. For e~ch succeeding month,
[he referred [o allowa~ce will be credited to the account

month of assure proper disbursement as required du~ing that
month.
2. S:~{d monthly allowances will be disbursed on authorization
of the CitY's pcrsonnel office onl.y after having received

priate will evaluate the requests for accept~bility under
standards for City sponsorship. These standards shall include
