OF Tf1E CITY OF CUPERTINO CERTIFYING REVIEW AND CONSIDERATI.ON OF TH~ F,NVIRONMENTAL IMPACT REPORT: INTERLAND DEVELOPMENT COMPANY, "SEVEN , ~ SPRINGS RANCH DEVELOPMGNT" , WHEREAS, the Interl~nd Development Company proposes to construct a 419-unit residential planned development located on 148 acres at the north- I west corner of the intersection of Prospect Road and Stelling Road ("Seven Springs Ranch"); and WHEREAS, the City of Cupertino has prepared and submitted an Environmental I Impact Report for review by the decisionmaking body pertaininQ to the project; ' and , WHEREAS, the final Environmental Impact Report was reviewed in conjunction ' with the public hearinRs for prezoning Application 25-Z-80; and WFIEREAS, [he significant environmental effects of the project identified 1 in the Environmental Impac[ Report have been mitigated by the following plan changes and development conditions of approval. I SIGNIFICANT EFFECT MITIGATION MEASURE I A. Traffic and Circulation Condition No. 17 of Planning Commission Resolution 2303 requires the applicant to participate in a proportlonate share of major off-site street improvements of a local and communitywide nature. It is further stipulated that at the use permit and buildinR permit stages, phasing will be determined in canjunction with mitigation measures consistent with the adopted General Plan. The site plan is to be modlfied, as required by Condition 18 of Planninp, Commission Resolution 2303, re~arding on- site cirr.ulation and its effect nn nei~hboring residential streets. Additional access to the property is required. Interior circulation modifications will be required to disrnuraRe vehicular traffic cuttinR i throu~h the project to existing residential streets. Additionally, the applicant shall provide a detailed trafEic control plan for Rainbow Drive between Bubb Road and Southern Pacific Railroad crossine to reduce vehicular ~ volumes and speeds and discourage penetration i into existing neighborhoods. ,As provided 6y Condition No. 22, public access is being assured to the Fremont Older Open Space District property at [he present terminus of Upland Wny. i -1- ~ Resolution No. 5~ (continued) • B. Noise A number of noise miti~ations will be . required as a part of the development to maintain an acceptable noise environment for project residents. These measures will include sound insulation, berms, noise barriers, distant setbacks, etc. Cons[ruc[ion noise will be restricted to nocmal working hours with equipment muffled in accordance with health and safety standards. WHEREAS, the following significant environmental effec[s of the project II identified in the Environmental Impact Report cannot be mitigated, a statement of overriding considerations based upon inFormation of record and the Final Environmental Impac[ Report are set forth below. SIGNIFICANT EFFECT OVERRIDING CONSIDERATIONS ''i A. Noise Pro~ect Renerated traffic will not increase I ambient noise levels on adjacent streets in a perceivable mauner with exception of li Prospect Road west of Slellin~ Road. This il roadway would increase by 4 decibels to n I community noise equivalent level of 51 to , 55 decibels which is consistent with tht ~I conditionally "acceptable level" within 'I the adop[ed City General Plan. B. Conversion of ARricultural Projec[ entails the conversion of approxi- Use mately 80 acres of aFricultural use to urban uses. Information of record submitted as part of the Environmental Impact Report demonstrates the economic, nan-viability of the existinR aRricultural use. Additionnlly, i[ is proposed to main[ain community a~ricultural uses such as ve~e[ablc Fardene and productive fruit trees as part of [he open sp~ce and landscaped areas. Due to the size of the aRricultural use and its relation to surroundin~ urban uses, it has , been deemed that the production of nceded ' housin~ for the community outwei~hs the con[inued uneconomic use of aRric~lture. NOW, THEREFORE, it is hereby found, determined and ordered that the City Council of the City of Cupertino, ns responsible agency, has considered said Enviranmental Impact Report and hereby certifies thnt it has reviewed and considered the inEormation contained therein nnd that the Environmental Impact Report hns been completed in compliance with the CEQA und State guidelines. Council finds further that alterations have been incorporated into the projec[ which mitiRate , or avoid each signi£icant environmental impact identified in the Environmental • Impact Report [o an acceptable level as defined in Section 8.7 of the Cupertino Environmental Guidelines.
